L.-33004/99 The Gazette of India CG-DL-E-30052024-254437 EXTRAORDINARY PART II—Section 3—Sub-section (ii) PUBLISHED BY AUTHORITY No. 2025] NEW DELHI, WEDNESDAY, MAY 29, 2024/JYAISHTHA 8, 1946 MINISTRY OF COAL NOTIFICATION New Delhi, the 29th May, 2024 S.O. 2124(E). - Whereas by the notification of the Government of India in the Ministry of Coal number S.O. 2875(E), dated the 3rd July, 2023, issued under sub-section (1) of section 4 of the Coal Bearing Areas (Acquisition and Development) Act, 1957 (20 of 1957) (hereinafter referred to as the said Act), and published in Gazette of India, Extraordinary, Part II, Section-3 of Sub-section(ii), dated the 3rd July, 2023, the Central Government gave notice of its intention to prospect for coal in 250.00 acres (approximately) or 101.174 hectares (approximately) of the land in the locality specified in the Schedule annexed to that notification; And whereas the Central Government is satisfied that coal is obtainable in a part of the said land specified in the Schedule appended to this notification; Now, therefore, in exercise of the powers conferred by sub-section (1) of section 7 of the said Act, the Central Government hereby gives notice of its intention to acquire the land measuring 250.00 acres (approximately) or 101.174 hectares (approximately) and all rights in or over the said land as described in the Schedule appended hereto; Note 1: The plan bearing number MCL/GM(BA)/L and R/2024/02, dated the 11th March, 2024 and Drg. No. R7- GMT-001350, Rev. No 1, dated the 18th March, 2024, the area covered by this notification may be inspected in the office of the Collector, District Angul, State Odisha or in the office of the Coal Controller, Coal Controller Organisation, Scope Minar, Core-2, 5th Floor, Laxmi Nagar, Delhi-110092 or in the office of the Director (Personnel), Mahanadi Coalfields Limited, Jagruti Vihar Post Office Jagruti Vihar, Burla, District Sambalpur-768 020, Odisha. Note 2: Attention is hereby invited to the provisions of section 8 of the said Act which provides as follows:- "8. Objections to acquisition.- (1) Any person interested in any land in respect of which a notification under section 7 has been issued, may, within thirty days of the issue of the notification, object to the acquisition of the whole or any part of the land or any rights in or over such land. Explanation.- It shall not be an objection within the meaning of this section for any person to say that he himself desires to undertake mining operations in the land for the production of coal and that such operations should not be undertaken by the Central Government or by any other person. (2) Every objection under sub section (1) shall be made to the competent authority in writing, and the competent authority shall give the objector an opportunity of being heard either in person or by a legal practitioner and shall, after hearing all such objections and after making such further inquiry, if any, as he thinks necessary, either make a report in respect of the land which has been notified under sub-section (1) of section 7 or of rights in or over such land, or make different reports in respect of different parcels of such land or of rights in or over such land, to the Central Government, containing his recommendations on the objections, together with the record of the proceedings held by him, for the decision of that Government. (3) For the purpose of this section, a person shall be deemed to be interested in land who would be entitled to claim an interest in compensation if the land or any rights in or over such land were acquired under this Act." Note 3: The Coal Controller, Coal Controller Organisation, Ministry of Coal, Scope Minar, 5th Floor, Core II, Laxmi Nagar, Delhi-110092 has been appointed by the Central Government as the competent authority under section 3 of the said Act, vide notification number S.O. 2015, dated the 10th July, 1995, published in the Gazette of India on 22nd July, 1995. Line B(P-21)-C(P-49) : The line starts from point 'B'(P-21) and advances in north direction along the common block boundary of Kalinga East Coal Block and Subhadra West Coal Block and reaches at point ‘C'(P-49), which is Trijunction point of village Joragadia, Barapali and Kishorechandrapur. Line C(P-49)-D(P-63)-E(P-69) : The line starts from point 'C'(P-49) and advances in north direction along the common village boundary of village Barapali & Joragadia through point 'D'(P-63) and advances in north-east direction to reach at point 'E'(P-69), which is the Tetra-Junction point of village Joragadia, Hiloi, Kantapali & Barapali. Line E(P-69)-F(P-72)-G(P-76): The line starts from point 'E'(P-69) and advances in south-east direction along the common village boundary of village Joragadia and Hiloi through point 'F'(P-72) and advances in southern direction to reach at point ‘G’(P-76), which is the Tri-Junction point of village Joragadia, Hiloi, and kurihan . Line G(P-76)-A(P-1) : The line starts from point 'G'(P-76) and advances in south west direction along the common village boundary of village Joragadia and Kurihan and meets at the starting point 'A'(P-1).
