Detailed Summary

In supersession of notification S.O. 2145(E) dated 6 July 2017 of the Ministry of Environment, Forest and Climate Change, a draft notification S.O. 1226(E) dated 14 March 2023 was published in the Gazette of India inviting objections and suggestions within sixty days from 14 March 2023, the date copies were made available to the public. After considering objections and suggestions received, the Central Government (S.O. 4747(E), dated 27 October 2023) confirmed the Gudekote Extension Sloth Bear Sanctuary, situated in Kudligi taluk of Vijayanagara district, Sandur taluk of Ballari district, and Molakalmuru taluk of Chitradurga district, Karnataka, covering a total protected area of 167.66 square kilometres. The sanctuary comprises the Gudekote Reserve Forest (Block A, 1822.03 hectares, notified vide FEE-72, FWL-2013 dated 11 November 2013), the Gudekote Extension Reserve Forest (Block B, 664.76 hectares) and the Halasagara Reserve Forest (1362.05 hectares), totaling 3848.84 hectares; a further 905.8 hectares of Halasagara Reserve Forest was added by corrigendum FEE-432, FWL-2014 dated 21 September 2016; and an additional 12,005.48 hectares was included and notified vide Notification No. FEE-62, FWL-2019 dated 16 May 2019. July, 2017, a draft notification was published in the Gazette of India, Extraordinary, vide number S.O. 1226 (E), dated the 14th March, 2023, inviting objections and suggestions from all persons likely to be affected thereby within the period o f sixty days from the date on which copies of the Gazette containing the said notification were made available to the public; AND WHEREAS , copies of the said Gazette notification were made available to the public on the 14th March, 2023; AND WH EREAS , objections and suggestions received from persons and stakeholders in respect of the said draft notification have been considered by the Centr al Government; AND WHEREAS , the Gudekote Extension Sloth Bear Sanctuary situated in the Kudligi taluk of Vijayanagara District and Sandur talukas of Ballari District, and Molakalmuru taluk of Chitradurga District, Karnataka lies between East: 14°52' 05.59’’, 76° 43’ 54.43’’, West: 14°47' 17.23’’, 76° 28’ 45.79’’, North 14°57' 13.49’’, 76° 39’ 45.76’’, and South: 14°45' 38.41’’, 76° 34’ 18.67’’, covering a total Protected area of 167.66 square kilometer. AND WHEREAS, the Sanctuary was notified as “ Gudekote Extension Sloth Bear Sanctuary ” with details as follows; Table -1 Sl. AND WHEREAS , it is necessary to conserve and protect the geographical area around the protected area of Gudekote Extension Sloth Bear Sanctuary from ecological and environmental aspects, to conserve and protect the Sloth Bear, Leopard and other endangered faunal biodiversity and wildlife therein and its environment, and to prohibit industries or class of ind ustries and their operations and proce sses in this geographical area; NOW THEREFORE , in exercise of the power conferred by sub section (l), clauses (v) and (xiv) of section (2), and sub -section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub -rule (3) of rule 5 of the Environment (Protection) Rules, 1986, and in supersession of notification number S.O. 2145(E), dated 6th July, 2017, except as respects things done or omitted to be done, the Central Government hereby noti fies an area from the boundary of Gudekote Extension Sloth Bear Sanctuary, in the State of Karnataka as the Gudekote Extension Sloth Bear Sanctuary Eco -sensitive Zone (herein after referred to as the Eco -Sensitive Zone) details of which are as under, namel y:- 1. Extent and boundaries of Eco -sensitive Zone. - (1) The Eco -sensitive Zone shall cover an area of 234.54 square kilometers with an extent varying from 1 kilometer to 5.70 kilometers from the boundary of Gudekote Extension Sloth Bear Sanctuary. (2) The boundary details, latitudes and longitudes of the Eco -sensitive Zone are in Annexure - I. (3) The list of forty eight (48) villages falling within Eco -sensitive Zone along with co -ordinates of prominent points is in Annexure -II. (4) The map of the Ec o-sensitive Zone in Annexure -III. (5) The list of Protected Forests falling within the Eco -sensitive Zone is in Annexure -IV. (6) The list of Reserve Forests falling within the Eco -sensitive Zone is in Annexure -V. (7) The list of trees, reptiles, birds and mammals found within the Eco -sensitive Zone is in Annexures -VI to X. (8) The list of legal categories of land falling within the Eco -sensitive Zone is in Annexure -XI. 2. Zonal Master Plan for the Eco -sensitive Zone . – (1) The State Government shal l for the purpose of effective management of the Eco -sensitive Zone, prepare a Zonal Master