In Chapter II, rule 3(3) is amended to add reference to a new Form XVI B and to insert items (h), (i) and (j) covering introduction of Double Distant Signalling, new Intermediate Block Signalling, and new Automatic Block Signalling (each without yard remodelling) as categories requiring certification; rule 4A is limited to items (a) to (g); a new rule 4B is inserted requiring documents for items (h) to (j) to be submitted to the General Manager via Form XVI B by the concerned Higher Administrative Grade Officer; and rule 5A's heading is amended. In Chapter VII, rule 25A(1)(e) is amended to remove the words "non-interlocked", with a new Note designating the Principal Chief Engineer as competent authority for works affecting running lines carrying passenger trains; rule 25A(2) wording on upgradation of interlocked level crossings is revised; and a new sub-rule (3) is inserted giving the General Manager of the Zonal Railway, with no further delegation, sanctioning authority for the same three new signalling categories (items a-c). Chapter VIII rule 31(7) is amended to remove "Part I" and substitute "Chapter 7" for "Chapter VII". A new Form XVI B, a certificate to be given by a Higher Administrative Grade Officer confirming compliance with Maximum/Minimum Dimensions, vacuum/air brake provisioning, and Absolute Block or Automatic Block System operation, is inserted. The principal rules were published in G.S.R. 625(E) dated 21 July 2000 and last amended by G.S.R. 321(E) dated 28 April 2023. EXTRAORDINARY PART II —Section 3 —Sub-section ( i) PUBLISHED BY AUTHORITY No. 493] NEW DELHI , TUES DAY, AUGUST 29, 2023/ BHADRA 7, 194 5 CG-DL-E-29082023-248401 MINISTRY OF RAILWAYS (Railway Board) NOTIFICATION New Delhi, the 28th August, 2023 G.S.R. 633(E).—In exercise of the powers conferred by section 198 of the Railways Act, 1989 (24 of 1989), the Central Government hereby makes the following rules further to amend the Railways (Opening for Public Carr iage of Passengers) Rules, 2000 (hereinafter referred to as the said rules), namely: - 1. (1) These rules may be called the Railways (Opening for Public Carriage of Passengers) Second Amendment Rules, 2023. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In Chapter II of the said rules, - (i) after sub - rule (3) of rule 3, - (a) in the proviso, - (i) after the word and letters “Form XVI A ”, the word and letters “or Form XVI B” shall be inserted ; (ii)) in item (f), the word ‘and’ occurring at the end, shall be omitted ; (b) after item (g), the following items shall be inserted, namely: - “(h) introduction of Double Distant S ignalling alongwith corresponding changes at adjacent stations without yard remodelling; (i) introduction of new Inter mediate Block S ignaling , except in section with Slip Siding and Catch S iding, alongwith corresponding changes at adjacent stations without yard remodelling; and (j) introduction of new Automatic Blo ck Signaling , except in section with Slip S iding and Catch Siding, alongwith corresponding changes at adjacent stations without yard remodeling ”. (ii) In rule 4A, for the words and figure “For matters specified in proviso to rule 3”, the words , brackets, letters and figures “For matters relating to items (a) to (g ) specified in proviso to sub-rule (3) of rule 3” shall be substituted; (iii) after rule 4A, the following rule shall be inserted, namely: - “4B. Supply of documents to General Manager . - For matters relating to items (h) to (j) specified in proviso to sub-rule (3) of rule 3 and documents mentioned in rule 4 , as relevant to specific matter, shall be submitted to the General Manager by concerned Higher Administrative Grade Officer of Zonal Railway, who shall provide the certificate as specified in Form XVI B to the General Manager”; (iv) in rule 5A, in the heading, aft er the words “supplied to the” , the words “General Manager or” shall be inserted. 3. In Chapter VII of the said rules, in rule 25A, - (i) in sub -rule (1), - (a) in item (e), the words “non -interlocked” shall be omitted; (b) after item (e), the following N ote shall be inserted, namely: - Note: For sub-rule (1), the Principal Chief Engineer shall be the Competent Authority to grant sanction for works affecting running lines carrying passenger’s trains. ; (ii) in sub -rule (2), - (a) for the words “For upgradation of interlocked level crossing, including interlo cking outside station limits,” ,the words “interlocking of level crossing” shall be substituted; (b) the words “execute and” shall be omitted; (iii) after sub -rule (2), the following sub -rules shall be inserted, namely: - “(3). For items, - (a) introduction of Double Distant S ignalling alongwith corresponding changes at adjacent stations without yard remodelling; (b) introduc tion of new Intermediate Block S ignaling , except in section with Slip S iding and Catch Siding, alongwith corresponding changes at adjacent stations without yard remodelling; and (c) introduction of new Aut omatic Block Signaling , except in section with Slip Siding and Catch Siding, alongwith corresponding changes at adjacent stations without yard remodeling, the Competent Authority to grant sanction to open works , shall be the General Manager of Zonal Railwa y, with no further delegation. Note -The General Manager or Principal Chief Signal and Telecommunication Engineer of the Zonal Railway , as the case may be, may sanction the opening of work s for passenger traffic under sub -rules (2) and (3) of rule 25A, if he is satisfied, either with or without inspection and w orks so opened without inspection, should ordinarily be inspected at the earliest possible date, but in case of works of a minor types , the General Manager or Principal Chief Signal and Telecommunicat ion Engineer of Zonal Railway , as the case may be, shall exercise his discretion as to the necessity of carrying out a subsequent inspection. ” 4. In Chapter VII I of the said rules, in sub-rule (7) of rule 31, - (i) the word and letter ‘Part I ’ shall be omitted ; (ii) for the word and letters “Chapter VII” , the word and figure “Chapter 7” shall be substituted; 5. In the said rules, after Form XVI A and the entries relating thereto , the following “ Form XVI B and entries ”, shall be inserted, namely: - “FORM XVI B [See items (h) to (j) specified in proviso to sub-rule (3) of rule 3 and rule 4B ] CERTIFICATE TO BE GIVEN BY HIGHER ADMINISTRATIVE GRADE OFFICER I do hereby certify: - (i) that the Maximum Dimensions for railway in India have in every case been worked to, with the exceptions detailed in the statement herewith annexed and a lso, that the Standard Dimensions will be observed in future, and that no work or structure infringing the Standard Dimensions will hereafter be permitted without the sanction o f the Central Government. (ii) that every coaching vehicle constructed or procured for the use of the railway in mail and passenger trains is, and shall be provided with vacuum or air brake and effective means of communication between passengers, guard a nd driver. Note: This item of certificate is not necessary for those light lines on which the use of vacuum or air brake has not been insisted upon. (iii) that the railway shall be worked on the system known as Absolute Block System or Automatic Block Syst em in accordance with the regulations prescribed in section Chapter VIII or Chapter IX of the General Rules for Railways in India. Note: In the statement showing the cases in which the Maximum and Minimum dimensions have been infringed full details for eac h case must be given, in the form attached (Form XVII) with explanation of the necessity for such infrin gements and a reference to the A uthori ty under which it was permitted. I f there have been no infringements of the Maximum and Minimum Dimensions the wor ds, “with the exception detailed in the statement herewith annexed”, should be omitted or stuck out. (iv) that the signaling and telecommunication equipment have been installed in accordance with the approved instructions and they are safe for passing tra ffic. (v) that ………….. has been delegated to accompany the General Manager on his inspection and all information supplied or engagements entered into by him shall bear my authority.
