NOTIFICATION
Prayagraj, the 25th April, 2025
S.O. 1928(E).—Whereas, by the notification of the Government of India in the Ministry of Railways
(Railway Board), No. S.O. 1597(A), dated 22 March, 2023 published in Gazette of India, Extraordinary, Part II,
Section 3, Sub-section (ii), dated 03 April, 2023 and issued of sub section (i) of section 20A of the Railways Act, 1989
(24 of 1989) (hereinafter referred to as the said Act), the Central Government, declared its intention to acquire the land
specified in the Schedule annexed to the said notification for execution, maintenance, management and operation of
Special Railway Project namely, “Construction of Aligarh-Harduaganj (22 Km.)” under Tehsil Koil/Gabhana in
Aligarh District in the State of Uttar Pradesh.
And whereas the substance of the said notification was published in the daily newspapers ―Dainik Jagran
dated 05.05.2023 and Amar Ujala dated 05.05.2023‖ under sub-section (4) of section 20A of the said Act;
And whereas 52 objection was received and the same have been considered and allowed by the Competent
Authority and accordingly orders have been passed;
And whereas in pursuance of sub-section (1) of Section 20E of the said Act, the Competent Authority has
submitted its report to the Central Government;
Now, therefore, upon receipt of the said report of the Competent Authority, and in exercise of the powers
conferred by sub- section (1) of section 20E of the Railways Act, 1989 the Central Government hereby declares that
the lands specified in the Schedule annexed hereto shall be acquired for the aforesaid purpose;
And further, in pursuance of sub - section (2) of section 20E of the said Act, the Central Government hereby
declares that on publication of this notification in the official Gazette, the land specified in the Schedule annexed
hereto shall vest absolutely in the Central Government free from all encumbrances.

| 1. | Short title, extent and commencement. |
| | (1) This Act may be called the **Rail Land Development Authority Act, 2025.** |
| | (2) It extends to the whole of India. |
| | (3) It shall come into force on such date as the Central Government may, by notification in the Official Gazette, appoint. |
| 2. | Definitions. |
| | (1) In this Act, unless the context otherwise requires,— |
| | (a) "Authority" means the Rail Land Development Authority established under sub-section (1) of section 3; |
| | (b) "Chairperson" means the Chairperson of the Authority appointed under clause (a) of sub-section (2) of section 4; |
| | (c) "Chief Executive Officer" means the Chief Executive Officer of the Authority appointed under clause (b) of sub-section (2) of section 4; |
| | (d) "development" with its grammatical variations, means carrying out of building, engineering, mining or other operations in, on, over or under land or the making of any material change in any building or land and includes re-development; |
| | (e) "Government land" means any land belonging to, or in the possession of, the Central Government or a State Government, or any local authority, or any public sector undertaking; |
| | (f) "land" includes benefits to arise out of land, and things attached to the earth or permanently fastened to anything attached to the earth; |
| | (g) "member" means a member of the Authority appointed under clause (c) of sub-section (2) of section 4; |
| | (h) "prescribed" means prescribed by rules made under this Act; |
| | (i) "rail land" means any land belonging to the railways, whether used for railway purposes or not, including land held by the railways on lease, licence or any other arrangement; |
| | (j) "railway" means the Government railway as defined in clause (20) of section 2 of the Railways Act, 1989 (24 of 1989); |
| | (k) "regulations" means regulations made by the Authority under this Act; |
| | (l) "rules" means rules made by the Central Government under this Act; |
| | (m) "scheme" means a scheme prepared by the Authority under section 14; |
| | (n) "tender" means an invitation by the Authority to submit a proposal for undertaking any development activity on rail land; |
| | (o) "tribunal" means the tribunal established under sub-section (1) of section 35; |
| | (p) "undertaking" means any commercial or industrial enterprise or public sector undertaking controlled by the Central Government, a State Government or a local authority, or a public sector enterprise. |
| | (2) The words and expressions used herein and not defined but defined in the Railways Act, 1989 (24 of 1989) shall have the meanings respectively assigned to them in that Act. |
| 3. | Establishment and incorporation of Rail Land Development Authority. |
| | (1) With effect from such date as the Central Government may, by notification in the Official Gazette, appoint, there shall be established for the purposes of this Act an Authority to be called the Rail Land Development Authority. |
| | (2) The Authority shall be a body corporate by the name aforesaid having perpetual succession and a common seal with power, subject to the provisions of this Act, to acquire, hold and dispose of property, both movable and immovable, and to contract, and shall by the said name sue or be sued. |
| | (3) The head office of the Authority shall be at New Delhi. |
| | (4) The Authority may, with the previous approval of the Central Government, establish offices at other places in India. |
| 4. | Composition of the Authority. |
| | (1) The Authority shall consist of a Chairperson, a Chief Executive Officer and three other members. |
| | (2) The Chairperson, Chief Executive Officer and other members shall be appointed by the Central Government in such manner as may be prescribed. |
| | (3) The Chairperson, Chief Executive Officer and other members shall be persons of ability, integrity and standing who have wide experience in railways, land management, urban planning, finance, law or public administration. |