Plan, within a period of two years from the date of the publication of this notification in the Official Gazette, in accordance with the provisions of this notifica tion, the relevant Central and State laws, and the guidelines issued by t he Central Government, if any. (2) The Zonal Master Plan shall be approved by the Competent Auth ority in the State Government. (3) The Zonal Master Plan shall be prepared in cons ultation with the local residents and, with all State Departments concerned, namely: - (i) Environment; (ii) Forest; (iii) Urban Development; (iv) Tourism; (v) Municipality; (vi) Revenue; (vii) Agriculture; (viii) Karnataka State Pollution Contro l Board; (ix) Irrigation; (x) Public Works Department; and (xi) any other concerned agency in the State, for integrating environmental and ecologica l considerations. (4) The Zonal Master Plan shall not impose any restriction on the approved existing l and use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco -friendly. (5) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that needs attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, tribal areas, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies. (7) The Zonal Master Plan shall regulate development in Eco -sensitive Zone and adhere to prohibited, regulated and promoted activities listed in the Table in paragraph 17 and shall ensure eco -friendly development for security of local communities’ livelihood. (8) Pending the preparation of the Zonal Master Plan for the Eco -sensitive Zone, all new construction and other developmental activities shall be referred to the Monitoring Committee constit uted under paragraph 18 for appropriate action under paragraph 19. (9) The Zonal Master Plan shall be a reference document for the Monitoring Committee for any decision to be taken includin g consideration for relaxation. 3. Measures to be taken by State Government. - The State Government shall take the measures for giving effect to the p rovisions of this notification - 4. Land use related measures. - (1) Forests, horticulture areas, tribal areas, agricultural areas, parks and open spaces earmarked for recre ational purposes in the Eco -sensitive Zone shall not be used or convened into areas for commercial or industrial r elated development activities: Provided that the State Government may permit the conversion of agricultural lands within the Eco -sensitive Zone on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for th e following activities namely: - (i) Establishment of eco-friendly cottages for temporary occu pation of tourists, such as tents, wooden houses, etc. for eco -friendly tourism activities, (ii) Widening and strengthening of existing roads and construction of new roads, (iii) Setting up of small scale industries not causing pollution, (iv) Rainwater harvesting, and (v) Setting up of cottage industries including village industries, convenience stores and local amenities. Provided further that the State Government may permit the use of land in tribal area for commercial and industrial development activities or prior appro val of the State Government, and or compliance of article 244 of the Constitution of India and the laws for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): (2) The State Government shall correct any error appearing in the records of the land within the Eco -sensitive Zone only once in each case, on consultation with the Monitoring Committee and intimate the Central Government in the Ministry of Environment, Fo rest and Climate Change about such correction: Provided that the correction of error shall not include change of land use in any case except as pro vided under this sub -paragraph: Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or u nproductive agricultural areas. 5. Natural springs related measures. - The State Government shall take the following measures, namely. - (i) Identification of the catchment area of all natural springs and natural springs; (ii) Planning for conversion and rejuvenation of the catchment area and incorporation of such plans in the Zonal Master Plan; and (iii) Prohibit development activities at or near the catchment area which are detrimental to such areas. 