The Ministry of Environment, Forest and Climate Change, vide S.O. 1791(E) dated 25th April 2024, in exercise of powers under sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) and in pursuance of notification S.O. 1533(E) dated 14th September 2006, constitutes the State Level Environment Impact Assessment Authority, Goa, comprising Dr. Purushottam Raya Pednekar as Chairman, Dr. Dipak C. S. Gaitonde as Member, and the Director (Environment and Climate Change), ex-officio Joint Secretary, Government of Goa, as Ex-Member-Secretary, to hold office for three years from publication. It also constitutes, in consultation with the State Government of Goa, the State Level Expert Appraisal Committee, Goa, comprising Er. Pascoal Barbosa Noronha as Chairman; Dr. Nitin S. Sawant, Dr. Subhash Hanamantappa Bhosale, Shri Prasad Shashikant Rangnekar, Dr. Jose Romeno Faleiro, Shri Sanjay Jahagirdar, Shri Sujeetkumar Mariappa Dongre and Shri Sanjay Amonkar as Members; and the Senior Environmental Engineer, Goa State Pollution Control Board, as Member-Secretary, also for a three-year term. The Authority is to decide based on the Committee's recommendations, with decisions ordinarily unanimous or, if by majority, recorded with dissenting views communicated to the Central Government. Members must declare consulting affiliations and recuse themselves from appraisal of projects for proponents they consulted for in the preceding five years. The Government of Goa is to provide secretariat, financial and logistic support, and pay sitting fees, travelling and dearness allowances per relevant State Government rules. L.-33004/99 The Gazette of India CG-DL-E-25042024-253852 EXTRAORDINARY PART II—Section 3—Sub-section (ii) PUBLISHED BY AUTHORITY No. 1699] NEW DELHI, THURSDAY, APRIL 25, 2024/VAISAKHA 05, 1946 MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 25th April, 2024 S.O. 1791(E).—In exercise of the powers conferred by sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) and in pursuance of the notification of the Government of India in the erstwhile Ministry of Environment and Forests, number S.O. 1533(E), dated the 14th September, 2006 (hereinafter referred to as the said notification), the Central Government hereby constitutes the State Level Environment Impact Assessment Authority, Goa (hereinafter referred to as the Authority) comprising of the following persons, namely: - (i) Dr. Purushottam Raya Pednekar, residing at Surya Ganesh, H.No.4/95/F, Next to SAG Girl Sports Hostel, Peddem, Mapusa, Goa. Pin 403526 -Chairman; (ii) Dr. Dipak C. S. Gaitonde, Head of Department – Humanities and Science, Government Polytechnic, Panaji, and residing at AF-Parrikar Hill residency, Khorlim, Mapusa, Bardez-Goa, Pin. 403507 -Member; (iii) Director (Environment and Climate Change), Officio, Jt. Secretary, Government of Goa Ex-Member- Secretary. 2. The Chairman and Members of the Authority shall hold office for a period of three years from the date of publication of this notification in the Official Gazette. 3. The Authority shall exercise such powers and follow such procedures as specified in the said notification. 4. The Authority shall take its decision on the recommendations of the State Level Expert Appraisal Committee constituted under paragraph 6. 5. All decisions of the Authority shall be taken in a meeting and shall ordinarily be unanimous: Provided that, in case a decision is taken by majority, the details of views, for and against it, shall be clearly recorded in the minutes and a copy thereof shall be sent to the Central Government. 6. The Central Government, in consultation with the State Government of Goa, for the purpose of assisting the Authority, hereby constitutes the State Level Expert Appraisal Committee (hereinafter referred to as the Committee), comprising of the following persons, namely: - (i) Er. Pascoal Barbosa Noronha, H. No. 206, St. Joaquim Road, Opposite St. Joaquim Chapel. Borda, 403 602 -Chairman; (ii) Dr. Nitin S. Sawant, Assistance Professor of Zoology, Goa University residing at H.No. 991/A, Shri Ganesh, Alto Porvorim, Berdez, Goa Pin. 403521 -Member; (iii) Dr. Subhash Hanamantappa Bhosale, H.No.15/B, Shree Sharada Co. Op. Housing Society, Farmagudi- Dhavali Bypass road, Behind Hotel Venkateshleel, Xemetimb, Bandora, Ponda- Goa -Member; (iv) Shri Prasad Shashikant Rangnekar, Corlim, Ella Tiswadi, Goa -Member; (v) Dr. Jose Romeno Faleiro, Mariella, House No.225, Arlem-Raia, Salcete, Goa -Member; (vi) Shri. The Chairman and Members of the Committee, shall hold office for a period of three years from the date of publication of this notification in the Official Gazette. 8. The Committee shall exercise such powers and follow such procedures as specified in the said notification. 9. The Committee shall function on the principle of collective responsibility and the Chairman shall endeavour to reach consensus in each case, and if consensus cannot be reached the view of the majority shall prevail. 10. In order to avoid any conflict of interest,- (i) the Chairman and Members of the Authority and the Committee shall- (a) declare to which consulting organisation they have been associated with and also the project proponents; (b) not undertake any consultation or associate with regard to preparation of Environment Impact Assessment and Environment Management Plan for project, which is to be decided by the Authority, or to be appraised by the Committee during their tenure; and (ii) in the preceding five years, if the Chairman or any Member of the Authority or Committee has provided consultancy services or conducted Environment Impact Assessment studies for any project proponent, they shall recuse themselves from the meetings of the Authority or Committee from the process of appraisal of any project proposed by such proponents. 11. The State Government of Goa shall specify an agency to act as secretariat of the Authority and the Committee which shall provide financial and logistic support including accommodation, transportation and such other facilities in respect of their functions under the said notification. 12. The sitting fee, travelling allowances and dearness allowances to the Chairman and Members of the Authority and the Committee, shall be paid in accordance with the provisions of relevant rules of the State Government of Goa.
