Whereas the Central Government is of the opinion that it is necessary or expedient for facilitating the construction or for ensuring the safety of Metro Railway from Joka to Diamond Park via IIM (Phase-I) in the city of Kolkata and other works connected therewith for public purpose, as per the alignment mentioned in the accompanying Schedule; And whereas the Central Government is satisfied that due care has been taken so that minimum inconvenience and hardships are caused to the owners or occupiers of the land, building, street, road, passage, nullah etc. and the acquisition of the right of the user in the land, building, street, road, passage, nullah etc. shown in the plan is inescapable for construction of Metro Railway from Joka to Diamond Park via IIM (Phase-I); And whereas the plan of the areas mentioned in the said Schedule may be inspected in the Office of the General Manager, Metro Railway, Kolkata or his nominees, 1.1. Now, therefore, in exercise of the-powers conferred by sub-section (1) of Section 21 of the Metro Railways (Construction of Works)Act, 1978 (Act 33 of 1978) (hereinafter referred to as the said Act), the Central Government hereby directs under clause (a) of sub-section (1) of Section 21 of the said Act that no building or any other construction shall be made or done above the proposed Metro alignment or on any land within the 20.0 m width on either side of the proposed metro alignment at station area and 10.0m on both sides from Center line of Viaduct Alignment as mentioned in the accompanying Schedule, within 05 (five) years from the date of publication of this notification; 2. Every person shall be bound to comply with these directions, as specified in sub-section (5) of section 21 of the said Act. 3. Any person who sustains any loss or damage in consequence of these directions shall be paid an amount which shall be determined by an order of the Competent Authority in the first instance and if the amount determined by the Competent Authority is not acceptable to either of the parties, the amount shall, on an appeal preferred by either of the parties, within sixty (60) days from the date of the order of the Competent Authority, to the Appellate Authority, be determined by an order of the Appellate Authority.
