Detailed Summary

The Ministry of Power, exercising powers under clause (a) of sub-section (2) of Section 176 of the Electricity Act, 2003 (Act 36 of 2003), issued G.S.R. 467(E) dated 30th June 2023 notifying the National Electricity Plan Notification (Amendment) Rules, 2023, effective from the date of publication in the Official Gazette. The amendment substitutes rule 3 of the National Electricity Plan Notification Rules, 2004 (principal rules published vide G.S.R. 234(E) dated 6th April 2004), providing that a draft National Electricity Plan prepared under sub-section (4) of Section 3 of the Act shall be published on the website of the Authority to invite suggestions and objections from licensees, generating companies and the general public, with notice also published in at least two daily newspapers, and that a period of sixty days from the date of publication of the draft Plan shall be provided for such suggestions and objections; the final National Electricity Plan shall be notified on the Authority's website. EXTRAORDINARY PART II —Section 3 —Sub-section ( i) PUBLISHED BY AUTHORITY No. 378] NEW DELHI, FRIDAY, JUNE 30, 2023/ASHADHA 9, 194 5 CG-DL-E-01072023-246905 MINISTRY OF POWER NOTIFICATION New Delhi, the 30th June, 2023 G.S.R. 467(E):— In exerci se of the powers conferred by clause (a) of sub -section (2) of Section 176 of the Electricity Act, 2003 (Ac t 36 of 2003), the Central Government hereby makes the following rules, to amend the National Electricity Plan Notification Rules, 2004, namely: - 1. (1) These rules may be called the National Electricity Plan Notification (Amendment) Rules, 2023. (2) The y shall come into force on the date of their publication in the Official Gazette. 2. In the National Electricity Plan Notification rules, 2004, for rule 3, the following shall be substituted, namely: - “3. Notification of draft National Electricity Plan .- (1) A draft National Electricity Plan prepared under the provisions of sub -section (4) of Section 3 of the Act shall be published on the website of the Authority for inviting suggestions and objections of licensees, generating companies and general publi c and notice to this effect shall be published in at least two daily newspapers; (2) For inviting suggestions and objections, a period of sixty days, from the date of publication of such draft Plan, shall be provided by the Authority.” (3) The final Nationa l Electricity Plan shall be notified on the website of the Authority.
