By S.O. 1009(E) dated 4th March 2024, the Ministry of Power, on the application of M/s Renew Solar Power Private Limited (registered office at 138, Ansal Chambers-II, Bhikaji Cama Place, New Delhi-110066), confers upon the applicant, under Section 164 of the Electricity Act, 2003, all the powers which a telegraph authority possesses under the Indian Telegraph Act, 1885 with respect to placing telegraph lines and posts, for laying an overhead transmission line under the scheme 'Transmission System for providing connectivity to M/s Renew Solar Power Private Limited (RSPPL) for its 300 MW Wind Power Project in Beed, Maharashtra', comprising a 220 kV single-circuit line from the RSPPL wind farm pooling station (Village Ghatnandur, Taluk Bhoom, District Osmanabad) to Kallam PS (an ISTS sub-station), passing through villages in Bhoom, Washi and Kalamb talukas of Osmanabad district and Kaij taluka of Beed district, Maharashtra; the Central Electricity Authority had earlier granted prior approval under section 68(1) of the Act vide letter CEA-PS-11-23(20)/1/2018-PSPA-I Division-I/19219/2021 dated 10.12.2021, and public notice was published in Weekend Business Standard (English) dated 27.08.2022, Dainik Bhaskar (Hindi) dated 25.08.2022, Dainik Ekmat (Marathi) dated 25.08.2022, Dainik Sangharsh (Marathi) dated 07.09.2022 and the Weekly Gazette of India dated 22.10.2022, with no objections received as confirmed by the applicant's affidavit dated 04.09.2023; the authorization is granted for 25 years subject to conditions including obtaining consent of local bodies, Railways, National Highways and State Highways, compliance with Appropriate Commission regulations under the Electricity Act, 2003, operation only after approval of the Electrical Inspector/Chief Electrical Inspector, submission of clearances from Civil Aviation and Defence authorities, and, where the route falls within Great Indian Bustard (GIB) potential/priority areas, compliance with the Supreme Court's order dated 19.04.2021 in Petition No. 838 of 2019 regarding undergrounding of lines or fixing of bird diverters; issued under file number 25-16/8/2024-PG and signed by M.V.N. L.-33004/99 The Gazette of India CG-DL-E-04032024-252588 EXTRAORDINARY PART II-Section 3-Sub-section (ii) PUBLISHED BY AUTHORITY No. 964] NEW DELHI, MONDAY, MARCH 4, 2024/PHALGUNA 14, 1945 MINISTRY OF POWER ORDER New Delhi, the 4th March, 2024 S.O. 1009(E).— Whereas M/s Renew Solar Power Private Limited, the applicant, with its registered office at 138, Ansal Chambers- II, Bhikaji Cama Place, New Delhi -110066, India, has applied for authorization under Section 164 of the Electricity Act, 2003 for laying of overhead transmission line under “Transmission System for providing connectivity to M/s Renew Solar Power Private Limited (RSPPL) for its 300 MW Wind Power Project in Beed, Maharashtra". And whereas, Central Electricity Authority, Government of India vide its letter CEA-PS-11-23(20)/1/2018- PSPA-I Division-I/19219/2021 dated 10.12.2021 had granted prior approval under section 68(1) of the Electricity Act, 2003 for the overhead line covered under the transmission scheme “Transmission System for providing connectivity to M/s Renew Solar Power Private Limited (RSPPL) for its 300 MW Wind Power Project in Beed, Maharashtra". M/s Renew Solar Power Private Limited had published notice for transmission scheme in local newspapers Weekend Business Standard (in English) dated 27.08.2022, Dainik Bhaskar (in Hindi) dated 25.08.2022, Dainik Ekmat (in Marathi) dated 25.08.2022, Dainik Sangharsh (in Marathi) dated 07.09.2022 and in Weekly Gazette of India dated 22.10.2022 for the general public to make observations/representations on the proposed transmission route within two months from the date of publication. Subsequently, M/s Renew Solar Power Private Limited has submitted an affidavit dated 04.09.2023 declaring that no observation/representation was received within two months from the date of publication in the official gazette of Government of India and newspaper publication. And now the applicant has requested to confer upon him, all the powers under section 164 of the Electricity Act, 2003, which the telegraph authority possess under the Indian Telegraph Act, 1885 with respect to the placing of telegraph lines and posts for the purpose of a telegraph established or maintained by Government or to be so established or maintained for laying of electric line under the transmission scheme “Transmission System for providing connectivity to M/s Renew Solar Power Private Limited (RSPPL) for its 300 MW Wind Power Project in Beed, Maharashtra". The following overhead line is covered under this scheme: 1. RSPPL (wind farm pooling station located in Village: Ghatnandur, Taluk: Bhoom, District: Osmanabad) – Kallam PS (ISTS sub-station) 220 kV S/c line. The approval is granted for 25 years. ii. The Applicant shall have to seek the consent of the concerned authorities i.e., local bodies, Railways, National Highways, State Highways etc. before erection of proposed line. iii. The Applicant shall have to follow regulations/codes of the Appropriate Commission regarding transmission, O&M, open access, etc., framed under Electricity Act, 2003. iv. The Applicant shall operate the line after approval of Electrical Inspector / Chief Electrical Inspector of Central Government. v. The approval is subject to compliance of the requirement of the provisions of the Electricity Act, 2003 and the rules made there under by the applicant. vi. M/s Renew Solar Power Private Limited shall have to submit the requisite clearances to Central Electricity Authority after obtaining the same from concerned authorities like Civil Aviation, Defense etc., at the time of Electrical Inspection. vii. In case, the route of above overhead lines (or some portion of the route of above overhead line) falls in the Great Indian Bustard (GIB) potential area (or priority area) marked in the map which is part of the order of the Hon'ble Supreme Court order dated 19.04.2021, in the petition No.838 of 2019 regarding GIB case, the applicant has to comply with the directions of the Hon'ble Supreme Court, with regard to undergrounding of the above overhead transmission line and/or fixing of bird diverters, as the case may be as per the Hon'ble Supreme Court Order dated 19.04.2021 and the directions of the technical committee constituted by the Hon'ble Supreme Court in this regard.