6. Tourism Master Plan. - (1) The Department of Tourism of the State Government, in consultation with the Department of Forests and Environment of the State Government, shall prepare a Tourism Master Plan for the purpo se of effective management of the tourism activities within the Eco -sensitive Zone. (2) The Tourism Master Plan shall be incorporated in the Zonal Master Plan. 7. Tourism related measures. - (1) All new tourism activities or expansion of existing tourism a ctivities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco -tourism guidelines issued by the National Tiger Conservation Authority , with emphasis on eco -tourism, eco -education and eco -development and based on carrying capacity study of the Eco -sensitive Zone. (2) Establishment of hotels and resorts shall not be permitted within one kilometer from the boundary of the Gudekote Extensio n Sloth Bear Sanctuary except for temporary accommodation for tourists related to eco -friendly tourism activities. (3) Establishment of new hotel and resorts may be permitted by the State Government only in pre -defined and designated areas for eco -tourism beyond the distance of one kilometer from the boundary of the Gudekote Extension Sloth Bear Sanctuary till the extent of the Eco -sensitive Zone, as per the Tourism Master Plan. (4) The development for tourism and expansion of existing tourism activities ma y be permitted by the regulatory authorities concerned based on the actual site specific scrutiny and on the recommendations of the Monitoring Committee until the Zonal Master Plan is app roved under this notification . 8. Natural heritage Protection and C onservation Plan. - (1) The State Government shall prepare a Natural Heritage Protection and Conservation Plan within six months and such plan shall be incorporated in the Zonal Master Plan. (2) The State Government shall identify and, plan to protect and c onserve the valuable natural heritage sites in the Eco-sensitive Zone, including the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides and cliffs. 9. Man -made heritage Protection and Conservation Pla n.- (1) The State Government shall prepare a Man -made Heritage Protection and Conservation Plan within six months and such plan shall be incorporated in the Zonal Master Plan. (2) The State Government shall identify and, plan to protect and conserve the v aluable Man -made heritage sites in the Eco-sensitive Zone, including the buildings, structures, artefacts, areas and precincts of historical, architectural, aesth etic and cultural significance. 10. Noise pollution related measures. - The Environment Departm ent of the State Government in consultation with the State Pollution Control Board shall make guidelines for the control of noise pollution in the Eco -sensitive Zone in accordance with the provisions of the Noise Pollution (Regul ation and Control) Rules, 2 000. 11. Air pollution related measures. - The Environment Department of the State Government in consultation with the State Pollution Control Board shall make guidelines for the control of air pollution in the Eco -sensitive Zone in accordance with the prov isions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981), Environment (Protection) Act, 1986, and the rules mad e thereunder. 12. Discharge of effluents related measures: - The discharge of treated effluents in Eco -sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974), the environment (Protection) Act, 1986 and rules made thereunder. 13. Solid wastes, disposal related measures. - (1) The solid waste disposal in Eco-sensitive Zone shall be in accordance with the provisions of the Solid Waste Management Rules, 2016. (2) The local authorities shall draw up plans for the segregation of solid waste into biodegradable and non - biodegradable components. (3) The biodegr adable components shall be recycled preferably through composting or vermiculture. (4) The non -biodegradable components may be disposed of in an environmentally acceptable manner at a site(s) identified outside the Eco -sensitive Zone and no burning or inci neration of solid wastes shall be permitted in the Eco - sensitive Zone. 14. Bio -medical waste disposal related measures. - The bio -medical waste disposal in the Eco -sensitive Zone shall be in accordance with the provisions of the Bio -Medical Waste Management Rules, 2016. 15. Vehicular traffic related measures. - The State Government shall regulate the vehicular movement of traffic in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such ti me as the Zonal Master Plan is prepared and approved under this notification, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant guidelines of the Central Government in the Ministry of Environment, Forest and Climate Change. 16. Industrial units related measures. - (1) No establishment of new wood based industries within the Eco -sensitive Zone shall be permitted except the existing wood based industries set up as per the law. (2) No establishment of any new industry ca using water, air, soil or noise pollution within the Eco -sensitive zone shall be permitted. 