The Central Electricity Authority had granted prior approval under section 68(1) of the Electricity Act via letter CEA-PS-11-23(20)/1/2018-PSPA-I dated 2 December 2022. The applicant published notice in The Indian Express (09.06.2023), Rajasthan Patrika (08.06.2023), Divya Bhaskar (08.06.2023) and the Weekly Gazette of India (15.07.2023), and affirmed by affidavit dated 3 November 2023 that no objections were received within the two-month period. The line passes through numerous villages across Banaskantha, Patan, Mahesana and Ahmedabad districts of Gujarat. The authorization is granted for 25 years, subject to conditions including obtaining consent of local bodies/Railways/Highways authorities, compliance with Appropriate Commission regulations, Electrical Inspector approval, submission of clearances (Civil Aviation, Defence, etc.) to CEA, and, where the route falls within Great Indian Bustard (GIB) potential/priority zones, compliance with the Supreme Court's order dated 19.04.2021 in Petition No. 838 of 2019 regarding undergrounding or bird diverters. And whereas, Central Electricity Authority (CEA), Ministry of Power, Government of India vide its letter CEA -PS-11-23(20)/1/2018 -PSPA -I Division -Part(1) dated 02.12.2022 had granted prior approval under section 68(1) of the Electricity Act, 2003 for the overhead line covered under the transmission scheme “Transmission Network Expansion in Gujarat associated with integration of RE projects from Khavda potential RE zone”. M/s Powergrid Khavda RE Transmission System Limited had published notice for transmission scheme in local ne wspapers The Indian Express (in English) dated 09.06.2023, Rajasthan Patrika (in Hindi) dated 08.06.2023 and Divya Bhaskar (in Gujarati) dated 08.06.2023 and in Weekly Gazette of India dated 15.07.2023 for the general public to make observations/representa tions on the proposed transmission route within 2 Months from the date of publication. Subsequently, M/s Powergrid Khavda RE Transmission System Limited has submitted an affidavit dated 03.11.2023 declaring that no observation/representation was received w ithin 2 Months from the date of Publication in the official gazette of Government of India. And now the applicant has requested to confer upon him, all the powers under section 164 of the Electricity Act, 2003, which the telegraph authority possess under the Indian Telegraph Act, 1885 with respect to the placing of telegraph lines and posts for the purpose of a telegraph established or maintained by Government or to be so established or maintained for laying of electric lines under “Transmission Network Ex pansion in Gujarat associated with integration of RE projects from Khavda potential RE zone”. Jholapur, Bakrana, Khoraj Nadoda, Hamajpura, Virochannagar Sanand Ahmedabad Now, after careful consideration, Ministry of Power, Government of India, under section 164 of the Electricity Act, 2003, confers all the powers to M/s Powergrid Khavda RE Transmission System Limited for laying above overhead line, which telegraph authority possesses under the Indian Telegraph Act, 1885 with respect to placing of telegraph lines and posts for the purposes of a telegraph established or maintained, by Government or to be established or maintained subject to following terms and conditions for installing the above mentioned line, namely: i. The approval is granted for 25 years. ii. The Applicant shall have to seek the co nsent of the concerned authorities i.e., local bodies, Railways, National Highways, State Highways etc. before erection of proposed line. iii. The Applicant shall have to follow regulations/codes of the Appropriate Commission regarding transmission, O&M, open a ccess, etc., framed under Electricity Act, 2003. iv. The Applicant shall operate the line after approval of Electrical Inspector / Chief Electrical Inspector of Central Government. v. The approval is subject to compliance of the requirement of the provisions of t he Electricity Act, 2003 and the rules made there under by the applicant. vi. M/s Powergrid Khavda RE Transmission System Limited shall have to submit the requisite clearances to Central Electricity Authority after obtaining the same from concerned authorities like Civil Aviation, Defense etc., at the time of Electrical Inspection. vii. In case, the route of above overhead lines (or some portion of the route of above overhead line ) falls in the Great Indian Bustard (GIB) potential zone (or priority zone) marked in the map which is part of the order of the Hon’ble Supreme Court order dated 19.04.2021, in the petition No.838 of 2019 regarding Great Indian Bustard (GIB) case, the applicant has to comply with the directions of the Hon’ble Supreme Court, with regard to u ndergrounding of the above overhead transmission line and / or fixing of bird diverters, as the case may be as per the Hon’ble Supreme Court Order dated 19.04.2021 and the directions of the technical committee constituted by the Hon’ble Supreme Court in th is regard.
