This authorization excludes public servants not removable from office save by or with the sanction of the Government. Furthermore, no court shall take cognizance of an offence alleged to have been committed by a public servant while acting in the discharge of official duty, except with the previous sanction of the Central Government (for Union affairs) or the State Government (for State affairs). II/551/10/2023] MINISTRY OF EXTERNAL AFFAIRS ORDER New Delhi, the 26th May, 2026 S.O. 3022(E). — In exercise of the powers conferred by section 15 of the Passports Act, 1967 (15 of 1967), and in supersession of the notifications of the Government of India in the Ministry of External Affairs number G.S.R. 662 (E), dated the 1st December, 1979 and G.S.R. 370 (E), dated the 9th February, 2010, the Central Government hereby authorises all State Governments, the Administrators of the Union territories, and in respect of the State of Tamilnadu, the Commissioners of Police (Chennai City, Chennai Sub-urban, Coimbatore, Tiruchirappalli, Madurai, Tirunelveli and Salem) and the District Collectors of all the districts in the said State, to sanction prosecution within their respective territorial jurisdictions in respect of the offences under section 12 of the said Act against any person, except a public servant not removable from his office save by or with the sanction of the Government. 2. When any person, who is or was a public servant, not removable from his office save by or with the sanction of the Government, is accused of any offence alleged to have been committed by him while acting or purporting to act in the discharge of his official duty, no court shall take cognizance of such offence, except with the previous sanction, - (a) in the case of a person who is employed or, as the case may be, was at the time of commission of the alleged offence employed, in connection with the affairs of the Union, of the Central Government; (b) in the case of a person who is employed or, as the case may be, was at the time of commission of the alleged offence employed, in connection with the affairs of a State, of the State Government.
