The Institute of Chartered Accountants of India (ICAI), in Notification No. PR/145/2016/DD/171/2016/DC/962/2018 dated 22nd September 2023, records that its Disciplinary Committee, acting under Section 21B(3) of the Chartered Accountants Act, 1949 read with Rule 18(17) of the Chartered Accountants (Procedure of Investigations of Professional and Other Misconduct and Conduct of Cases) Rules, 2007, held CA. Amar Tandon (Membership No. 072630) of Lucknow guilty of Professional Misconduct under Clauses (6) and (7) of Part I of the Second Schedule to the Act, and, after a hearing under Rule 19(1), ordered removal of his name from the Register of Members for three months together with a fine of Rs. 1,00,000. The Respondent's appeal (Appeal No. 28/ICAI/2022) was dismissed by the Appellate Authority in an order dated 30th August 2023, which upheld the Disciplinary Committee's order. Accordingly, under Section 20(2) of the Chartered Accountants Act, 1949 and Regulation 18 of the Chartered Accountants Regulations, 1988, CA. Amar Tandon (Membership No. 072630), LG-1, Pinky Apartments, 93 -N, Dali Bagh, Near Ganga Sansthan, LUCKNOW - 226001, guilty of Professional Misconduct falling within the meaning of Clauses (6) and (7) of Part I of Second Schedule to the aforesaid Act consequently after affording an opportunit y of being heard in terms of Rule 19(1) of the aforesaid Rules, ordered for removal of the name of CA. Amar Tandon (Membership No. 072630) from the Register of Members for a period of 03(Three) months and also imposed a fine of Rs. 1,00,000/ - (Rupees One Lakh Only). Aggrieved by Order of the Committee, the Respondent preferred an Appeal in terms of Section 22G of the Chartered Accountants Act, 1949 and the Appellate Authority in appeal no. 28/ICAI/2022 vide its order dated 30th August, 2023 has upheld the impugned order of the Disciplinary Committee. Accordingly, in pursuance of the aforesaid Order of the Disciplinary Committee which has also been upheld by the Appellate Authority and in exercise of the powers conferred by sub -section (2) of Section 20 of the aforesaid Act, it is hereby notified under Regulation 18 of the Chartered Accountants Regulations 1988, that the name of said CA.
