By notification G.S.R. 461(E) dated 16th June 2023, the Ministry of Home Affairs, Narcotics Control Bureau, in exercise of powers under the proviso to Article 309 of the Constitution, superseded the Ministry of Home Affairs, Narcotics Control Bureau, Staff Car Driver (Group 'C' Posts) Recruitment Rules, 2015 and promulgated the Ministry of Home Affairs, Narcotics Control Bureau, Staff Car Driver (Group 'C', Non Gazetted Post) Recruitment Rules, 2023, effective from the date of publication in the Official Gazette; the rules govern recruitment, number of posts, classification and pay-matrix level, method of recruitment, age limits and qualifications, disqualification on grounds of bigamy (subject to Central Government exemption), power to relax provisions, and savings for reservation and age relaxation for Scheduled Castes, Scheduled Tribes, Other Backward Classes, Ex-servicemen and other special categories; the Schedule specifies three posts: Staff Car Driver (Grade-I), 38 posts in Level-5 (Rs. 29200-92300), filled 100% by promotion (six years' regular service as Grade-II or combined fifteen years' service) failing which by deputation, subject to a Departmental Promotion Committee chaired by the Deputy Director, Narcotics Control Bureau; Staff Car Driver (Grade-II), 33 posts in Level-4 (Rs. 25500-81100), filled 100% by promotion (nine years' regular service in Ordinary Grade) failing which by deputation; and Staff Car Driver (Ordinary Grade), 33 posts in Level-2 (Rs. 19900-63200), age limit 18 to 25 years (relaxable to 40 for Government servants, or 18 to 27 for direct open competitive examination), filled by deputation or absorption failing which by direct recruitment, with a maximum deputation age limit of fifty-six years; the notification was issued under F. Short tit le and commencement. –– (1) These rules may be called the Ministry of Home Affairs, Narcotics Control Bureau, Staff Car Driver (Group ‘C’, Non Gazetted Post) Recruitment Rules, 2023. (2) They shall come into force on the date of their publication in the Off icial Gazette. Application. - These rules shall apply to the posts specified in column (1) of the Schedule annexed to these rules. 2. Number of posts, classification and level in the pay matrix. –– The number of the posts, their classification and level in the pay matrix attached thereto shall be as specified in columns (2) to (4) of the afore -said Schedule. 3. Method of recruitment, age -limit and other qualifications, etc. –– The method of recruitment, age -limit, qualifications and other matters rel ating thereto, shall be as specified in columns (5) to (13) of the said Schedule. 4. Disqualification. –– No person, – (a) who has entered into or contracted a marriage with a person having a spouse living; or (b) who, having a spouse living, has entered into or contr acted a marriage with any person, shall be eligible for appointment to the said post: Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marr iage and that there are other grounds for so doing, exempt any person from the operation of this rule. 5. Power to relax. –– Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recor ded in writing, relax any of the provisions of these rules with respect to any class or category of persons. 6. Saving.–– Nothing in these rules shall affect reservation, relaxation of age -limit and other concessions required to be provided for the Schedul ed Castes, the Schedule Tribes, Other Backward Classes, Ex -servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard. Promotion : Staff Car Driver (Grade –II) in level -4 (Rs.25500 -81100) in the the pay matrix with six years of reg ular service or with a combined service of fifteen years in Staff Car Driver Grade -II and Staff Car Driver (Ordinary Grade); and have passed the trade test , specified by the Central Government. 2. Deputation : Officials of Central Government or State Gover nment or Union territories : - (a) holding analogous posts on regular basis in the parent cadre or department; or (b) with five years regular service in the level -4 (Rs.25500 -81100) in the pay matrix in the parent cadre or department. Note 1: The Departme nt officers in the feeder category who are in the direct line Group `C’ Departmental Promotional Committee for considering promotion consisting of: - (1) Deputy Director, Narc otics Control Bureau - Chairman. (2) Assistant Director, Narcotics Control Bureau – Member . (3) An officer of the level of Under Secretary from any Department other than Narcotics Control Bureau of th e Ministry of Home Affairs - Member . Not applicable of promotion shall not be eligible for consideration for appointment on deputation and similarly, the deputationists shall not be eligible for consideration for appointment by promotion. Note 2 : Period of deputation including period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other Organisation or Department of the Central Government shall ordinarily not to exceed three years. Note 1: The Department officers in the feeder category who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation and similarily, the deputationists shall not be eligible for consideration for appointment by promotion. Note 2: Period of deputation including period of deputation in another ex-cadre post held Group `C’ Departmental Promotion Committee for considering promotion consisting of: - (1) Deputy Director, Narcotics Control Bureau - Chairman . (2) Assistant Director, N arcotics Control Bureau – Member . (3) An officer of the level of Under Secretary from any Department other than Narcotics Control Bureau of the Ministry of Home Affairs - Member. Not applicable immediately preceding this appointment in the same or some other organisation or Department of the Central Government shall ordinarily not to exceed three years. Note: The crucial date for determining the age limit shall be the closing date for receipt of applications from candidates in India and not the closing date speci fied for those in Assam, Meghalaya, Arunachal Pradesh, Mizoram, Manipur, Nagaland, Tripura, Sikkim, Union territory of Ladakh, Lahaul and Spiti District and Pangi Sub Division of Chamba District of Himachal Pradesh, Andaman and Nicobar Islands of Lakshadwe ep). * If the ‘direct recruitment’ is to be made by ‘direct open competitive examination’, the age limit would be 18 to 27 years. 7 8 9 10 1. Essential : (i) possession of a valid driving license for motor cars; (ii) knowledge of motor mechanism (the candidate s hould be able to remove minor defets in vehicle); (iii) experience of driving a motor car for at least three years; and (iv) pass in 10th standard. 2. Desirable: Three years’ service as Home Guard or Civil Volunteers. Note: The qualification regarding expe rience is relaxable at the discretion of the competent authority in the case of candidates belonging Not applicable Two years for direct recruits or re -employed. Deputation or absorption failing which by direct recruitment. For Armed Forces Personnel: Deput ation or re -employment. to the Scheduled Castes or Scheduled Tribes if at any stage of selection, the competent authority is of the opinion that the sufficient number of candidate s with requisite experience is not likely to be available to fill up the vacancy reserved for them. 11 12 13 1. Deputation or Absorption : From amongst the regular Dispatch Rider (Group C) and Group C employees in level -1(Rs. 18000 -56900) in the pay matrix in Narcotics Control Bureau who possess valid Driving License for Moto r Cars on the basis of a Driving Test to assess the competence to drive Motor Cars failing which from officials holding the post of Dispatch Rider on regular basis or regular Group C employees in in the level -1(Rs. 18000 -56900) in the pay matrix in other Ministries of the Central Government who fulfill the necessary qualifications as mentioned in column (7). 2. Deputation or re -employment for Armed Forces Personnel : The Armed Forces Personnel due to retire or who are to be transferred to reserve within a period of one year and having the requisite experience and qualifications prescribed shall also be considered and such persons would be given deputation terms upto the date on which they are due for release from the Armed Forces; thereafter they may be co ntinued on re - employment. Note1: The period of deputation including the period of deputation in another ex- cadre post held immediately preceding this appointment in the same or some other organisation or Department of the Central Government shall ordinari ly not exceed three years. Note2: The maximum age - limit for appointment by deputation or absorption shall not be exceeding fifty six years as on the closing date of receipt of applications. Group `C’ Departmental Committee for considering confirmation co nsisting of: (1) Deputy Director, Narcotics Control Bureau - Chairman. (2) Assistant Director, Narcotics Control Bureau – Member.
