Short title and commencement – (1) These rules may be ca lled the Ministry of Health and Family Welfare, North Eastern Indira Gandhi Regional Institute of Health & Medical Sciences, Shillong Nursing Teaching Faculty posts ( Group ‘A’) R ecruitment amendment Rules, 2024 along with its preamble. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Number of post, classification and level in Pay Matrix – The number of the said post, its class ification and level in the Pay Matrix attached thereto shall be specified in columns 2 to 4 of the Schedule annexed to these rules. 3. Method of recruitment, age -limit, other qualifications, etc . – The method of recruitment, age -limit, qualifications and oth er matters relating to the said post shall be as specified in columns (5) to (13) of the said Schedule. 4. Disqualification – No person, (a) Who has entered into or contracted a marriage with a person having a spouse living: or (b) Who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appoint ment to the said post: Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operatio n of this rule. 5. Power to Relax – Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing and in consultation with the Ministry of Health & Family Welfare, relax a ny of the provisions of these rules with respect to any class or category of persons or posts. 6. Saving – Nothing in these rules shall affect reservation relaxation of age -limit and other concessions required to be provided for the Scheduled Castes, the Sch eduled Tribes, the Other Backw ard Classes, the Ex -servicemen, Persons with Disabilities and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard. PREAMBLE 1. Short Tile and application a. In exercise of the powers conferred under Rule 6 of the Rules of the Institute, the Governing Council with sanctioned of the Central Government in so far as they relate to the Nursing Teaching Faculty posts only, hereby makes the following rules w hich may be called the North Eastern Indira Gandhi Regional Institute of Health & Medical Sciences Re cruitment Amendment Rules – 2024 . It shall come into effect from the date of issue of the Gazette Notification. 2. Objectives Appointment of Associate Professor, College of Nursing with minimum qualification and experience are a necessary requirement to maintain a standard of teaching. 3. Definition a. Ad-hoc (short term) appointment : Appointment made for a short -term period where delay in regular select ion is envisaged and the post is required to be filled up urgently. b. Nursing Teaching Faculty posts : Posts included in Schedule of these Rules. c. Appointment/Competent Authority: The Competent Authority to make appointment to a post. d. Contract Off icer: A person appointed on contract basis. e. Cadre: The strength of a service or a part of service sanctioned as a separate unit. f. Mode of Recruitment: The recruitment will be carried out in the following manners; “By direct recruitment failing which by deputation (including short term contract) These posts shall be filled up by direct recruitment failing which by deputation or short term contract. In case of direct recruitment, the eligible departmental candidates will also b e allowed to compete, if otherwise eligible. g. Officiating appointment: Appointment of an Institute’s employee to officiate in a vacant post. h. Probation: Appointment on trial to judge the suitability of the employee with a view to his/her ultimate absorption in the permanent service/post in the Institute. If the officer in the opinion of the Institute, is not found fit for permanent appointment, he may be discharged or reverted to the previous post held by him in the service or extend the p eriod of probation. This will not be applicable in case of appointment against a temporary post and also on deputation/contract appointments. The period of probation is as mentioned in the Schedule at Column No.9 i. Permanent post: A post carrying a defin ite rate of pay sanctioned without l imit of time j. Post Graduate Qualification: Post Graduate Qualification means a Post Graduate Qualification recognized as per Indian Nursing Council Act. k. Qualification: Academic and professional qualifications including experience prescribed for each post as per Schedule to these Rules. l. Mode of Selection: Selection for appointment through one or more of the following methods (i) Interview, (ii) Written and /or practical test/s (iii) any other recognized method of evaluation or suitability m. Scale of Pay: Which rises by periodical increments from minimum attached to a particular post. n. Standing Selection Committee: As per the composition of Standing Selection Committee for Group A Faculty posts of NEIGRIHMS, Shillong. The present constitution o f the Selection Committee is as under: 1. Chairman (as nominated by the Governing Council) 2. Nominee of Secretary (H&FW) or his nominee (not below the rank of Joint Secretary) 3. DGHS or his nominee (not below the rank of Addl.DGHS) 4. Director, AIIMS, New