17. List of prohibited, regulated and promoted activities within the Eco -sensitive Zone. - All activities in the Eco-sensitive Zone shall be governed by the provisi ons of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder, and be regulated in the manner specified in the table below, namely: - TABLE Sl.No. Activity Remarks (I) (2) (3) Prohibited activities 1 Commercial mining, ston e quarrying and crushing units. (b) The mining operations shall strictly be in accordance with the orders of the Hon' ble Supreme Court dated the 4th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. Union of India in Writ Petition (Civil) No.202 of 1995 and order of the Hon'ble Supreme Court dated the 21st April, 2014 in the matter of Goa Foundation Vs. Union of India in Writ Petition (Civil) No.435 of 2012. 2 Setting up of sa wmills. No new or expansion of existing saw mills shall be permitted within the Eco -sensitive Zone. 3 Setting up of industries causing water, air, soil or noise pollution. No new or expansion of polluting industries in the Eco-sensitive Zone shall be perm itted 4 Commercial use of firewood. Prohibited as per applicable laws. 5 Establishment of new thermal and major hydroelectric projects. Prohibited (except as otherwise provided) as per applicable laws. 6 Use or production of any hazardous substances including pesticides and insecticides. Prohibited (except as otherwise provided) as per applicable laws. 7 Discharge of untreated effluents and solid waste in natural water bodies or land area. Prohibited (except as otherwise provided) as per applicable law s. 8 Undertaking activities related to tourism like over-flying the National Park Area by aircraft, hot-air balloons. Prohibited (except as otherwise provided) as per applicable laws. 9 New wood based industry. No establishment of new wood based industry may be permitted within the limits of Eco -sensitive Zone. The existing wood -based industry may continue as per applicable laws. 10. Setting up of brick kilns. Prohibited as per applicable law. Regulated activities 11. Use of plastic carry bags, lami nates and tetra packs. Disposal of plastic articles, laminates and tetra packs shall be regulated and monitored as per applicable laws. 12. Establishment of hotels and resorts. No new commercial hotels and resorts may be permitted within one kilometer of the boundary of the protected area except for accommodation for temporary occupation of tourists related to eco - friendly tourism activities. However, beyond one kilometer and upto the extent of the Eco -sensitive Zone, all new tourism activities or expansion of existing activities would in conformity with the Tourism Master Plan. 13. Construction activities. (a) No new commercial construction of any kind may be permitted within one kilometre from the boundary of the Protected Area or up to extent of the Eco - sensitive Zone, whichever is nearer: (b) The local residents may be permitted to undertake construction in their land for their use including the activities listed in sub paragraph (1) of paragraph 3 as per building byelaws to meet the residential needs of the local residents such as: (i) Widening and strengthening of existing roads and construction of new roads; (ii) Construction and renovation of infrastructure and civic amenities; (iii) Small scale industries not causing pollution termed as per Classification done by Central Pollution Control Board of February 2016; (iv) Cottage industries including village industries; convenience stores and local amenities supporting eco - tourism including home stays; and (v) Promoted activities listed in this Notification. (c) The construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any. (d) Bey ond one kilometer it shall be regulated as per the Zonal Master Plan. 14. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government; (b)The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Acts and the rules made there under. (c) In case of Reserve Forests and Protected Forests, the Working Plan prescriptions shall be fol lowed. 15. Commercial water resources including ground water harvesting. Regulated under applicable law. 16. Erection of electrical cables, transmission lines and telecommunication towers and Optical fiber cables, pipelines etc. Regulated and to promote underground cabling. 17. Fencing of existing premises of hotels and lodges. Regulated under applicable laws. 18. Widening and strengthening of existing roads. Shall be done with proper Environment Impact Assessment and mitigation measures, as applicable . 