L.-33004/99 The Gazette of India CG-DL-E-08012025-260047 EXTRAORDINARY PART II-Section 3-Sub-section (ii) PUBLISHED BY AUTHORITY No. 142] NEW DELHI, WEDNESDAY, JANUARY 8, 2025/PAUSHA 18, 1946 MINISTRY OF EXTERNAL AFFAIRS NOTIFICATION New Delhi, the 6th January, 2025 S.O. 144(E).— WHEREAS the Government of India signed an Agreement with International Atomic Energy Agency (hereinafter referred to as the Agency) for the Application of Safeguards to Civilian Nuclear Facilities in India on 2nd day of February 2009, which came into force on 11th May, 2009; AND WHEREAS the Government of India signed an Agreement on the Privileges and Immunities for the Agency (hereinafter referred to as the said agreement) on 2nd day of February 2009; AND WHEREAS the provisions of the said agreement provide for privileges and immunities to International Atomic Energy Agency, to its representatives and officials; AND WHEREAS the Agency, its assets, income and other property shall be exempt from customs duties and prohibitions and restrictions on imports and exports in respect of articles imported or exported by the Agency for its official use as per the provisions of section 8(b) of Article III of the said agreement ; AND WHEREAS the Central Government considers it expedient to extend the necessary privileges and immunities provided under the United Nations (Privileges and Immunities) Act, 1947 (46 of 1947) to the Agency and to its representatives and officials; NOW, THEREFORE, in exercise of the powers conferred by section 3 of the United Nations (Privileges and Immunities) Act, 1947 (46 of 1947), the Central Government hereby declares that the provisions of Articles I to VIII of the Schedule to the said Act shall apply, mutatis mutandis, to the International Atomic Energy Agency and to its representatives and officials, subject to following modifications, namely:- In the Schedule to the said Act, for the words “The United Nations" and "Secretary General" wherever they occur, the words “International Atomic Energy Agency” and “Director General" shall respectively be substituted.