| | (4) The salaries and allowances payable to, and other terms and conditions of service of, the Chairperson, Chief Executive Officer and other members shall be such as may be prescribed. |
| 5. | Term of office of Chairperson, Chief Executive Officer and other members. |
| | (1) The Chairperson, Chief Executive Officer and other members shall hold office for a term not exceeding three years from the date on which they enter upon their office. |
| | (2) A person shall not be eligible for appointment as Chairperson, Chief Executive Officer or other member for more than two terms. |
| | (3) The Chairperson, Chief Executive Officer or any other member may, by notice in writing under his hand addressed to the Central Government, resign his office. |
| | (4) The Central Government may remove the Chairperson, Chief Executive Officer or any other member from office if he— |
| | (a) has been adjudged an insolvent; or |
| | (b) has been convicted of an offence which, in the opinion of the Central Government, involves moral turpitude; or |
| | (c) has become physically or mentally incapable of acting as Chairperson, Chief Executive Officer or other member; or |
| | (d) has acquired such financial or other interest as is likely to affect prejudicially his functions as Chairperson, Chief Executive Officer or other member; or |
| | (e) has so abused his position as to render his continuance in office detrimental to the public interest. |
| | (5) Notwithstanding anything contained in sub-section (4), no Chairperson, Chief Executive Officer or other member shall be removed from office under this section unless he has been given a reasonable opportunity of being heard in the matter. |
| 6. | Vacancies, etc., not to invalidate proceedings of the Authority. |
| | No act or proceeding of the Authority shall be invalid merely by reason of— |
| | (a) any vacancy in, or any defect in the constitution of, the Authority; or |
| | (b) any defect in the appointment of a person acting as Chairperson, Chief Executive Officer or other member of the Authority; or |
| | (c) any irregularity in the procedure of the Authority not affecting the merits of the case. |
| 7. | Meeting of the Authority. |
| | (1) The Authority shall meet at such times and places and shall observe such rules of procedure in regard to the transaction of business at its meetings (including the quorum at its meetings) as may be specified by regulations. |
| | (2) If the Chairperson, for any reason, is unable to attend any meeting of the Authority, any other member chosen by the members present at the meeting shall preside at the meeting. |
| | (3) All questions which come up before any meeting of the Authority shall be decided by a majority of votes of the members present and voting, and in the event of an equality of votes, the Chairperson or the person presiding shall have a second or casting vote. |
| 8. | Appointment of officers and other employees of the Authority. |
| | (1) The Authority may appoint such officers and other employees as it considers necessary for the efficient discharge of its functions under this Act. |
| | (2) The method of appointment, salaries and allowances payable to, and other terms and conditions of service of, the officers and other employees of the Authority shall be such as may be specified by regulations. |
| 9. | Functions of the Authority. |
| | The Authority shall perform the following functions, namely:— |
| | (a) to develop rail land for commercial use; |
| | (b) to lease or sell rail land for commercial use in accordance with the provisions of this Act and the rules made thereunder; |
| | (c) to grant leasehold or freehold rights in respect of rail land for commercial use to private parties, public sector undertakings, local authorities or other Government agencies; |
| | (d) to invite tenders for undertaking any development activity on rail land; |
| | (e) to approve schemes for commercial development of rail land; |
| | (f) to monitor the implementation of schemes for commercial development of rail land; |
| | (g) to provide for the planning, design, engineering, construction, development, maintenance, management and operation of railway projects, including stations, railway lines, workshops, depots, railway colonies and other railway infrastructure; |
| | (h) to undertake any other activity necessary for the commercial development of rail land as may be entrusted to it by the Central Government. |
| 10. | Powers of the Authority. |
| | (1) The Authority shall have the power to do all things necessary for the performance of its functions under this Act, including the power to— |
| | (a) enter into contracts with any person, including any private party, public sector undertaking, local authority or other Government agency, for undertaking any development activity on rail land; |
| | (b) levy and collect fees and charges for any services provided by it; |
| | (c) borrow money from any source, including any financial institution, bank or other lending agency, for the purpose of financing its activities; |
| | (d) invest its funds in such manner as may be prescribed; |
| | (e) acquire, hold and dispose of any property, both movable and immovable; |
| | (f) issue directions to any person, including any private party, public sector undertaking, local authority or other Government agency, for the proper implementation of any scheme for commercial development of rail land; |
| | (g) recommend to the Central Government any modifications to the Railways Act, 1989 (24 of 1989) or any other law, for the purpose of facilitating commercial development of rail land; |
| | (h) do all such other things as may be necessary for the commercial development of rail land. |