19. Movement of vehicular traffic at night. Regulated for commercial purpose, under applicable laws. 20. Introduction of exotic species. Regulated under applicable laws. 21. Protection of hill slopes and river banks. Regulated under applicable laws. 22. Discharge of treated effluents in natural water bodies or land area and disposal of solid waste. The discharge of treated waste water/effluents shall be avoided to enter into the water bodies. Efforts to be made for recycle and reuse of treated waste w ater. Otherwise the discharge of treated waste water/effluent shall be regulated as per applicable laws. 23. Commercial sign hoards and hoardings. Regulated under applicable laws. 24. Establishment of large -scale commercial live - stock and poultry farms by firms, corporate and companies. Regulated as per applicable laws except for meeting local needs. 25. Small scale industries not causing pollution. Non polluting, non -hazardous, small -scale and service industry, agriculture, floriculture, horticulture or agro - based industry producing products from indigenous goods from the Eco -sensitive Zone, and which do not cause any adverse impact on environment shall be permitted. 26. Collection of Forest produce or Non -Timber Forest Produce. Regulated under applic able laws. 27. Air and vehicular pollution. Regulated as per applicable laws. 28 Drastic change of agriculture systems. Regulated as per applicable laws. Promoted activities 29 Ongoing agriculture and horticulture practices by local communities along w ith dairies, dairy farming, aquaculture and fisheries. Permitted under applicable laws. 30 Agroforestry, Skill Development, Environmental Awareness . Shall be actively promoted. 31 Rain water harvesting. Shall be actively promoted. 32 Organic farming. Shall be actively promoted. 33 Adoption of green technology for all activities. Shall be actively promoted. 34 Cottage industries including village artisans. Shall be actively promoted. 35 Use of renewable energy sources. Bio gas, solar light, etc. to be promoted. 18. Monitoring Committee. - There shall be a committee to be known as Monitoring Committee consisting of the following persons, namely: - Sl.No. Constituent of the Monitoring Committee Designation i. Representative of Non -Governmental Orga nisations working in the field of natural conservation (including heritage conservation) to be nominated by the Government of Karnataka for a term of three years from time to time. Member; v. Regional Officer, Karnataka State Pollution Control Board Member , Ex- officio ; vi. One expert in the area of ecology and environment from reputed Institution or University of the State of Karnataka to be nominated by the Government of Karnataka for a term of three years from time to time. Member; vii. The Deputy Commissio ner or his representative, Vijayanagara District Member, Ex- officio ; viii. The Deputy Commissioner or his representative, Ballari District Member, Ex- officio ; ix. The Deputy Commissioner or his representative, Chitradurga District Member, Ex- officio ; x. The Deputy Conservator of Forests, Vijayanagara Division Member Secretary, Ex- officio . 19. Functions of the Monitoring Committee. –(1)The Monitoring Committee shall, based on the actual site -specific conditions, scrutinise the activities covered in the Sche dule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest, number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco -sensitive Zone, except for the prohibited activities specified in the Table under paragraph 17 thereof, and refer to the Central Government in the Ministry of Environment, Forest and Climate Change or the State Environment Impact Assessment Authority, as the case may be, for prior environmental clearances under the provision s of the said notification. (2) The activities not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and falling in the Eco -sensitive Zone, except for the prohibited activities specified in the Table under paragraph 17 thereof, shall be scrutinised by the Monitoring Committee based on the actual site -specific conditions and refer to the re gulatory authorities concerned. (3) The Mo nitoring Committee may invite representative or expert from concerned Department, representative from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on case to case basis. (4) The Monitoring Co mmittee shall submit the annual action taken report of its activities for the period up to the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden of the State in pro - forma specified in Annexure -XII. (5) The Central Governm ent may give such directions in writing, as it deems fit, to the Monitoring Committee for effective discharge of its func tions. 20. Complaints for non -compliance. - The Member -Secretary of the Monitoring Committee or the Collector or the Deputy Conservator of Forests shall be competent to file complaint under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
