The Ministry of Home Affairs, having been authorised by the Central Government to notify under Rule 5 of the Aadhaar Authentication for Good Governance (Social Welfare, Innovation, Knowledge) Rules, 2020, read with sub-clause (ii) of clause (b) of sub-section (4) of section 4 of the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016, notifies through S.O. 4261(E) dated 29 September 2023 that the Prison Departments of the States and Union Territories are permitted to perform Aadhaar authentication, on a voluntary basis, of visitors to prison inmates using the Yes/No authentication facility; the notification directs that Prison Departments must adhere to sections 3A and 8 of the Aadhaar Act with respect to authenticating persons below 18 years of age, and that all provisions of the Act, its rules and regulations, and directions issued by the Unique Identification Authority of India ('Authority') must be complied with; file reference F. The Prison Departments of the States/UTs shall adhere to the provisions of section 3A and 8 of the Aadhaar Act with respect to the authentication of persons being children i.e., below 18 years of age. 3.
