Detailed Summary

This Order issued by the Ministry of Power, dated 17th August 2023 (S.O. 3686(E)), records that M/s ReNew Solar Power Private Limited, with its registered office at 138 Ansal Chambers-II, Bhikaji Cama Place, New Delhi-110066, applied for authorization under section 164 of the Electricity Act, 2003, to lay an electric line under the transmission scheme for providing connectivity to its 300MW Wind generation project in Gadag, Karnataka, having earlier obtained prior approval under section 68(1) of the Electricity Act, 2003, from the Central Electricity Authority, Ministry of Power, vide letter No. CEA-PS-11-21/1/2021-PSPA-I Division-Part(1)/294-295 dated 22nd November 2021; after the applicant published public notices in newspapers (Prajavani, Samyukta Karnataka, The Times of India, Deccan Herald on 17.05.2022; Rajasthan Patrika on 18.05.2022) and in the Weekly Gazette of India (02.07.2022 to 08.07.2022, with a Hindi corrigendum from 03.12.2022 to 09.12.2022) and submitted an affidavit dated 21st June 2023 confirming no objections were received within the two-month period, the Ministry of Power, exercising powers under section 164 of the Electricity Act, 2003, confers on M/s ReNew Solar Power Private Limited all powers possessed by a telegraph authority under the Indian Telegraph Act, 1885, for laying the overhead transmission line from the ReNew Solar Power Private Limited Pooling Sub-station (Hirehandigol Village, Gadag District, Karnataka) to the 400/220 kV Koppal PS (ISTS sub-station) via a 220 kV Single Circuit Transmission Line passing through villages in Gadag, Ron, Yalburga and Kukanura talukas of Gadag and Koppal districts, Karnataka; the approval is granted for 25 years, subject to conditions including obtaining consent of local bodies, Railways and Highways authorities, compliance with Appropriate Commission regulations, operation only after Electrical Inspector/Chief Electrical Inspector approval, submission of clearances from Civil Aviation and Defence authorities, and, where the route falls within the Great Indian Bustard (GIB) potential/priority zone, compliance with the Hon'ble Supreme Court's order dated 19th April 2021 in Petition No. 838 of 2019 regarding undergrounding or bird diverters; the Order (F. And whereas, CEA, Ministry of Power, Government of India vide its letter No. CEA -PS-11-21/1/2021 - PSPA -I Division - Part (1)/ 294 -295 dated 22/11/21 had granted prior approval under section 68(1) of the Electricity Act, 2003 to M/s Renew Solar Power Private Limited for the overhead line covered under the transmission scheme “Installati on of the dedicated overhead transmission line included in the transmission system for providing connectivity to “Renew Solar Power Private Limited” for its 300MW Wind generation project in Gadag, Karnatka”. M/s Renew Solar Power Private Limited ha d published notice for transmission scheme in local newspapers 17.05.2022 (Prajavani, Samyukta Karnataka, The Times of India, Deccan Herald), 18.05.2022 (Rajasthan Patrika) and in Weekly Gazette of India dated 02.07.2022 to 08.07.2022 and Hindi Corrigendum dated 03.12.2022 to 09.12.2022 for the general public to make observations/representations on the proposed transmission route within 2 Months from the date of publication. Subsequently, M/s ReNew Solar Power Private Limited has submitted an affidavit date d 21.06.2023 declaring that no objection, observation/representation has been received from public within 2 Months from the date of Publication of public notice for the above transmission scheme in newspaper/ gazette of India. And now the applicant has requested to confer upon him, all the powers under section 164 of the Electricity Act, 2003, which the telegraph authority possess under the Indian Telegraph Act, 1885 with respect to the placing of telegraph lines and posts for the purpose of a teleg raph established or maintained by Government or to be so established or maintained for laying of electric lines covered under the transmission scheme “Installation of the dedicated overhead transmission line included in the transmission system for providin g connectivity to “Renew Solar Power Private Limited” for its 300MW Wind generation project in Gadag, Karnatka”. The following overhead line is covered under this transmission scheme: Renew Solar Power Private Limited Pooling Sub -station (Hirehandigol Vil lage, Gadag District, Karnataka) - 400/220 kV Koppal PS (ISTS sub -station) 220 kV Single Circuit Transmission Line. The above overhead line included under the scheme will pass through, over, around and between the following villages, towns and cities of Karnataka : Name of villages Tehsil District Chikka Handigola, Hire Handigola, Shagoti, Betigeri, Chikkoppa, Hire Koppa, Nagasamudra, Kanginhal, Harlapura, Timmapura, Hombal, Huilgol, Kiratageri, Niralgi, Hirehandigol Gadag Gadag Belahoda, Nagaral Ron Hire Hanchehal, Binnala, Chikkenakoppa, Shidnekoppa, Sompura, Malekoppa, Mannapura, Batappanahalli, Mandalgeri, Itagi, Bannikoppa, Adavalli, Gorlukoppa, Lingapura, Rayana Hala, Benkankoppa, Ganesh Nagar Yalburga Koppal Talakalla, Talabal, Tadakal, Komala pura, Chittapura Kukanura Now, after careful consideration, Ministry of Power, Government of India, under section 164 of the Electricity Act, 2003, confers all the powers to M/s Renew Solar Power Private Limited for laying above overhead line, which tel egraph authority possesses under the Indian Telegraph Act, 1885 with respect to placing of telegraph lines and posts for the purposes of a telegraph established or maintained, by Government or to be established or maintained subject to following terms and conditions for installing the above mentioned lines, namely: i. The approval is granted for 25 years; ii. The Applicant shall have to seek the consent of the concerned authorities i.e. local bodies, Railways, National Highways, State Highways etc. before erection of proposed lines; iii. The Applicant shall have to follow regulations/codes of the Appropriate Commission regarding transmission, O&M, open access, etc., framed under Electricity Act, 2003. iv. The Applicant shall operate the lines after approval of Electrical In spector / Chief Electrical Inspector of Central Government. v. The approval is subject to compliance of the requirement of the provisions of the Electricity Act, 2003 and the rules made there under by the applicant. vi. M/s Renew Solar Power Private Limited shall have to submit the requisite clearances to Central Electricity Authority after obtaining the same from concerned authorities like Civil Aviation, Defence etc., at the time of Electrical Inspection. vii. In case, the route of above overhead lines (or some porti on of the route of above overhead line ) falls in the Great Indian Bustard (GIB) potential zone (or priority zone) marked in the map which is part of the order of the Hon’ble Supreme Court order dated 19.04.2021, in the petition No.838 of 2019 regarding Gr eat Indian Bustard (GIB) case, the applicant has to comply with the directions of the Hon’ble Supreme Court, with regard to undergrounding of the above overhead transmission line and / or fixing of bird diverters, as the case may be as per the Hon’ble Supr eme Court Order dated 19.04.2021 and the directions of the technical committee constituted by the Hon’ble Supreme Court in this regard.
