NOTIFICATION

G.S.R. 284(E).— In exercise of the powers conferred by clause (b) of sub-section (2) of section 156 of the
Indo-Tibetan Border Police Force Act, 1992 (35 of 1992), and in supersession of the Indo-Tibetan Border Police
Force, Judge Attorney General, Additional Judge Attorney General, Deputy Judge Attorney General and Judge
Attorney Group 'A' Posts Recruitment and Conditions of Service Rules, 2019, in so far as they relate to the post of
Judge Attorney General (Deputy Inspector General) and Deputy Judge Attorney General (Deputy Commandant),
except as respects things done or omitted to be done before such supersession, the Central Government hereby makes
the following rules regulating the method of recruitment to the posts of Judge Attorney General (Deputy Inspector
General) and Deputy Judge Attorney General (Deputy Commandant), Group 'A' posts in the Indo-Tibetan Border
Police Force, Ministry of Home Affairs, namely :-
1. Short title and commencement.— (1) These rules may be called the Ministry of Home Affairs, Indo-
Tibetan Border Police Force, Judge Attorney General (Deputy Inspector General) and Deputy Judge Attorney
General (Deputy Commandant) Group 'A' Posts, Recruitment Rules, 2024.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Application.- These rules shall apply to the posts specified in column (1) of the Schedule annexed to these
rules.
3. Number of posts, classification and level in pay matrix.— The number of said posts, their classification
and level in the pay matrix attached thereto, shall be as specified in columns (2) to (4) of the said Schedule.
4. Method of recruitment, age-limit, qualifications, etc.— The method of recruitment, age-limit,
qualifications and other matters relating to the said posts, shall be as specified in columns (5) to (13) of the aforesaid
Schedule.
5. Medical Fitness.- Notwithstanding anything contained in these rules, only those persons who are in medical
category SHAPE-I, as specified in Health Care System in Central Armed Police Forces, shall be eligible for
appointment and promotion including appointment by deputation or re-employment under the provisions of these
rules.
6. Seniority.-The seniority shall be determined in accordance with the following principles, namely :-
(i) an officer appointed in a substantive capacity shall be senior to an officer appointed in an
officiating capacity;
(ii) seniority of officers appointed to any post in a substantive capacity shall be determined in
accordance with the date of appointment to that post in a substantive capacity and where two or more
officers are appointed in a substantive capacity on the same date, their seniority shall be determined
in accordance with their seniority while holding such posts in an officiating capacity; and
(iii) no weightage is to be given for service rendered on adhoc or officiating basis for the purpose of
determination of seniority and seniority is to be counted from the date of substantive appointment.
7. Other conditions of Service.- The conditions of service of the Judge Attorney General (Deputy Inspector
General) and Deputy Judge Attorney General (Deputy Commandant), in respect of matters for which no provision or
insufficient provision has been made under these rules, shall, unless the Central Government, by an order in writing,
otherwise directs, be the same as are applicable from time to time to other officers of the Indo-Tibetan Border Police
Force holding the corresponding ranks or status.
8. Disqualification.- No person,-
(a) who has entered into or contracted a marriage with a person having a spouse living; or
(b) who, having a spouse living, has entered into or contracted a marriage with any person,
shall be eligible for appointment to the said posts :
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal
law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt
any person from the operation of this rule.
9. Power to relax.- Where the Central Government is of the opinion that it is necessary or expedient so to do, it
may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any
class or category of persons.
10. Ineligibility of non-citizens of India.- No person who is not a citizen of India shall, except with the prior
permission of the Central Government in writing, be appointed under these rules:
Provided that nothing contained in this rule shall debar the appointment or employment of a subject of Nepal
or Bhutan in the Force.
11. Superannuation.-(1) Every person appointed under these rules, shall retire from service in the afternoon of
the last day of the month in which they attain the age of sixty years:
Provided that the person whose date of birth is the first of a month shall retire from service on the afternoon
of the last day of the preceding month on attaining the age of superannuation i.e. sixty years.
(2) No person shall be granted extension in service beyond the prescribed age of retirement on
superannuation.
12. Saving.- Nothing in these rules shall affect reservations, relaxation of age-limit and other concessions
required to be provided for the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes, the Ex-
servicemen and other special categories of persons, in accordance with the orders issued by the Central Government
from time to time in this regard.

Promotion:
From amongst Additional Judge Attorney General (Commandant) of Indo-Tibetan Border Police Force in
level-13 (Rs. 123100-215900) of the pay matrix with two years regular service in the grade, with twenty years Group
'A' service and having minimum twenty years experience in dealing with legal matters or court cases and having
successfully completed the prescribed pre-promotional courses.
Note 1.— The requirement of twenty years of Group 'A' service, in the case of directly appointed Deputy Judge
Attorney General (Deputy Commandant) shall be fifteen years.
(since five years of notional service in Group 'A' is added to the service of such officers, on the date of their
appointment)
Note 2.— Where juniors who have completed their qualifying or eligibility service are being considered for
promotion, their seniors shall also be considered provided they are not short of the requisite qualifying or eligibility
service by more than half of such qualifying or eligibility service or two years, whichever is less, and have
successfully completed their probation period for promotion to the next higher grade along with their juniors who
have already completed such qualifying or eligibility service.
Deputation:
A person who-
(i) is a commissioned officer of the rank of Brigadier or equivalent in the Department of the Judge Advocate
General in Army or Navy or Air Force; or
(ii) is an officer of the rank of Deputy Inspector General or equivalent in level-13 A (Rs. 131100-216600) of
the pay matrix in legal branch of a Central Armed Police Force with minimum twenty years Group 'A'
regular service and having twenty years of experience in dealing with Force Law; or
(iii) is a member of the State Judicial Service for a period not less than twenty years and holding the post of
District Judge or an equivalent post; or
(iv) is an Additional Legal Advisor or equivalent in Level-13 (Rs. 123100-215900) in the pay matrix, in the
Legal Department of the Central Government or the State Government and having two years of regular
service in the grade with twenty years of Group 'A' regular service.
Note 1.- The period of deputation including the period of deputation in another ex-cadre post held immediately
preceding this appointment in the same or some other organisation or department of the Central Government shall
ordinarily not exceed five years.
Note 2.- The maximum age-limit for eligibility for deputation shall not be exceeding fifty-six years on the date of
receipt of application.
Note 3.- The departmental officers in the feeder category who are in the direct line of promotion shall not be eligible
for consideration for appointment on deputation. Similarly, deputationists shall not be eligible for consideration for
appointment by promotion.
