G.S.R. 295(E).—In exercise of the powers conferred by clauses (b) and (c) of sub-section (2) of section 141 of the Border Security Force Act, 1968 (47 of 1968) and in supersession of the Border Security Force, Water Wing, Group-'A' (Technical Staff), Recruitment Rules, 2012, except as respects things done or omitted to be done before such supersession, the Central Government hereby makes the following rules regulating the method of recruitment to the posts of Deputy Inspector General, Commandant, Second-in-Command, Deputy Commandant and Assistant Commandant in the Water Wing of the Border Security Force in the Ministry of the Home Affairs, namely:- 1. Short title and commencement.- (1) These rules may be called the Ministry of Home Affairs, Border Security Force, Water Wing, Group- 'A' (Technical Staff Cadre), Recruitment Rules, 2026. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Application.- These rules shall apply to the posts specified in column (1) of the Schedule annexed to these rules. 3. Number of post, classification and level in pay matrix.- The number of the said posts, their classification and level in the pay matrix attached thereto shall be as specified in columns (2) to (4) of the said Schedule. 4. Method of recruitment, age-limit and other qualifications, etc.- The method of recruitment, age-limit, qualifications and other matters relating to the said posts shall be as specified in columns (5) to (13) of the aforesaid Schedule. 5. Medical standard for promotion.- Notwithstanding anything contained in these rules, only those persons who are in medical category SHAPE-I, shall be eligible for promotion to the posts specified in column (1) of the Schedule. 6. Medical standard for direct recruits.- Only those persons who are medically and physically fit as per the guidelines issued by the Ministry of Home Affairs and as per the scheme prescribed by the Central Government from time to time shall be eligible for appointment to the posts specified in the column (1) of the said Schedule under the provision of these rules. 7. Physical standard for recruitment shall be applicable as per the Scheme specified by the Central Government from time to time in this regard. 8. Liability of service.- Any person appointed to any category of posts under these rules shall be liable to serve anywhere in India or abroad. 9. Maintenance of seniority lists.- Separate seniority lists for each of the ranks shall be maintained centrally at the Head Quarter of the Force whether in an officiating or substantive capacity by Border Security Force, Water Wing. 10. Seniority.- (1) All officers holding a higher rank whether in an officiating or substantive capacity shall be senior to the officers holding a lower rank. (2) In a particular rank, seniority of officers appointed to any post shall be determined in accordance with the order of selection for appointment to that post. (3) Subject to the provisions of sub-rule (2), inter-se-seniority amongst officers holding the same rank shall be as follows: - (a) seniority of officers promoted on the same day shall be determined in the order in which they are selected for promotion to that rank; (b) inter-se-seniority of direct recruits shall be arranged in the order of 'combined' merit which shall be determined after adding together the marks obtained by them in the competitive examination conducted by the Border Security Force and the Basic Professional Course of the Border Security Force in the ratio of 50:50: Provided that in the case of direct recruits, the date of appointment shall be the date of joining the venue as mentioned in the offer of appointment: Provided further that if two or more officers have secured equal marks in the combined merit, then, their order of merit shall be considered as per the order of their dates of birth: Provided also that the seniority in cases of delay in reporting for training after selection shall be as under:- (i) an offer of appointment issued by the Ministry or Department shall be valid for a period of four weeks from the date for joining mentioned in the offer of appointment after which the offer would lapse automatically; (ii) if, however, within the specified period of four weeks, a request is received from the candidate for extension of time and after due consideration by the Ministry of Home Affairs, he may be granted extension for a maximum period of two weeks in addition to the four weeks if facts and circumstances deem it necessary to do so and the candidates who join within a period of six weeks shall have their seniority fixed as per first proviso of clause (b) of sub-rule (3); (iii) after the grant of extension of two weeks as stated in clause (ii), if a candidate fails to report within he stipulated time (which shall not exceed a period of six weeks), the offer of appointment shall lapse automatically; (iv) an order of appointment which has lapsed, shall not ordinarily be revived, except in exceptional circumstances and on grounds of public interest to be recorded in writing, and only after obtaining the approval of the Ministry of Home Affairs; (v) where the offer of appointment is revived under clause (iv), the seniority of candidates concerned shall be fixed above the candidates of the next selection examination, but, in case, such candidate joins after any of the candidate of the next selection examination has joined, he shall be placed below the last of such candidate; (vi) Provided further that seniority in case of delay in reporting for training shall be fixed in accordance with the provisions of items (i), (ii) and (iii) of third proviso of clause (b) of sub-rule (3). 11. Disqualifications. - No person, - (a) who has entered into or contracted a marriage with a person having a spouse living; or (b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said posts: Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule. 12. Ineligibility of aliens. - No persons who is not a citizen of India shall, except with the prior permission of the Central Government in writing, be appointed or employed under these rules: Provided that nothing contained in these rules shall debar the appointment, enrolment or employment of a subject of Nepal or Bhutan under these rules. 