ORDER
New Delhi, the 28th June, 2023
S.O. 2983(E) .—whereas M/s SJVN Limited, the applicant with its registered office at Shakti Sadan , Corporate
Office Complex, Shanan, Shimla -171006, has applied for authorization under Section 164 of the Electricity Act, 2003
for laying of electric line under the transmission scheme “Connectivity to M/s SJVN Limited for its 1000 MW Solar
Power Plant in Bikaner, Rajasthan”.
And whereas, CEA, Ministry of Power, Government of India vide its letter no. I/24468/2022 dated
11.11.2022 had granted prior approval under section 68(1) of the Electricity Act, 2003 to M/s SJVN Limited for the
overhead lines covered under the transmission scheme “Connectivity to M/s SJVN Limited for its 1000 MW Solar
Power Plant in Bikaner, Rajasthan”.
M/s SJVN Limited had published notice for transmission scheme in local newspapers dated 15.11.2022
(Times of India, Hindustan Times, R ajasthan Patrika and Dainik Bhaskar) and in Weekly Gazette of India dated
10.12.2022 to 16.12.2022 for the general public to make observations/representations on the proposed transmission
route within 60 days from the date of publication. Subsequently M/s SJVN Limited has submitted an affidavit dated
15.02.2023 declaring that 01 objection was received from M/s Juniper Green Cosmic Private Limited (JGCPL), within
two months from the date of publication in gazette. However, the same was withdrawn by M/s JGCPL vide letter
No. JGPCL/Raj/2023/01/04 dated 09.02.2023. Further, no other objections/representations have been received from
the public within 60 days of publication of Public Notice for the above transmission scheme in Newspapers/ Gazette
of India.
And no w the applicant has requested to confer upon him, all the powers under section 164 of the Electricity
Act, 2003, which the telegraph authority possess under the Indian Telegraph Act, 1885 with respect to the placing of
telegraph lines and posts for the pur pose of a telegraph established or maintained by Government or to be so
established or maintained for laying of electric lines under the transmission scheme “Connectivity to M/s SJVN
Limited for its 1000 MW Solar Power Plant in Bikaner, Rajasthan”. The fol lowing overhead lines are covered under
this transmission scheme:
“SJVN generation pooling substation – Bikaner -II PS 400kV S/C line on D/C tower (approx. 22 km)”
The above overhead lines included under the scheme will pass through, over, around and betwee n the following
villages, towns and cities:

Now, after careful consideration, Ministry of Power, Government of India, under section 164 of the Electricity
Act, 2003, confers all the powers to M/s SJVN Limited for laying above overhead lines, which telegraph authority
possesses under th e Indian Telegraph Act, 1885 with respect to placing of telegraph lines and posts for the purposes of
a telegraph established or maintained, by Government or to be established or maintained subject to following terms
and conditions for installing the above mentioned lines, namely:
i. The approval is granted for 25 years;
ii. The Applicant shall have to seek the consent of the concerned authorities i.e. local bodies, Railways, National
Highways, State Highways etc. before erection of proposed lines;
iii. The Applicant shall have to follow regulations/codes of the Appropriate Commission regarding transmission,
O&M, open access, etc., framed under the Electricity Act, 2003.
iv. The Applicant shall operate the lines after approval of Electrical Inspector / Chief Electrical Inspector of
Central Government.
v. The approval is subject to compliance of the requirement of the provisions of the Electricity Act, 2003 and
the rules made there under by the applicant.
vi. M/s SJVN Limited shall have to submit the requisite clearances to Cent ral Electricity Authority after
obtaining the same from concerned authorities like Civil Aviation, Defence etc., at the time of Electrical
Inspection.
vii. In case, the route of above overhead lines (or some portion of the route of above overhead line) falls in the
Great Indian Bustard (GIB) potential area (or priority area) marked in the map which is part of the order of
the Hon’ble Supreme Court order dated 19.04.2021, in the petition No.838 of 2019 regarding GIB case, the
applicant has to comply with the dire ctions of the Hon’ble Supreme Court, with regard to undergrounding of
the above overhead transmission line and/or fixing of bird diverters, as the case may be as per the Hon’ble
Supreme Court Order dated 19.04.2021 and the directions of the technical commi ttee constituted by the
Hon’ble Supreme Court in this regard.
