S.O. 5464(E), dated 18th December 2024, issued by the Ministry of Environment, Forest and Climate Change in exercise of powers under sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) and in pursuance of notification S.O. 1533(E) dated 14th September 2006, constitutes the Union territory Level Environment Impact Assessment Authority for Dadra and Nagar Haveli and Daman and Diu comprising Shri Manmohan Singh Negi (Chairman), Dr. Panchagnula Venkata Subba Rao (Member) and the Chief Conservator of Forest, Union territory of Dadra and Nagar Haveli and Daman and Diu (Member Secretary), each to hold office for three years from publication; it also constitutes the Union territory Level Expert Appraisal Committee comprising Shri Sujeetkumar Mariappa Dongre (Chairman), Shri Bidhu Bhushan Barman (Member) and the Conservator of Forest, Union territory of Dadra and Nagar Haveli and Daman and Diu (Member-Secretary), also for three-year terms; the notification prescribes decision-making by consensus or majority, conflict-of-interest and recusal requirements for members who provided consultancy or EIA services in the preceding five years, secretariat support by the Union territory administration, and payment of sitting fees, travelling and dearness allowances per Union territory administration rules. 8171 GI/202 4 (1) EXTRAORDINARY PART II —Section 3 —Sub-section ( ii) PUBLISHED BY AUTHORITY No. 5056 ] NEW DELHI, WEDNESDAY , DEC EMBER 18, 2024 /AGRAHAYANA 27, 194 6 CG-DL-E-18122024-259505 MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 18th December , 2024 S.O. 5464 (E).—In exercise of the powers conferred by sub -section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) and in pursuance of the notification of the Government of India, in the erstwhile Ministry of Environment and Forests, num ber S.O. 1533(E), dated the 14th September, 2006 (hereinafter referred to as the said notification), the Central Government hereby constitutes the Union territory Level Environment Impact Assessment Authority for the Union territory of Dadra and Nagar Have li and Daman and Diu (hereinafter referred to as the Authority) comprising of the following Members, namely: - (a) Shri Manmohan Singh Negi, Doon Officers Enclave, Wildlife Institute Road, Chandrabani, Post Office -Mohabbewala, Dehradun, Uttarakhand -248002 - Chairman; (b) Dr. Panchagnula Venkata Subba Rao, H.No.58, Saket Bhusattva, Gowdavalli Village, Hyderabad -501401 - Member; (c) Chief Conservator of Forest, Union territory of Dadra and Nagar Haveli and Daman and Diu - Member Secretary. 2. The Chairman and Members of the Authority, shall hold office for a period of three years from the date of publication of this notification in the Official Gazette. 3. The Authority shall exercise such powers and follow such procedures as specified in th e said notification. 4. The Authority shall take its decision on the recommendations of the Union territory Level Expert Appraisal Committee constituted under paragraph 6. 5. All decisions of the Authority shall be taken in a meeting and shall ordinarily be unanimous: Provided that, in case a decision is taken by majority, the details of views, for and against it, shall be clearly recorded in the minutes and a copy thereof sent to the Central Government. 6. The Central Government, in cons ultation with the Union territory of Dadra and Nagar Haveli and Daman and Diu, for the purpose of assisting the Authority, hereby constitutes the Union territory Level Expert Appraisal Committee for Union territory of Dadra and Nagar Haveli and Daman and D iu (hereinafter referred to as the Committee), comprising of the following Members, namely: - (a) Shri Sujeetkumar Mariappa Dongre, F2 Nadkarni Manor, Defence Colony, Phase II, Alto Porvorim, Bardez Goa -403521 - Chairman; (b) Shri Bidhu Bhushan Barman, 201, MS Block, Bapudham, SP Marg, Chanakyapuri, New Delhi -110021 - Member; (c) Conservator of Forest, Union territory of Dadra and Nagar Haveli and Daman and Diu . - Member - Secretary. 7. The Chairman and Members of the Committee, shall hold office for a period of three years from the date of publication of this notification in the Official Gazette. 8. The Committee shall exercise such powers and follow such procedures as specified in the said notification. 9. The Committee shall function on the principle of collective responsibility and the Chairman shall endeavour to reach a consensus in each case, and if consensus cannot be reached, the view of the majority shall prevail. 10. In order to avoid any conflict of interest, - (i) the Chairman and Members of the Authority and the Chairman and Member of the Committee shall, ⸺ (a) declare to which consulting organisation they have been associated with and also the project proponents; and (b) not u ndertake any consultation or associate with regard to preparation of Environment Impact Assessment and Environment Management Plan for project, which is to be decided by the Authority or to be appraised by the Committee during their tenure; and (ii) if the Chairman or any Member of the Authority or the Committee has provided consultancy services or conducted Environment Impact Assessment studies for any project proponent during the preceding five years, in that event they shall recuse themsel ves from the meetings of the Authority or the Committee in the process of appraisal of any project proposed by such proponents. 11. The administration of Union territory of Dadra and Nagar Haveli and Daman and Diu shall specify an agency to act as S ecretariat of the Authority and the Committee and the Secretariat shall provide financial and logistic support including accommodation, transportation and such other facilities in respect of their functions under the said notification. 12. The sittin g fees, travelling allowances and dearness allowances to the Chairman and Members of the Authority and the Committee, shall be paid in accordance with the provisions of relevant rules of the Union territory administration.
