The Food, Supplies and Consumer Affairs Department, Government of the National Capital Territory of Delhi, on July 24, 2026, issued the 'Delhi Specified Articles (Regulation of Distribution) Order, 2026'. This order, made under the powers conferred by sub-Section 3 of the Essential Commodities Act, 1955 (10 of 1955), read with Ministry of Agriculture and Irrigation Order GSR 800 dated 9th June 1978 and Ministry of Industries and Civil Supplies Order S.O.681(E) dated 30th November 1974, and the Targeted Public Distribution System (Control) Order, 2015, supersedes the Delhi Specified Articles (Regulation of Distribution) Order, 1981, published on January 12, 1981. Its purpose is to implement the National Food Security Act, 2013, and the Delhi Food Security Rules, 2026 (published February 2, 2026). The Order defines 'specified article' as rice and wheat, and other notified commodities. It establishes regulations for Fair Price Shop (FPS) licenses, distinguishing between Regular licenses (valid until suspended/cancelled, non-transferable, non-renewable) and Temporary licenses (maximum three months, extendable once for emergent service gaps). Eligible entities include individuals, Self-Help Groups, Cooperative Societies (under Delhi Cooperative Societies Act, 2003), NGOs/Societies, Partnership Firms (under Partnership Act, 1932), Limited Liability Partnerships, and Companies (under Companies Act, 2013). Limits apply: one license per individual/firm/LLP, and a maximum of five FPS per revenue district for other entities. Eligibility criteria include age (21-60 years, with 5-year relaxation for ex-servicemen/women, and licensee may run till 70 years), Class XII pass educational qualification, and residency in the same revenue district. Disqualifications include unsound mind, previous license cancellation for malpractice, conviction under Essential Commodities Act, 1955, Bhartiya Nyaya Sanhita, or moral turpitude/economic offense, or furnishing false information. FPS premises must be at least 15 square metres (with additional storage if under 25 sq m), have 10-foot road access, be a pucca structure, and held under legal possession for a minimum of three years. Applications are online, accompanied by a non-refundable fee of ₹1,000 for Regular and ₹500 for Temporary licenses, and specific documents (Annexure-I). Selection is based on a weightage-based marking scheme (Annexure-IV) by a Selection Committee, with final approval from the Hon'ble Minister, Food & Supplies. Successful applicants must furnish a performance guarantee (₹50,000 for up to 500 ration cards, ₹75,000 for 501-750, ₹1,00,000 for more than 750) and pay a one-time license fee of ₹10,000. Penalties for stock variations range from ₹2,000 (25-50 Kg) to ₹10,000 (50-100 Kg) with suspension, and forfeiture of entire security, immediate suspension, and FIR under Essential Commodities Act, 1955, Sections 7 and/or 10 (over 100 Kg). Other violations (e.g., failure to display info, unhygienic conditions) can lead to forfeiture of up to ₹25,000 and/or license cancellation. Repeated violations or deliberate malpractice may lead to cancellation and blacklisting. Existing licensees must opt for a one-time license for ₹5,000 within twelve months, with relaxed educational qualifications (Class X pass for post-July 2015, no requirement for pre-July 2015). The Order also details grievance redressal and appeal mechanisms to the Commissioner, Financial Commissioner, and Lieutenant Governor, outlines Fair Price Shop dealer responsibilities, and grants powers to the Commissioner and other officers for monitoring, inspection, and enforcement.
