NOTIFICATION
New Delhi, the 23rd October, 2023
G.S.R . 794 (E).—Whereas the draft Rules further to amend the Insecticides Rules, 1971, was p ublished, as
required by section 36 of the Insecticides Act, 1968 (46 of 1968) vide notification of the Government of India in the
Ministry of Agriculture and Farmers Welfare (Department of Agriculture and Farmers Welfare) number G.S.R. 406 (E),
dated the 1st June, 2023, in the Gazette of India, Extraordinary, Part -II, Section -3, sub -section (i), inviting objections
or suggestions from all persons likely to be affected thereby, before the expiry of a period of thirty days from the date
on which the copies o f the Gazette of India in which the said notification was published, were made available to the
public.
And whereas, copies of the said notification were made available to the public on 1st day of June, 2023;
And whereas, no objections or suggestions were received from the public on the said draft rules by the
Central Government;
Now, therefore, in exercise of the powers conferred by section 36 of the said Act, the Central Government
hereby makes the following rules further to amend the Insecticides Rules, 1971, namely:
1. (1) These rules may be called the Insecticides (Fifth Amendment) Rules, 2023.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Insecticides Rules, 1971, in rule 14, in sub -rule(1), the followi ng provisos, shall be inserted namely:
“Provided that in case of death of the existing retailer or dealer, the family member of the deceased retailer or
dealer, during the currency of the license, may apply for permission to transfer the license in his na me subject to
the submission of the death certificate of the deceased dealer or retailer and the legal heir certificate before the
concerned licensing officer:
Provide further that the family member of the deceased retailer or dealer who is without the qua lifications referred
to in rule 10 shall undergo the certificate course in insecticides management for transfer of license and such
license shall be provisionally transferred to the family member for a period of one year or till the family member
completes the certificate course in insecticides management, whichever is earlier and during the said period, the
applicant may employ a person with such educational qualifications referred to in rule 10.”.