13. Superannuation. - (1) The personnel appointed under these rules shall retire from service on the afternoon of the last day of the month in which they attains the age of sixty years or as per the order or instructions issued by the Central Government from time to time in this regard: Provided that an Officer whose date of birth is the first of a month shall retire from service on the afternoon of the last day of the preceding month on attaining the age of sixty years. (2) No person shall be granted extension in service beyond the prescribed age of retirement on superannuation as specified in sub-rule (1). 14. Powers to relax. – Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons. 15. Interpretation. - If any question relating to the interpretation of these rules arises, it shall be decided by the Central Government. 16. Saving. Nothing in these rules shall affect reservations, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Other Backward Class, ex- Servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard. Note 1: Where juniors who have completed their qualifying or eligibility service are considered for promotion their seniors shall also be considered provided they are not short of the requisite qualifying or eligibility service for more than half of such qualifying or eligibility service or two years, whichever is less, and have successfully completed probation period and other prescribed training or courses for promotion to the next higher grade along with their Juniors who have already completed such qualifying or eligibility service. Deputation (including short term contract) / absorption: Officers of Central Para Military Forces or the Central Government or the State Governments or the Union territories administration or the public sector undertaking having twenty years' of Group 'A' service; and (a) (i) holding analogous posts on regular basis; or (ii) with two years' regular service in level-13 (Rs.123100-215900) in the pay matrix; and (b) possessing the following educational qualifications and experience, namely:- (i) minimum three years' experience in Motor Transport or Water Wing or Special Repair Organisation or Central School of Motor Transport; or (ii) Degree in Mechanical Engineering or Automobile Engineering or Marine Engineering. Note 1: The departmental candidates in the feeder category who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation. Similarly, deputationists shall not be eligible for consideration for appointment by promotion. Note 2: The period of deputation including the period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organisation or department of the Central Government shall ordinarily not exceed five years. Note 3: The maximum age limit for appointment by deputation shall be not exceeding fifty-six years of age as on the last date of receipt of applications. Note 1: Where juniors who have completed their qualifying or eligibility service are considered for promotion their seniors shall also be considered provided they are not short of the requisite qualifying or eligibility service for more than half of such qualifying or eligibility service or two years, whichever is lesser, and have successfully completed their probation period and other prescribed training or courses for promotion to the next higher grade along with their Juniors who have already completed such qualifying or eligibility service. Deputation (including short term contract) / absorption: Officers of Central Para Military Forces or Central Government or State Governments or the Union territories administration or the public sector undertaking,- a) (i) holding analogous posts on regular basis; or (ii) with five years' regular service in level-10 in the pay matrix (Rs.56100-177500); and (b) possessing the following educational qualifications and experience, namely:- (i) having minimum three years' experience in Motor Transport or Water Wing or Special Repair Organisation or Central School of Motor Transport; or (ii) Bachelors Degree or three years Diploma in Mechanical or Automobile Engineering or Marine Engineering. Note 1: The eligibility service shall continue to be the same for persons holding the feeder posts on regular basis on the date of issue of amendment in Principal Recruitment Rules, 2012. Note 2: Where juniors who have completed their qualifying or eligibility service are considered for promotion their seniors shall also be considered provided they are not short of the requisite qualifying or eligibility service for more than half of such qualifying or eligibility service or two years, whichever is lesser, and have successfully completed their probation period and other prescribed training or courses for promotion to the next higher grade along with their Juniors who have already completed such qualifying or eligibility service. Deputation (including short term contract)/absorption: Officers of the Central Government or the State Governments or the Union territories administration or the public sector undertaking: (a) (i) holding analogous posts on regular basis; and (b) possessing the following educational qualifications and experience, namely: - (i) having minimum three years experience in Motor Transport or Water Wing or Special Repair Organisation or Central School of Motor Transport; or (ii) Degree in Mechanical Engineering or Automobile Engineering or Marine Engineering. Note 1: The departmental candidates in the feeder category who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation. Similarly, deputationists shall not be eligible for consideration for appointment by promotion. Note 2: The period of deputation including the period of deputation in another ex-cadre post held immediately preceding this appointment, in the same or some other Organisation or Department of the Central Government shall ordinarily not exceed three years. Note 3: The maximum age-limit for appointment by deputation (including short term contract) shall be not exceeding fifty-six years as on the closing date of receipt of application. Note 4: Absorption can be effected only in the case of officers from the Central Government or the State Governments or the Union territories administration.
