NOTIFICATION
New Delhi, the 8th October, 2025
G.S.R. 739(E). — Whereas, to provide for issuance of carbon credit certificates to the obligated entities
under section 14(AA) of the Energy Conservation Act, 2001 (52 of 2001) (hereinafter to referred as the said Act)
which complies with the requirements of the carbon credit trading scheme;
AND WHEREAS, The Central Government has notified the Carbon Credit Trading Scheme, 2023
(hereinafter referred to as the said Scheme), vide S.O. 2825(E) dated 28th June 2023, under the powers conferred by
clause (w) of section 14 of the Act;
AND WHEREAS, under the compliance mechanism of the said Scheme as recommended by the Ministry of
Power based on the recommendations of Bureau of Energy Efficiency and National Steering Committee for Indian
carbon market, greenhouse gases emission intensity targets for the obligated entities are to be notified by the Ministry
of Environment, Forest, and Climate Change;
AND WHEREAS, for this purpose, the draft Greenhouse Gases Emission Intensity Target Rules, 2025, was
published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i), vide notification number G.S.R.
234(E), dated the 16th April 2025, for inviting objections and suggestions from all persons;
AND WHEREAS, all the objections and suggestions have been duly received and considered by the Central
Government;
NOW, THEREFORE, in exercise of the powers conferred by section 3, section 6 and section 25 of the
Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby makes the following
rules, namely:—
1. Short Title and Commencement .– (1) These rules may be called the Greenhouse Gases Emission Intensity
Target Rules, 2025.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Definitions. – (1) In this rules, unless the context otherwise requires,-
(a) "banked" means the number of carbon credit certificates remaining with an obligated entity after the
completion of compliance for the respective compliance year;
(b) "compliance year" means the financial year as referred in column (5) of the Schedule appended to these
rules;
(c) "greenhouse gases emission intensity targets" means targets in terms of tCO2e per equivalent output or
product as referred in column (5) of the Schedule appended to these rules;
(d) "Schedule" means the Schedule appended to these rules.
(2) The words and expressions used herein and not defined but defined in the Environment Protection Act,
1986 (29 of 1986), the Energy Conservation Act, 2001 (52 of 2001), the Electricity Act, 2003 (36 of 2003)
and the Carbon Credit Trading Scheme, 2023, shall have the same meanings respectively as assigned to them
in those Acts and under the said Scheme.
3. Greenhouse gases emission intensity targets. – (1) The greenhouse gases emission intensity targets shall
be calculated as per the methodology described in the detailed procedure as provided under the said Scheme.
(2) The greenhouse gases emission intensity targets, for the specified trajectory period shall be as given in
the Schedule.
4. Responsibilities of the obligated entities. – The obligated entity shall, –
(1) achieve the greenhouse gases emission intensity targets in the respective compliance year as per the
Schedule;
(2) meet its greenhouse gases emission intensity target under paragraph 11 and detailed procedure under
the said Scheme;
(3) surrender the banked carbon credit certificates or carbon credit certificates purchased in the respective
compliance year equivalent to the shortfall to comply with the greenhouse gases emission intensity
target;
(4) register on the portal under Indian Carbon Market Framework;
(5) submit all the documents in the manner as stipulated in the detailed procedure under the Scheme:
Explanation: For the removal of the doubts, it is hereby clarified that the obligated entities fail to
submit the documents, the shortfall shall be calculated as the carbon credit certificate to be purchased
as provided in the formula under the paragraph 5 of these rules, where achieved greenhouse gas
emission intensity shall be considered as baseline greenhouse gas emission intensity;
5. Issuance of Carbon Credit Certificates. - (1) Bureau shall issue the carbon credits certificate as per the
clause (c) of sub-paragraph 2 of paragraph 5 of the Scheme.
(2) The carbon credit certificates to be issued to the obligated entities under the said Scheme, shall be
determined as per the following formula, namely,-
(greenhouse gases emission intensity target for that compliance year – greenhouse gases emission
intensity achieved in that compliance year) multiply by unit of equivalent product produced in that
compliance year is equal to number of carbon credit certificates to be issued for the respective compliance
year;
(3) The number of carbon credit certificates to be purchased by the obligated entities to meet the shortfall
under the said Scheme, shall be determined as per the following formula, namely,-
(greenhouse gases emission intensity achieved for that compliance year – greenhouse gases
emission intensity target in that compliance year) multiply by unit of equivalent product produced in that
compliance year is equal to number of carbon credit certificates to be purchased for the respective
compliance year;
(4) The carbon credit certificates issued or purchased may be banked by the obligated entities as provided in
the detailed procedure under the said Scheme.
6. Environmental compensation. – (1) In case an obligated entities fail to comply with or contravene any
provisions of the paragraph 4 of these rules; the Central Pollution Control Board shall impose environmental
compensation Order on such obligated entities for the shortfall in the respective compliance year which shall
be equal to twice of the average price at which carbon credit certificate is traded during the trading cycle of
such compliance year.
Explanation: for the purposes of these rules, it is hereby clarified that the average price shall be determined
by the Bureau.
(2) No Order for imposition of the environmental compensation shall be made unless the obligated entities
have been given reasonable opportunity of being heard.
(3) Environmental Compensation shall be paid within the 90 days from the day of such imposition of the
Order.
Provided that obligated entity who fails to pay the environmental compensation shall be liable to pay penalty
under the Environment Protection Act, 1986.
(4) The fund collected under the Environmental Compensation shall be maintained in a separate account and
utilised for the purposes of the said Scheme on the recommendation of the National Steering Committee for
Indian carbon market and subsequent approval of the Central Government.
