L.-33004/99 The Gazette of India CG-DL-E-23072025-264900 EXTRAORDINARY PART II-Section 3-Sub-section (i) PUBLISHED BY AUTHORITY NEW DELHI, MONDAY, JULY 21, 2025/ASHADHA 30, 1947 No. 440] MINISTRY OF AGRICULTURE AND FARMERS' WELFARE (DEPARTMENT OF AGRICULTURE AND FARMERS' WELFARE) NOTIFICATION New Delhi, the 4th July, 2025 G.S.R. 483(E).—In exercise of the powers conferred by sub-section (1) of section 95 of the Protection of Plant Varieties and Farmers' Rights Act, 2001 (53 of 2001), the Protection of Plant Varieties and Farmers' Rights Authority, with the previous approval of the Central Government, hereby makes the following regulations further to amend the Protection of Plant Varieties and Farmers' Rights Regulations, 2006, namely: 1. Short title and commencement.- (1) These regulations may be called the Protection of Plant Varieties and Farmers' Rights (Amendment) Regulations, 2025. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Protection of Plant Varieties and Farmers' Rights Regulations, 2006 (herein referred as said regulation), for regulation 4, the following regulation shall be substituted, namely:- "4. Jurisdiction.- (1) The jurisdiction of the Registrar shall be such as may be determined by the Authority from time to time and shall be assisted by the Joint Registrar, Deputy Registrar, Deputy Director (Administration), Accountant and other technical, legal advisor, financial and administrative staff.". 3. In the said regulation, for regulation 5, the following regulations shall be substituted.- "5. The term of office and the conditions of service of the Registrars.- (1) The term of office, qualifications, experience and conditions of service of the Registrars, Joint Registrars and Deputy Registrars shall be as per provisions specified in the Schedule annexed to these regulations. 5A. Initial constitution.- (1) Personnel holding the posts specified in column (1) of the Schedule, immediately before the commencement of these regulations on a regular basis, shall be deemed to have been appointed under the provisions of these regulations. (2) The regular continuous service of personnel referred to in sub-regulation (1) in the respective grade immediately before the commencement of these regulations, shall count for the probation period and qualifying service for promotion, confirmation, and pension in the service.". 4. Short title and commencement.- (1) These regulations may be called the Protection of Plant Varieties and Farmers' Rights (Amendment) Regulations, 2025. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Protection of Plant Varieties and Farmers' Rights Regulations, 2006 (herein referred as said regulation), for regulation 4, the following regulation shall be substituted, namely:- "4. Jurisdiction.- (1) The jurisdiction of the Registrar shall be such as may be determined by the Authority from time to time and shall be assisted by the Joint Registrar, Deputy Registrar, Deputy Director (Administration), Accountant and other technical, legal advisor, financial and administrative staff.". 3. In the said regulation, for regulation 5, the following regulations shall be substituted.- "5. The term of office and the conditions of service of the Registrars.- (1) The term of office, qualifications, experience and conditions of service of the Registrars, Joint Registrars and Deputy Registrars shall be as per provisions specified in the Schedule annexed to these regulations. 5A. Initial constitution.- (1) Personnel holding the posts specified in column (1) of the Schedule, immediately before the commencement of these regulations on a regular basis, shall be deemed to have been appointed under the provisions of these regulations. (2) The regular continuous service of personnel referred to in sub-regulation (1) in the respective grade immediately before the commencement of these regulations, shall count for the probation period and qualifying service for promotion, confirmation, and pension in the service.". 4.
