L.-33004/99 The Gazette of India CG-DL-E-09022024-251974 EXTRAORDINARY PART II-Section 3-Sub-section (ii) PUBLISHED BY AUTHORITY No. 563] NEW DELHI, FRIDAY, FEBRUARY 9, 2024/MAGHA 20, 1945 MINISTRY OF POWER ORDER New Delhi, the 9th February, 2024 S.O. 594(E).—Whereas M/s ABC Renewable Energy Private Limited has its registered address at 6-3-680/8/3, PMR Plaza, Thakur Mansion Lane, Somajiguda, Hyderabad-500082 has applied for grant of authorization under Section 164 of the Electricity Act, 2003 for laying of overhead transmission line under “Connectivity transmission system for the evacuation of 400 MW solar power project being developed by ABC Renewable Energy Private Limited near village - Harwa, Tehsil-Sheo, District-Barmer in Rajasthan". And whereas, Ministry of Power, Government of India vide its letter No. 25-17/12/2023-PG dated 26.07.2023 had granted prior approval under section 68(1) of the Electricity Act, 2003 for the overhead line covered under "Connectivity transmission system for the evacuation of 400 MW solar power project being developed by ABC Renewable Energy Private Limited near village - Harwa, Tehsil-Sheo, District-Barmer in Rajasthan". M/s ABC Renewable Energy Private Limited had published notice for transmission scheme in local newspapers Hindustan Times (in English) dated 12.08.2023, Dainik Navajyoti (in Hindi) dated 12.08.2023, and in Weekly Gazette of India dated 02.09.2023 for the general public to make observations/representations on the proposed transmission route within 2 Months from the date of publication. Subsequently, M/s ABC Renewable Energy Private Limited has submitted an affidavit dated 20.12.2023 declaring that no observation/representation was received within 2 Months from the date of Publication in the official gazette of Government of India. And now the applicant has requested to confer upon him, all the powers under section 164 of the Electricity Act, 2003, which the telegraph authority possess under the Indian Telegraph Act, 1885 with respect to the placing of telegraph lines and posts for the purpose of a telegraph established or maintained by Government or to be so established or maintained for laying of transmission lines under “Connectivity transmission system for the evacuation of 400 MW solar power project being developed by ABC Renewable Energy Private Limited near village - Harwa, Tehsil-Sheo, District-Barmer in Rajasthan". The following overhead line is covered under this scheme: 1. ABC Renewable Energy Private Limited (Generation switchyard in Sheo Tehsil, Barmer district, Rajasthan) -Fatehgarh - III - PS (ISTS substation) 220 kV S/C transmission line". The approval is granted for 25 years. ii. The Applicant shall have to seek the consent of the concerned authorities i.e., local bodies, Railways, National Highways, State Highways etc. before erection of proposed line. iii. The Applicant shall have to follow regulations/codes of the Appropriate Commission regarding transmission, O&M, open access, etc., framed under Electricity Act, 2003. iv. The Applicant shall operate the line after approval of Electrical Inspector / Chief Electrical Inspector of Central Government. v. The approval is subject to compliance of the requirement of the provisions of the Electricity Act, 2003 and the rules made there under by the applicant. vi. M/s ABC Renewable Energy Private Limited shall have to submit the requisite clearances to Central Electricity Authority after obtaining the same from concerned authorities like Civil Aviation, Defense etc., at the time of Electrical Inspection. vii. In case, the route of above overhead lines (or some portion of the route of above overhead line) falls in the Great Indian Bustard (GIB) potential zone (or priority zone) marked in the map which is part of the order of the Hon'ble Supreme Court order dated 19.04.2021, in the petition No.838 of 2019 regarding Great Indian Bustard (GIB) case, the applicant has to comply with the directions of the Hon'ble Supreme Court, with regard to undergrounding of the above overhead transmission line and / or fixing of bird diverters, as the case may be as per the Hon'ble Supreme Court Order dated 19.04.2021 and the directions of the technical committee constituted by the Hon'ble Supreme Court in this regard.