| | (2) The Authority may, with the previous approval of the Central Government, delegate any of its powers or functions to any of its officers or employees or to any other person. |
| 11. | Directions by the Central Government. |
| | (1) The Authority shall, in the discharge of its functions and duties under this Act, be guided by such directions in matters of policy involving public interest as the Central Government may give to it in writing from time to time. |
| | (2) If any dispute arises as to whether a question is or is not a question of policy involving public interest, the decision of the Central Government thereon shall be final. |
| 12. | Authentication of orders and other instruments of the Authority. |
| | All orders and decisions of the Authority shall be authenticated by the signature of the Chairperson or any other officer of the Authority authorised by the Chairperson in this behalf, and all other instruments issued by the Authority shall be authenticated by the signature of such officer. |
| 13. | Fund of the Authority. |
| | (1) There shall be constituted a Fund to be called the Rail Land Development Authority Fund and there shall be credited thereto— |
| | (a) all grants, subventions, donations, gifts and other sums received by the Authority from the Central Government or any other source; |
| | (b) all fees and charges levied and collected by the Authority; |
| | (c) all moneys received by the Authority by way of loans or advances or otherwise. |
| | (2) The Fund shall be applied for— |
| | (a) meeting the salaries and allowances payable to the Chairperson, Chief Executive Officer, other members, officers and other employees of the Authority and other administrative expenses of the Authority; |
| | (b) meeting the expenses incurred by the Authority in the discharge of its functions and duties under this Act; |
| | (c) meeting any other expenses, including capital expenditure, as the Authority may deem fit, with the previous approval of the Central Government. |
| | (3) All moneys belonging to the Fund shall be deposited in such banks or invested in such manner as may be prescribed. |
| 14. | Schemes for commercial development of rail land. |
| | (1) The Authority may, with the previous approval of the Central Government, prepare schemes for commercial development of rail land. |
| | (2) A scheme prepared under sub-section (1) shall contain such particulars as may be prescribed, including— |
| | (a) the extent and location of the rail land proposed to be developed; |
| | (b) the nature and extent of commercial development proposed to be undertaken; |
| | (c) the estimated cost of commercial development; |
| | (d) the manner in which commercial development is proposed to be undertaken, including the participation of private parties, public sector undertakings, local authorities or other Government agencies; |
| | (e) the terms and conditions for grant of leasehold or freehold rights in respect of rail land for commercial use; |
| | (f) any other matter which the Authority may deem fit or which may be prescribed. |
| | (3) The Authority shall, before submitting a scheme to the Central Government for approval, publish the scheme in such manner as may be prescribed, inviting objections and suggestions from all persons interested in the scheme. |
| | (4) The Central Government may, after considering the objections and suggestions received, approve the scheme with such modifications as it may deem fit or reject the scheme. |
| 15. | Power to acquire land. |
| | (1) Where any land is required for the purpose of commercial development of rail land in accordance with a scheme approved by the Central Government, the Central Government may acquire such land under the provisions of the Land Acquisition Act, 1894 (1 of 1894) or any other law for the time being in force. |
| | (2) The acquisition of land under sub-section (1) shall be deemed to be for a public purpose. |
| 16. | Transfer of rail land to the Authority. |
| | (1) The Central Government may, by order, transfer to the Authority any rail land belonging to the railways, for the purpose of commercial development, on such terms and conditions as may be specified in the order. |
| | (2) Upon the transfer of any rail land to the Authority under sub-section (1), all rights, title and interest in such rail land shall vest in the Authority free from all encumbrances. |
| 17. | Power to lease or sell rail land. |
| | (1) The Authority may, in accordance with the provisions of this Act and the rules made thereunder, lease or sell any rail land transferred to it under section 16 for commercial use. |
| | (2) The leasehold or freehold rights in respect of rail land for commercial use may be granted by the Authority to private parties, public sector undertakings, local authorities or other Government agencies on such terms and conditions as may be specified in the scheme. |
| | (3) The Authority may, for the purpose of granting leasehold or freehold rights in respect of rail land for commercial use, invite tenders in such manner as may be specified by regulations. |
| 18. | Borrowing powers of the Authority. |
| | The Authority may, for the purpose of financing its activities, borrow money from any source, including any financial institution, bank or other lending agency, on such terms and conditions as may be approved by the Central Government. |
| 19. | Accounts and audit. |
| | (1) The Authority shall maintain proper accounts and other relevant records and prepare an annual statement of accounts in such form as may be prescribed by the Central Government in consultation with the Comptroller and Auditor-General of India. |
| | (2) The accounts of the Authority shall be audited by the Comptroller and Auditor-General of India at such intervals as may be specified by him. |
