The Ministry of Power issued Order S.O. 4982(E) dated 20 November 2023 on the application of M/s Powergrid Bhadla Transmission Limited (registered at B-9, Qutub Institutional Area, Katwaria Sarai, New Delhi-110016) under Section 164 of the Electricity Act, 2003, for authorization to lay an overhead transmission line on a modified route under the 'Transmission system strengthening scheme for evacuation of Power from Solar energy zone in Rajasthan (8.1 GW) under Phase-II Part-B,' noting that Central Electricity Authority had earlier granted prior approval under Section 68(1) via letter dated 05.11.2020 and Section 164 approval vide Gazette ID CG-DL-E-22022022-233673 dated 30.12.2021, that approximately 36 km of the route was subsequently re-routed following a Supreme Court-nominated committee's clearance letter dated 18.07.2022 arising from the Great Indian Bustard (GIB) case (Supreme Court order dated 19.04.2021 in IA No. 85618/2020 in WP(Civil) No. 838 of 2019), and that public notice of the modified route was published in Times Business (Jaipur, English) and Rajasthan Patrika (Barmer, Hindi), both dated 30.05.2023, and in the Weekly Gazette of India dated 01.07.2023, with no objections received per affidavit dated 01.09.2023; the Ministry accordingly confers on Powergrid Bhadla Transmission Limited, for 25 years, all powers under the Indian Telegraph Act, 1885 for the re-routed portion of the Fatehgarh II PS-Bhadla II PS 765 kV D/C (2nd) line passing through named villages in Fatehgarh and Pokharan tehsils, Jaisalmer district, Rajasthan, subject to conditions including obtaining consent from local bodies, Railways and Highways authorities, complying with Electricity Act 2003 regulations, operating only after Electrical Inspector approval, submitting Civil Aviation and Defence clearances to the Central Electricity Authority, and complying with Supreme Court directions on undergrounding or bird diverters in GIB potential areas; signed by M.V.N. 7242 GI/202 3 (1) EXTRAORDINARY PART II —Section 3 —Sub-section ( ii) PUBLISHED BY AUTHORITY No. 4773] NEW DELHI, MONDAY , NOVEMBER 20 , 2023/ KARTIKA 29, 1945 CG-DL-E-20112023-250168 MINISTRY OF POWER ORDER New Delhi, th e 20th November , 2023 S.O. 4 982(E).—Whereas M/s Powergrid Bhadla Transmission Limited, the applicant with its registered address at B -9, Qutub Institutional Area, Katwaria Sarai, New Delhi – 110016, India has applied for authorization under Section 164 of the Electricity Act, 2003 for laying of overhead transmission line on modified route under “Transmission system strengthening scheme for evacuation of Power from Solar energy zone in Rajasthan (8.1 GW) under Phase -II Part -B”. And whereas, Central Electricity Authority (CEA), Ministry of Power, Government of India vide its letter CEA -PS-11-21(25)/1/2018 -PSPA -I Division -Part (2) dated 05.11.2020 had granted prior approval under section 68(1) of the Electricity Act, 2003 for the o verhead line covered under “Transmission system strengthening scheme for evacuation of Power from Solar energy zone in Rajasthan (8.1 GW) under Phase -II Part -B”. CEA, Ministry of Power, Government of India vide it’s Gazette ID CG -DL-E-22022022 -233673 dated 30.12.2021 has granted approval of section 164 of the Electricity Act, 2003, conferring all the powers which telegraph authority possesses under the Indian Telegraph Act, 1885 with respect to placing of telegraph lines and posts for the purposes of a tele graph established or maintained by Government or to be established or maintained by M/s Powergrid Bhadla Transmission Limited for laying above overhead line. However, in pursuance to Hon’ble Supreme court order dated 19.04.21 in IA no. 85618/2020 in WP (Ci vil) No. 838 of 2019, M/s Powergrid Bhadla Transmission Limited had approached to the committee nominated by Hon’ble Supreme Court order for clearance of transmission line route related to GIB (Great Indian Bustard). Thereafter, nominated Committee by Hon’ ble Supreme court vide letter dated 18.07.22 has cleared the route of the line with some modification in existing route. Accordingly, approximately 36 km of the route of the said line has been re -routed. M/s Powergrid Bhadla Transmission Limited has publis hed notice for modified route of the transmission scheme in local newspapers Times Business, Jaipur edition (in English) dated 30.05.2023, Rajasthan Patrika, Barmer edition (in Hindi) dated 30.05.2023 and in Weekly Gazette of India dated 01.07.2023 for the general public to make observations/representations on the proposed transmission route within Two Months from the date of publication. Subsequently, M/s Powergrid Bhadla Transmission Limited has submitted an affidavit dated 01.09.2023 declaring that no ob servation/representation was received within Two Months from the date of Publication in the official gazette of Government of India. And now the applicant has requested to confer upon him, all the powers under section 164 of the Electricity Act, 2003, whi ch the telegraph authority possess under the Indian Telegraph Act, 1885 with respect to the placing of telegraph lines and posts for the purpose of a telegraph established or maintained by Government or to be so established or maintained for laying of elec tric lines under “Transmission system strengthening scheme for evacuation of Power from Solar energy zone in Rajasthan (8.1 GW) under Phase -II Part -B” for re -routed portion. The following overhead line is covered under this scheme: 1. Fatehgarh II PS -Bhadla II PS 765 kV D/C line (2nd) The approved re -routed portion of transmission line covered under the above scheme will pass through, over, around and between the following villages, towns and cities of Rajasthan State. Betina, Shyamsingh ki dhani, Madasar Pokharan Jaisalmer Now, after careful consideration, Ministry of Power, Government of India, under section 164 of the Electricity Act, 2003, confers all the powers to M/s Powergrid Bhadla Transmission Limited for laying above re -routed portion overhead transmission line, which telegraph authority possesses under the Indian Te legraph Act, 1885 with respect to placing of telegraph lines and posts for the purposes of a telegraph established or maintained, by Government or to be established or maintained subject to following terms and conditions for installing the above mentioned line, namely: i. The approval is granted for 25 years. ii. The Applicant shall have to seek the consent of the concerned authorities i.e., local bodies, Railways, National Highways, State Highways etc. before erection of proposed line. iii. The Applicant shall have to follow regulations/codes of the Appropriate Commission regarding transmission, O&M, open access, etc., framed under Electricity Act, 2003. iv. The Applicant shall operate the line after approval of Electrical Inspector / Chief Electrical Inspector of Central Government. v. The approval is subject to compliance of the requirement of the provisions of the Electricity Act, 2003 and the rules made there under by the applicant. vi. M/s Powergrid Bhadla Transmission Limited shall have to submit the requisite clearances to Central Electricity Authority after obtaining the same from concerned authorities like Civil Aviation, Defense etc., at the time of Electrical Inspection. vii. In case, the route of above overhead lines (or some portion of the route of above overhead line) fall s in the Great Indian Bustard (GIB) potential area (or priority area) marked in the map which is part of the order of the Hon’ble Supreme Court order dated 19.04.2021, in the petition No.838 of 2019 regarding GIB case, the applicant has to comply with the directions of the Hon’ble Supreme Court, with regard to undergrounding of the above overhead transmission line and/or fixing of bird diverters, as the case may be as per the Hon’ble Supreme Court Order dated 19.04.2021 and the directions of the technical c ommittee constituted by the Hon’ble Supreme Court in this regard.
