In exercise of powers under sub-sections (1) and (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986), the Ministry of Environment, Forest and Climate Change, via Order S.O. 5209(E) dated 3rd December 2024, constitutes the Lakshadweep Coastal Zone Management Authority for a period of three years from the date of publication. The Authority comprises nine members: the Adviser to the Administrator, Union territory of Lakshadweep Administration (Chairman, ex officio); Secretary, Department of Environment and Forests (Member ex officio); Collector, Union territory of Lakshadweep (Member ex officio); Secretary, Department of Urban Development (Member ex officio); Director, Department of Fisheries (Member ex officio); Prof. Ramesh Ramachandran, Advisor, Tamil Nadu Green Climate Company (Expert Member); Dr. C. Raghunathan, Additional Director, Zoological Survey of India, Kolkata (Expert Member); a representative of Suganthi Devadason Marine Research Institute, Tuticorin (Member, Non-Government Organisation); and the Member Secretary, Lakshadweep Pollution Control Committee (Member Secretary, ex officio). The Authority's headquarters shall be at Kavaratti, Lakshadweep, with a quorum of one-third of total members, and members other than ex officio members shall be paid allowances as decided by the Central Government. The order specifies functions including examination of project proposals under the Integrated Islands Management Plan (notified vide S.O. 20(E) dated 6th January 2011), regulation of developmental activities in Coastal Regulation Zone areas, issuance of directions under section 5 and exercise of powers under section 10 of the Act, filing complaints under section 19, review of alleged violations of the notification dated 30th September 2022 (S.O. 4650(E)), a requirement to maintain a public website for transparency, and biannual activity reporting to the Central Government. Adviser to the Administrator, Union territory of Lakshadweep Administration Chairman, ex officio; 2. Secretary, Department of Environment and Forests, Union territory of Lakshadweep Administration Member, ex officio; 3. Collector, Union territory of Lakshadweep Administration Member, ex officio; 4. Director, Department of Fisheries, Union territory of Lakshadweep Administration Member, ex officio; 6. The Headquarter of the Authority shall be at Kavaratti, Lakshadweep. 3. The quorum for the meeting of the Authority shall be one-third of the total number of its Members of the Authority. 4. A Member, other than member ex officio, shall be paid allowances as per the terms and conditions decided by the Central Government in this behalf. 5. In order to avoid any conflict of interest, the Chairman and Member shall recuse himself from the meeting of the Authority, in the process of appraisal of any project, for which they have rendered consultancy service. 6. The Authority shall take following measures for protecting and improving the quality of the coastal environment and preventing, abating and controlling environmental pollution in the Union territory of Lakshadweep, namely: (i) examination of proposals received from the project proponent for approval of project proposal, in accordance with the approved Integrated Islands Management Plan prepared under the notification of the Government of India, number S.O.20 (E), dated the 6th January, 2011 (hereinafter referred to as the said notification), and make recommendation for approval of project to the concerned authority, as specified in the said notification; (ii) regulate all developmental activities in the Coastal Regulation Zone areas as specified in the said notification; (iii) issue directions under section 5 of the said Act, as specified in the notification of the Government of India in the Ministry of Environment, Forest and Climate Change published in the Gazette of India, number S.O. 4650(E), dated the 30th September, 2022; (iv) exercise powers under section 10 of the said Act; (v) file complaint under section 19 of the said Act; (vi) examination of proposals received from the Union territory of Lakshadweep for changes or modifications in the Integrated Islands Management Plan and make specific recommendations thereon, to the Central Government; (vii) inquire and review the cases of alleged violation of the provisions of the said Act or the rules made thereunder; and (viii) inquire and review the cases of violation or contravention of the said notification suo-moto or on the basis of a complaint made by any individual or body or organisation before it; 7. The Authority shall be responsible for enforcement and monitoring of the implementation of the provision of the said notification. 8. The Authority shall, for the purposes of maintaining transparency in its functioning, create a dedicated website and post the information relating to its functions, including the agenda in its meeting, minutes of the meeting, decision taken in the meeting, recommendation for matters on violation and contravention of the said notification and action taken on such violation and court matter including the order of the court and the approved Integrated Islands Management Plan of the Union territory of Lakshadweep. 9.
