L.-33004/99 The Gazette of India CG-DL-E-05082024-256051 EXTRAORDINARY PART II—Section 3—Sub-section (ii) PUBLISHED BY AUTHORITY No. 2958] NEW DELHI, FRIDAY, AUGUST 2, 2024/SHRAVANA 11, 1946 MINISTRY OF COAL NOTIFICATION New Delhi, the 2nd August, 2024 S.O. 3100(E).—Whereas by the notification of the Government of India in the Ministry of Coal number S.O. 5312(E), dated 12th December, 2023, issued under sub-section (1) of section 4 of the Coal Bearing Areas (Acquisition and Development) Act, 1957 (20 of 1957) (hereinafter referred to as the said Act), and published in the Gazette of India part II, Section-3, sub-section (ii) dated 12th December, 2023 the Central Government gave notice of its intention to prospect for coal in 1245.00 hectares (approximately) or 3076.46 acres (approximately) of the lands in the locality specified in the Schedule annexed to that notification; And whereas the Central Government is satisfied that coal is obtainable in a part of the said land specified in the Schedule appended to this notification; Now, therefore, in exercise of the powers conferred by sub-section (1) of section 7 of the said Act, the Central Government hereby gives notice of its intention to acquire the land measuring 825.00 hectares (approximately) or 2038.58 acres (approximately) and all rights in or over the said land specified in the Schedule appended hereto; Note 1. The plan bearing Number NMDC/CD/ROHNE/CBA SEC(7)/24/01 dated 8th May, 2024 of the area covered by this notification may be inspected at the office of the Deputy Commissioner, Hazaribagh or at the office of the Chief General Manager (Exploration Division), Central Mine Planning and Design Institute Limited, Gondwana Place, Kanke Road, Ranchi-834008 (Jharkhand) or at the office of the Coal Controller, Coal Controllers organization, Scope Minar, 5th Floor, Core- II, Laxmi Nagar, Delhi-110092, or at the office of the NMDC Limited, Coal Division, 2nd Floor, JSFC Bhawan, Kadru, Ranchi- 834002 (Jharkhand), or at the office of the NMDC Ltd, 10-3-311/A, Castle Hills, Masab Tank, Hyderabad- 500028. Note 2. Attention is hereby invited to the provisions of section 8 of the said Act which provides as follows:- "8. Objection to acquisition.- (1) Any person interested in any land in respect of which a notification under section 7 has been issued may, within thirty days of the issue of the notification, object to the acquisition of the whole or of any part of the land or of any rights in or over such land. Explanation. -It shall not be an objection within the meaning of this section for any person to say that he himself desires to undertake mining operations in the land for the production of coal and that such operations should not be undertaken by the Central Government or by any other person. (2) Every objection under sub-section (1) shall be made to the competent authority in writing, and the competent authority shall give the object or an opportunity of being heard either in person or by a legal practitioner and shall, after hearing all such objections and after making such further inquiry, if any, as he thinks necessary, either make a report in respect of the land which has been notified under sub-section (1) of section 7 or of rights in or over such land, or make different reports in respect of different parcels of such land or of rights in or over such land, to the Central Government, containing his recommendations on the objections, together with the record of the proceedings held by him, the decision of that Government. (3) For the purposes of this section, a person shall be deemed to be interested in land who would be entitled to claim an interest in compensation if the land or any rights in or over such land were acquired under this Act. Note 3. Office of the Coal Controller, Coal Controllers organisation, Scope Minar, 5th Floor, Core- II, Laxmi Nagar, Delhi-110092 has been appointed by the Central Government as the competent authority under section 3 of the said Act, vide notification number S.O. 859, dated the 22.09.2022, published in part II, section 3, sub-section (ii) of the Gazette of India dated the 24.09.2022.
