The Ministry of Power, by Order S.O. 2525(E) dated 1st July 2024 (F. No. 25-16/25/2024-PG), recorded that M/s NHPC Limited, registered office at NHPC Office Complex, Sector-33, Faridabad-121003, Haryana, had applied under Section 164 of the Electricity Act, 2003 for authorization to lay an overhead transmission line under the scheme 'Transmission system for providing connectivity to M/s NHPC Limited for its 300 MW Solar Power Plant in Bikaner District, Rajasthan', for which prior approval under section 68(1) had already been granted vide letter No. 25-17/40/2023-PG dated 9th November 2023. Notice of the scheme was published in The Indian Express, Dainik Bhaskar and Rashtradoot in November 2023 and in the Weekly Gazette of India on 23rd December 2023, and NHPC Limited's affidavit dated 10th June 2024 confirmed no objections were received within two months. The Central Government accordingly conferred on NHPC Limited, under Section 164, the powers of a telegraph authority under the Indian Telegraph Act, 1885 to lay the NHPC Bikaner-II PS 220 kV single-circuit line on double-circuit tower, approximately 24 km, with 21-22 km as S/c line on D/c tower and 2-3 km as S/c line on M/c towers, passing through villages including Karnisar, Barjoo, Barala, Deensar, Banderewala and Bhanipura (Pugal taluka) and Mehrasar, Kawni, Sharah Jatan, Jaimalsar and Sarah Borla (Bikaner taluka) in Bikaner district, subject to conditions including a 25-year approval period and compliance with Supreme Court orders on the Great Indian Bustard (GIB) in Petition No. 838 of 2019. L.-33004/99 The Gazette of India CG-DL-E-02072024-255080 EXTRAORDINARY PART II—Section 3—Sub-section (ii) PUBLISHED BY AUTHORITY No. 2395] NEW DELHI, TUESDAY, JULY 2, 2024/ASHADHA 11, 1946 MINISTRY OF POWER ORDER New Delhi, the 1st July, 2024 S.O. 2525(E).—Whereas M/s NHPC Limited, the applicant, with its registered office at NHPC Office Complex, Sector-33, Faridabad-121003, Haryana, India, has applied for authorization under Section 164 of the Electricity Act, 2003 for laying of overhead transmission line under the transmission scheme “Transmission system for providing connectivity to M/s NHPC Limited for its 300 MW Solar Power Plant in Bikaner District, Rajasthan". And whereas, Ministry of Power, Government of India vide its letter 25-17/40/2023-PG dated 09.11.2023 had granted prior approval under section 68(1) of the Electricity Act, 2003 for the overhead line covered under the transmission scheme “Transmission system for providing connectivity to M/s NHPC Limited for its 300 MW Solar Power Plant in Bikaner District, Rajasthan”. M/s NHPC Limited had published notice for transmission scheme in local newspapers: The Indian Express (in English) dated 22.11.2023, Dainik Bhaskar (in Hindi) dated 24.11.2023, Rashtradoot (in Hindi) dated 22.11.2023 and in Weekly Gazette of India dated 23.12.2023 for the general public to make observations/representations on the proposed transmission route within 2 Months from the date of publication. Subsequently, M/s NHPC Limited has submitted an affidavit dated 10.06.2024 declaring that no observation/representation was received within 2 Months from the date of publication in the official Gazette of Government of India and newspaper publications. And now the applicant has requested to confer upon him, all the powers under section 164 of the Electricity Act, 2003, which the telegraph authority possess under the Indian Telegraph Act, 1885 with respect to the placing of telegraph lines and posts for the purpose of a telegraph established or maintained by Government or to be so established or maintained for laying of electric line under the transmission scheme “Transmission system for providing connectivity to M/s NHPC Limited for its 300 MW Solar Power Plant in Bikaner District, Rajasthan". The following overhead line is covered under this scheme: NHPC Limited Solar Power Project – Bikaner-II PS 220 kV S/c line on D/c tower (Route Length is approximately 24 km, out of which approximately 21-22 km line will be implemented as S/c line on D/c tower and balance 2-3 km line from Bikaner-II PS end will be implemented as S/c line on M/c towers) The transmission line covered under the above scheme will pass through, over, around and between the following villages, towns and cities of Rajasthan: +--------------------------------------------------------+---------+----------+ | Name of Villages | Taluka | District | +========================================================+=========+==========+ | Karnisar, Barjoo, Barala, Deensar, Banderewala, Bhanipura| Pugal | Bikaner | +--------------------------------------------------------+---------+----------+ | Mehrasar, Kawni, Sharah Jatan, Jaimalsar, Sarah Borla | Bikaner | Bikaner | +--------------------------------------------------------+---------+----------+ Now, after careful consideration, Ministry of Power, Government of India, under section 164 of the Electricity Act, 2003, confers all the powers to M/s NHPC Limited for laying above overhead line, which telegraph authority possesses under the Indian Telegraph Act, 1885 with respect to placing of telegraph lines and posts for the purposes of a telegraph established or maintained, by Government or to be established or maintained subject to following terms and conditions for installing the above mentioned line, namely: i. The approval is granted for 25 years. ii. The Applicant shall have to seek the consent of the concerned authorities i.e., local bodies, Railways, National Highways, State Highways etc. before erection of proposed line. iii. The Applicant shall have to follow regulations/codes of the Appropriate Commission regarding transmission, O&M, open access, etc., framed under Electricity Act, 2003. iv. The Applicant shall operate the line after approval of Electrical Inspector / Chief Electrical Inspector of Central Government. v. The approval is subject to compliance of the requirement of the provisions of the Electricity Act, 2003 and the rules made there under by the applicant. vi. M/s NHPC Limited shall have to submit the requisite clearances to Central Electricity Authority after obtaining the same from concerned authorities like Civil Aviation, Defense etc., at the time of Electrical Inspection. vii. In case, the route of above overhead lines (or some portion of the route of above overhead line) falls in the Great Indian Bustard (GIB) potential zone (or priority zone), the applicant has to comply with the orders of the Hon'ble Supreme Court in the petition No.838 of 2019 regarding Great Indian Bustard (GIB) case, and the directions of the technical/expert committee constituted by the Hon'ble Supreme Court in this regard.
