Ramesh Kumar Maheshwari (Membership No. 058398, of Kolkata) guilty of Professional Misconduct falling within Items (5), (6), (7) and (8) of Part I of the Second Schedule to the Chartered Accountants Act, 1949, and, after affording a hearing under Rule 19(1), ordered removal of his name from the Register of Members for three months together with a fine of Rs. 1,00,000 payable within 90 days (with a further one-month removal on default); since the fine was paid, under sub-section (2) of Section 20 of the Act and Regulation 18 of the Chartered Accountants Regulations, 1988, his name stood removed from the Register of Members for three months with effect from 23rd August 2024; signed by CA. In terms of the provisions of Section 21B(3) of the Chartered Accountants Act, 1949 read with Rule 18(17) of the Chartered Accountants (Procedure of Investigations of Professional and Other Misconduct and Conduct of Cases) Rules, 2007, the Disciplinary Committee has held CA. Ramesh Kumar Maheshwari (Membership No. 058398), 16, British India Street, 2nd Floor, Room No. 2D, KOLKATA 700069, guilty of Professional Misconduct falling within the meaning of Items (5), (6), (7) and (8) of Part I of Second Schedule to the aforesaid Act and consequently after affording an opportunity of being heard in terms of Rule 19(1) of the aforesaid Rules, ordered for removal of name of CA. Ramesh Kumar Maheshwari (Membership No. 058398) from the Register of Members for a period of 03 (Three) months and also imposed a Fine of Rs. 1,00,000/-(Rupees One Lakh) only to be paid within a period of 90 days of receipt of the Order and in case of default in payment of fine within stipulated time, his name be removed for a further period of 1(One) month. Since, the Respondent has already paid the imposed fine, in pursuance of the aforesaid Order of the Disciplinary Committee and in exercise of the powers conferred by sub-section (2) of Section 20 of the aforesaid Act, it is hereby notified under Regulation 18 of the Chartered Accountants Regulations 1988, that the name of CA.
