7805 GI/202 3 (1) EXTRAORDINARY PART II —Section 3 —Sub-section ( ii) PUBLISHED BY AUTHORITY No. 5143] NEW DELHI, TUES DAY , DECEMBER 19, 2023/ AGRAHAYANA 28, 1945 CG-MH-E-20122023-250770 1 3 4 5 6 7 8 LAND TO BE TRANSFERRED MINISTRY OF RAILWAYS [Western Railway (Construction Organization )] NOTIFICATION Mumbai, the 1 9th December , 2023 S.O. 5 372(E).—Whereas, by the notification of the Government of India, in the Ministry of Railways (Railway Board), number, S.O. 2778(E), dated the 26th June, 2023 published in Gazette of India, Extraordinary, Part II, Section 3, Sub -Section (ii), da ted the 11th January, 2023 and issued under sub -section (1) of section 20A of the Railways Act, 1989 (24 of 1989) (hereinafter referred to as the said Act), the Central Government, declared its intention to acquire the land specified in the Schedule anne xed to the said notification for the Purpose of execution, maintenance, management and operation of the Special Railway Project namely, Kadi – Kalol - Katosan Road Gauge Conversion Project (Western Railway) in the District of Ahmedabad and Mahesana in the State of Gujarat; And, whereas, the substance of the said notification was published in the daily newspapers namely the “Divya Bhaskar” (Gujarati), “Times of India” (English), & “Gujarat Vaibhav” (Hindi) dated 1st July, 2023 under sub - section (4) of secti on 20A of the said Act; And, whereas, nil objections were received and same have been considered and disallowed by the Competent Authority and accordingly orders have been passed; And, whereas, in pursuance of sub -section (1) of section 20E of the said Act , the competent authority has submitted its report to the Central Government; Now, therefore, upon receipt of the said report of the competent authority, and in exercise of the powers conferred by sub -section (1) of section 20E of the Said Act, the Central Government hereby declares that the lands specified in the Schedule annexed hereto shall be acquired for the aforesaid purpose; And, further, in pursuance of sub -section (2) of section 20E of the said Act, the Central Government hereby declares that on pu blication of this notification in the Official Gazette, the land specified in the Schedule annexed hereto shall vest absolutely in the Central Government free from all encumbrances.
