NOTIFICATION
New Delhi, the 6th October , 2023
S.O. 4354 (E).— In exercise of the powers conferred by sub -section (3) of section 3 of the Environment
(Protection) Act, 1986 (29 of 1986) and in pursuance of the notification of the Government of India in the erstwhile
Ministry of Environment and Forests, number S.O. 1533(E), dated the 14th September, 2006 (here inafter referred to
as the said notification), the Central Government hereby constitutes the State Level Environment Impact Assessment
Authority for Assam (hereinafter referred to as the Authority) comprising of the following persons, namely: -
(i) Sri Rajesh Kemprai,
Special Commissioner and Special Secretary (Retd.),
Public Works (Roads), Gover nment of Assam, House No.101, Pratistha
Apartment, Basisthapur, Bye Lane No.4, Survey, Beltola, Guwahati -
28. -Chairman;
(ii) Dr. Sarat Phukan,
Professor, Department of Geological Science, Guwahati University,
Guwahati -781014. -Member;
(iii) Secretary to the Government of Assam, Environment and Forest
Department. -Member Secretary.
2. The Chairman and Members of the Authority shall hol d office for a period of three years from the date of
publication of this notification in the Official Gazette.
3. The Authority shall exercise such powers and follow such procedures as specified in the said notification.
4. The Authority sha ll take its decision on the recommendations of the State Level Expert Appraisal Committee
constituted under paragraph 5 for the State of Assam.
5. The Central Government, in consultation with the State Government of Assam, for the purpose of assistin g the
Authority, hereby constitutes the State Level Expert Appraisal Committee (hereinafter referred to as the Committee),
comprising of the following persons, namely: -
(i) Shri Jatindra Sarma,
Field Director, Kaziranga National Park (Retd.),
Near Chand mari Flyover, Behind Kalabhumi, BSNL Tower (House No. 3), Chandmari,
Guwahati -781021. -Chairman;
(ii) Dr. Apurba Kumar Das,
Professor, Department of Environmental Science, Tezpur University, Tezpur -784028. -Member;
(iii) Dr. Bijoy Sankar Goswami,
Sr. Ass t. Professor, Department of Chemistry,
B. Borooah College, Guwahati. -Member;
(iv) Dr. Rahul Mahanta,
Associate Professor, Physics Cotton University, Guwahati, Assam -781001. -Member;
(v) Shri Arup Barpujary,
Jonaki Nagar, Near Pratiksha Hospital, House No. 36 -AB, P.O.: Hengrabari, P.S.: Dispur,
Dist.: Kamrup (M), Guwahati -781036. -Member;
(vi) Dr. Raza Rafiqul Houque,
Department of Environmental Science, Tezpur University, Tezpur -784028. -Member;
(vii) Shri Shantanoo Bhattacharyya,
Additional Chief Eng ineer (Retd.), Assam Public Works Department, Government of
Assam, House No. 2, Government Press Road, Bamunimaidam, Guwahati -781021. -Member;
(viii) Member Secretary,
Pollution Control Board, Assam. -Member
Secretary.
6. The Chairman and Members of the Committee, shall hold office for a period of three years from the date of
publication of this notification in the Official Gazette.
7. In order to avoid any conflict of interest, -
(i) the Chairman and Members of the Authority, and the Committee shall -
(a) declare to which consulting organisation they have been associated with and also the project
proponents;
(b) not undertake any consultation or associate with regard to preparation of Environment Impact
Assessment and Environme nt Management Plan for project, which is to be decided by the Authority, or
to be appraised by the Committee during their tenure; and
(ii) in the preceding five years, if the Chairman or any Member of the Committee has provided consultancy
services or conducted Environment Impact Assessment studies for any project proponent, they shall recuse themselves
from the meetings of the Committee from the process of appraisal of any project proposed by such proponents.
8. The Committee shall exercise suc h powers and follow such procedures as specified in the said notification.
9. The Committee shall function on the principle of collective responsibility and the Chairman shall endeavour to
reach consensus in each case, and if they fail to reach con sensus, the view of the majority shall prevail.
10. (i) The State Government of Assam shall specify an agency to act as secretariat of the Authority and the
Committee.
(ii) The secretariat shall provide financial and logistic support including accommodat ion, transportation and such
other facilities in respect of their functions under the said notification.
11. The sitting fee, travelling allowances and dearness allowances to the Chairman and Members of the Authority
and the Committee, shall be paid in accordance with the provisions of relevant rules, of the State Government of
Assam.
