Detailed Summary

The Ministry of Railways (Eastern Railway), through Notification S.O. 5974(E) dated 17th December, 2025 (published 24th December, 2025), has declared the Central Government's intention to acquire land for public purpose. This acquisition is for the execution, maintenance, and operation of the Special Railway Project titled "Howrah Division - 40 Nos Elimination of Level Crossing of DFC route by ROB/RUBs on Indian Railway - DKAE-KAN HBC Chord line" located in the Purba Bardhaman District of West Bengal. The declaration is made under sub-section (1) of Section 20A of the Railways Act, 1989, as amended by the Railways (Amendment) Act, 2008. Any person interested in the said land may raise an objection within thirty days from the notification's publication date in the Official Gazette, as per sub-section (1) of Section 20D of the Railways Act. Objections must be submitted in writing to the Competent Authority, identified as the Additional District Magistrate (Land Acquisition), Purba Bardhaman, West Bengal. The Competent Authority will provide an opportunity for a hearing, either in person or by legal practitioner, and their order under sub-section (2) of Section 20D shall be final. A brief description of the land to be acquired, including specific level crossings (e.g., NO. 47/C/E, NO. 48/C/E, NO. 49/C/T, NO. 53/C/E), Mouzas (e.g., Durgabati, Amra, Jotram, Gangpur, Saraitikar, Nutangram), R.S./L.R. plot numbers, and areas in acres and hectares, is provided in the annexed Schedule, which can be inspected at the Competent Authority's office.

In exercise of the power conferred by sub-section (1) of Section 20A of the Railways Act, 1989, (as amended vide the Railways (Amendment) Act, 2008) (herein after referred to as the said Act), the Central Government after being satisfied that for the public purpose, the land, the brief description of which has given in the Schedule annexed hereto, is required for the purpose execution, maintenance and operation of the Special Railway Project namely, โ€œHowrah Division - 40 Nos Elimination of Level Crossing of DFC route by ROB/RUBs on Indian Railway - DKAE-KAN HBC Chord line" in the Purba Bardhaman District in the State of West Bengal, hereby declares its intention to acquire such land; Any person interested in the said land may, within a period of thirty days from the date of publication of this notification in the Official Gazette, raise objection to the acquisition and use of such land for the aforesaid purpose under sub-section (1) of Section 20D of the said Act; Every such objection shall be made to the Competent Authority, namely, Additional District Magistrate (Land Acquisition), Purba Bardhaman, West Bengal in writing and shall set out the grounds thereof, and the Competent Authority shall give the objector an opportunity of being heard, either in person or by legal practitioner and may after hearing all such objections and after making such further enquiry, if any, as the Competent Authority thinks necessary, by order, either allow or disallow the objections; Any order made by the Competent Authority under sub- section (2) of Section 20D of the said Act shall be final; The land plans and other details of the land covered under this notification are available and can be inspected by the interested persons at the aforesaid office of the Competent Authority.