| | (3) The Comptroller and Auditor-General of India and any person appointed by him in connection with the audit of the accounts of the Authority shall have the same rights, privileges and authority in connection with such audit as the Comptroller and Auditor-General of India has in connection with the audit of Government accounts and, in particular, shall have the right to demand the production of books, accounts, connected vouchers and other documents and papers and to inspect any of the offices of the Authority. |
| | (4) The accounts of the Authority as certified by the Comptroller and Auditor-General of India or any other person appointed by him in this behalf, together with the audit report thereon, shall be forwarded annually to the Central Government by the Authority. |
| 20. | Annual report. |
| | The Authority shall prepare an annual report giving a full account of its activities during the previous financial year and forward a copy thereof to the Central Government. |
| 21. | Laying of reports and accounts before Parliament. |
| | The Central Government shall cause the annual report and the audited accounts of the Authority to be laid before both Houses of Parliament as soon as may be after they are received. |
| 22. | Power to make rules. |
| | (1) The Central Government may, by notification in the Official Gazette, make rules for carrying out the purposes of this Act. |
| | (2) In particular, and without prejudice to the generality of the foregoing power, such rules may provide for all or any of the following matters, namely:— |
| | (a) the manner of appointment of the Chairperson, Chief Executive Officer and other members of the Authority under sub-section (2) of section 4; |
| | (b) the salaries and allowances payable to, and other terms and conditions of service of, the Chairperson, Chief Executive Officer and other members under sub-section (4) of section 4; |
| | (c) the manner in which funds of the Authority may be invested under sub-section (3) of section 13; |
| | (d) the particulars to be contained in a scheme for commercial development of rail land under sub-section (2) of section 14; |
| | (e) the manner of publication of a scheme for inviting objections and suggestions from interested persons under sub-section (3) of section 14; |
| | (f) the form in which annual statement of accounts shall be maintained by the Authority under sub-section (1) of section 19; |
| | (g) any other matter which is required to be, or may be, prescribed. |
| 23. | Power to make regulations. |
| | (1) The Authority may, with the previous approval of the Central Government, by notification in the Official Gazette, make regulations consistent with this Act and the rules made thereunder to carry out the purposes of this Act. |
| | (2) In particular, and without prejudice to the generality of the foregoing power, such regulations may provide for all or any of the following matters, namely:— |
| | (a) the times and places of meetings of the Authority and the procedure to be observed thereat, including the quorum at such meetings, under sub-section (1) of section 7; |
| | (b) the method of appointment, salaries and allowances payable to, and other terms and conditions of service of, the officers and other employees of the Authority under sub-section (2) of section 8; |
| | (c) the manner of inviting tenders for granting leasehold or freehold rights in respect of rail land for commercial use under sub-section (3) of section 17; |
| | (d) any other matter which is required to be, or may be, specified by regulations. |
| 24. | Power to remove difficulties. |
| | (1) If any difficulty arises in giving effect to the provisions of this Act, the Central Government may, by order published in the Official Gazette, make such provisions not inconsistent with the provisions of this Act as appear to it to be necessary or expedient for removing the difficulty: |
| | Provided that no such order shall be made after the expiry of two years from the commencement of this Act. |
| | (2) Every order made under this section shall, as soon as may be after it is made, be laid before each House of Parliament. |
| 25. | Repeal and savings. |
| | (1) The Rail Land Development Authority Ordinance, 2025 (Ord. 3 of 2025) is hereby repealed. |
| | (2) Notwithstanding such repeal, anything done or any action taken under the said Ordinance shall be deemed to have been done or taken under the corresponding provisions of this Act. |
| | (3) The provisions of the Railways Act, 1989 (24 of 1989) shall, in so far as they are not inconsistent with the provisions of this Act, continue to apply to the railways. |
| 26. | Transitional provisions. |
| | (1) All rules, regulations, orders or notifications made or issued under the Rail Land Development Authority Ordinance, 2025 (Ord. 3 of 2025) and in force immediately before the commencement of this Act shall, in so far as they are not inconsistent with the provisions of this Act, continue to be in force and be deemed to have been made or issued under the corresponding provisions of this Act. |
| | (2) All proceedings commenced under the Rail Land Development Authority Ordinance, 2025 (Ord. 3 of 2025) and pending immediately before the commencement of this Act shall be continued under the corresponding provisions of this Act. |
| | (3) All appeals pending before the Central Government or any other authority under the Rail Land Development Authority Ordinance, 2025 (Ord. 3 of 2025) immediately before the commencement of this Act shall be continued under the corresponding provisions of this Act. |
| | (4) Any reference to the Rail Land Development Authority Ordinance, 2025 (Ord. 3 of 2025) in any law, instrument or other document shall be construed as a reference to this Act. |
