NOTIFICATION
New Delhi, the 25th August, 2025
S.O. 3938(E).— In exercise of the powers conferred by sections 3 and 4 of the Collection of Statistics Act,
2008 (7 of 2009), as amended in 2017 (21 of 2017) and through THE JAN VISHWAS (AMENDMENT OF
PROVISIONS) ACT, 2023 NO. 18 OF 2023 in 2023, read with rules 5 and 7 of the Collection of Statistics Rules,
2024, the Ministry of Statistics & Programme Implementation hereby directs Collection of Statistics on Capital
Expenditure Outlook, Capital Expenditure Intention, Investment Activity Outlook and Strategies for large private
sector industries through a statistical survey, hereinafter referred to as 'Forward Looking Survey on Private Corporate
Sector Capex Investment Intentions', as per the details mentioned in the Schedule-I.
2. The Ministry further appoints the persons as also their assignees in office, mentioned in the Schedule II as
Statistics Officers, Adjudicating Officer in Schedule-III and Appellate Authority in Schedule-IV in respect of the
geographical units mentioned thereof with reference to the aforesaid direction. Each Statistics Officer, Adjudicating
Officer, and Appellate Authority shall immediately submit an undertaking in the prescribed format, namely, Form-I
appended to the Collection of Statistics Rules, 2024, to the Additional Director General, Field Operations Division,
National Statistics Office, Delhi.
3. The persons authorised by each Statistics Officer, after submission of undertaking in the prescribed format,
namely, Form-I appended to the Collection of Statistics Rules, 2024 to the Statistics Officer, would be engaged in the
geographical jurisdiction of the Statistics Officer for pursuing data collection through web-based interface in CAPI.
4. The statistics collected in Forward Looking Survey on Private Corporate Sector Capex Investment Intentions
schedule, will be processed by officials working at the Office of the Additional Director General, Enterprise Survey
Division, Kolkata. The unit-level data of the survey will not be published by the Ministry.
5. All persons engaged in any activity in respect of collection of statistics, processing of data and dissemination
with respect to Forward Looking Survey on Private Corporate Sector Capex Investment Intentions are governed by the
provisions under the Collection of Statistics Act, 2008 as amended in 2017 (21 of 2017) and through THE JAN
VISHWAS (AMENDMENT OF PROVISIONS) ACT, 2023 NO. 18 OF 2023 in 2023 and the Collection of Statistics
Rules, 2024.
6. Following powers have been delegated to the Statistics Officers:
(a) A Statistics Officer is empowered to depute/authorize officials to collect statistics in respect of the
aforementioned direction, to verify any information furnished by informants on the basis of business records
and other records and to seek clarifications from any owner or occupier or person in-charge of a factory or
establishment or management, as the case may be, at the premises where such records are kept. A Statistics
Officer is also empowered to depute/authorize officials under the administrative control of any State
Government or Union territory Administration, which is willing to collect statistics from any of those
factories/establishment for which the Statistics Officer has not deputed/authorized any official under his
administrative control.
(b) A Statistics Officer is empowered to give one month notice or for the period deemed fit to each of the
informant for furnishing return in the format, specified for the purpose of collection of statistics.
(c) A Statistics Officer is empowered to provide to any informant, the facility of furnishing return in electronic
form through a web-based application/portal for certain period, to be specified by him in the notice to be
issued to the informant.
7. Powers of the adjudicating officer- An adjudicating officer appointed under section 15A of the Act to hold an
inquiry and impose penalty, shall also have the powers to-
(i) call for oral or written evidence on oath or on affidavit from parties including from any other person who has
been summoned;
(ii) peruse or inspect relevant documents, records or copies thereof;
(iii) summon and enforce the attendance of any person acquainted with the facts and circumstances of the case.
Any appropriate agency including the District Administration shall render such assistance on receiving a
reference regarding enforcing the attendance of any person while discharging the duties of the adjudicating
officer appointed under the Act.
8. Appeal against the order of adjudicating officer-
(1) The appropriate Government may appoint any of its officers, above the rank of adjudicating officer, as an
appellate authority under the provisions of the Act.
(2) Whoever aggrieved by the order passed by the adjudicating officer under this Act, may prefer an appeal to
the appellate authority, within thirty days from the date of receipt of order, in Form-III.
(3) An appeal may be admitted even after the expiry of the period of thirty days if the appellant satisfies the
appellate authority that he had sufficient cause for not preferring the appeal within that period. In case the
appeal has been preferred against the order of the adjudicating officer, the operation of the order of the
adjudicating officer shall be kept in abeyance, till the disposal of the appeal.
(4) Whenever, such an appeal is received, the appellate authority shall hold a hearing, either in person or virtual
or by any other admissible mode, as may be decided by the appellate authority.
(5) The appellate authority shall issue a notice of hearing to the parties, including persons acquainted with the
facts and circumstances of the case, by name, date, venue and mode of hearing, along with the relevant
documents of the receipt on appeal, at least fifteen days before the scheduled date of hearing.
(6) The notice of hearing may also provide for submission of written communication, which may be relevant for
deciding the appeal, by the parties, if they so desire at least five days before the date of hearing.
(7) The notice of hearing shall be served in the following modes, namely:
(i) by speed post or registered post;
(ii) by electronic mail in case electronic address is available;
and proof of deliveries shall be kept on the record of the case file.
(8) The parties may be present in person or through his duly authorised representative by the specified mode of
hearing as decided by the appellate authority including video conferencing, if the facility of video
conferencing is available, at the time of hearing of the case.
(9) The appellate authority may, after giving the parties to the appeal an opportunity of being heard, pass such
order as he may think fit.
SCHEDULE-I
Subject and purpose for collection of statistics:
1. Statistics relating to Capital Expenditure Outlook, Capital Expenditure Intention, Investment Activity Outlook
and Strategies for large private sector industries is collected through Forward Looking Survey on Private Corporate
Sector Capex Investment Intentions.
Geographical area for collection of statistics:
2. The Forward-Looking Survey on Private Corporate Sector Capex Investment Intentions is conducted in the
whole of India.
Method of data collection:
3. A Notice will be issued by each Statistics Officer to informants under his jurisdiction, indicating therein the
date by which, the officer or office to whom, the unit or units for which, and the formats and the manner in which
information is required to be furnished, including submission of information in electronic form through web based
interface in Computer Assisted Personal Interview(CAPI) designed for the purpose and made available to informants
up to a certain date, specified in the notice.

4. Enterprises that are registered with the MCA under the Companies Act, 2013.
Period during which collection of statistics may be completed:
5. The date for submission of information by each informant would be mentioned in the notice and would
generally fall during September, 2025 to March, 2026.

6. Information is required to be furnished on provisional Capital Expenditure to be incurred by the enterprise in
2025-26 and Capital Expenditure intentions, Investment Activity Outlook and Investment Activity Strategy for 2026-
27.
Nature of information to be collected:
7. The information required relates to Buying / selling capacity, Preferred / Alternative sectors, Preferred
States/Cities, Investment strategies, Capital expenditure, Challenges and Goals of the industries in the given period.
Language in which information is to be furnished by informant:
8. An informant shall furnish information in the prescribed formats, in English.
Obligation of informant:
9. An owner or occupier or person in-charge of a company or enterprise or management, as the case may be, shall
furnish information in the manner and by the date mentioned in the notice received by him from the concerned
Statistics Officer. He should also furnish relevant records as may be required by the Statistics Officer or a person
authorized by him for reference.
Nature of business records and other records which may be inspected:
10. The business records and other records will not be inspected upfront. However, in stray cases, official business
records may require to be referred.