Delhi or h is nominee 5. Director, PGIMER or his nominee 6. Nominee of Vice Chancellor, North Eastern Hill University, Shillong 7. Member, Governing Council 8. Member, Governing Council 9. Two experts in the field of speciality/Super speciality 10. One representative of SC/ST an approp riate status working in NEIGRIHMS or some other organization 11. One representative of Minorities and appropriate status working in NEIGRIHMS or some other organization 12. Director, NEIGRIHMS – Member Secretary 4 Procedure for making recruitments: a. The procedure to be followed for making recruitment to various categories of posts shall be as may be prescribed by the appointing authority for each category. The appointing authority may determine the procedure to follow for assessing the suitability of the candidat es in making se lection/s, which may include written test, practical test, holding of personal interview etc. It may also consider candidates on the basis of the particulars furnished in the application and the reports received from the referees, if any. Th e appointing au thority may where necessary, prescribe any special qualification/requirements for any particular post in the interest of the Institute. b. Selection to Group ‘A’ posts shall be made on the recommendations of the Standing Selection Committee constituted by the Institute Rule 9 of the Rules of the North Eastern Indira Gandhi Regional Institute of Health & Medical Sciences, Shillong. No appointm ent to a post shall be made unless the post is created in accordance with Rule 15 & 16 of the Rules o f the North Eastern Indira Gandhi Regional Institute of Health & Medical Sciences, Shillong and approval of the Competent Authority has been obtained for t he particular appointment. 5 Appointment on Deputation/Contract The posts will be filled up by the method of deputation for a period of 5 years only in exemption of the clause on ‘Immediate Absorption Basis’. Persons working in the analogous posts or in posts one level below shall be eligible for consideration provided they fulfil the requisite qualific ation and experience prescribed for the post as for a direct recruit. The period of deputation shall ordinarily not exceed 5 years at a time. In case of po sts to be filled up on contract, persons having requisite qualifications and experience and who have not crossed the age of 65 years will be eligible for consideration. 6 Appointment of Experts The Director may with the approval of the President invite e xperts who may include members of the Institute’s faculty and such others from outside who are eminen t in their respective filed of speciality to assist the Selection Committee/s in making selection/s of suitable candidate/s to teaching post/s and such oth er post/s in the Institute as may be considered by him. 7 Conditions of appointment a. The scale of pa y, mode of recruitment, upper age limit at the time of entry, qualifications etc for appointment to various posts in the Institute, shall be as contained in Schedule to these Rules. b. For posts not provided in Schedule, but created and sanctioned with approval of the competent authority, the qualifications, experience, upper age at the time of entry, mode of recruitment etc. may be prescribed by the appointing authority and the same shall be deemed to have been included in the Schedule to these rules. c. Any modifications/amendments/changes made in respect of any entries in Schedule to these Rules by the competent authority, shall be deemed to have been incorporated in the Schedule. Similarly posts abolished by the order of the competent authority shall b e deemed to have been deleted from the Schedule of these Rules. 8. Screening Committee All applications for the post of Associate Professor, C ollege of Nursing will be scrutinized by a Screening Committee constituted by the Director. 9. Academic Qualif ication / Experience The academic qualification and experience in respect of the post of Associate Professor, College of Nursing are relaxable at the discretion of the Selection Committee in order to enable the Selection Committee to interview the candida tes with relaxed acade mic qualification & experience. 10. Experience The effective date upto which the requisite experience must be completed would be reckoned as on the last date of submission of application(s) 11. Job requirement Specific job require ments should be indica ted against posts where specific expertise are necessary 12. Reservation of Schedule Caste, Schedule Tribe, OBC & PWD Nothing in these Rules shall effect reservation, relaxation of age limit and other concessions required to be prov ided for Scheduled Castes & Scheduled Tribes, Other Backward Classes, Persons with Disabilities and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard. 13. Interpretation In case of any doubt in respect of the interpretation of any of the Rules or the entries in the Schedule to these Rules, the decision of the Director shall be deemed as final and conclusive.
