No. 18/1/BEE/DISCOM/2026.— In exercise of the powers conferred by clause (g) of sub-section (2) of section 58, read with clause (q) of sub-section (2) of section 13 of the Energy Conservation Act, 2001 (52 of 2001), (hereinafter referred to as the Act) and in supersession of the notification of the Bureau of Energy Efficiency (the Bureau) published vide number 18/1/BEE/DISCOM/2021, dated the 6th October, 2021 and its subsequesnt amendment vide dated the 28th October, 2022, except as respects things done or omitted to be done before such supersession, the Bureau, with the previous approval of the Central Government, hereby proposes to make the following draft regulations; The draft regulations are hereby published in the Gazette of India, Extraordinary, as required by sub-section (1) of section 58 of the said Act, for the information of all the persons likely to be affected thereby and inviting their suggestions and objections (if any); and the notice is hereby given that the said draft regulations shall be taken into consideration on or after the expiry of a period of thirty days from the date of their publication in the Gazette of India, Extraordinary; Objections or suggestions, if any, may be addressed to the Director-General, Bureau of Energy Efficiency, Ministry of Power, 4th Floor, Sewa Bhawan, R.K. Puram, Sector-1, New Delhi-110066, through post or email at [email protected]. Objections or suggestions which may be received from the persons with respect to the said draft regulations before the expiry of the period of thirty days specified in para 1 above, shall be taken into consideration by the Bureau of Energy Efficiency. Draft Regulations 1. Short title, application and commencement. (1) These regulations may be called the Bureau of Energy Efficiency (Energy Audit and Energy Accounting in Electricity Distribution Companies) Regulations, 2026. (2) These regulations shall apply to all electricity distribution companies specified as designated consumer. (3) They shall come into force on the date of their publication in the Official Gazette. 2. Conduct of annual energy audit. (1) Every electricity distribution company shall conduct an annual energy audit for every financial year through an accredited energy auditing firm. (2) The annual energy audit report shall be prepared in accordance with the indicative structure specified in Annexure-I and as per the format specified in Annexure-III. (3) The report shall be submitted to the Bureau and respective State Designated Agency within a period of four months from the expiry of the relevant financial year. (4) Where a new electricity distribution company is established after the commencement of these regulations, such electricity distribution company shall conduct its first annual energy audit on completion of the first financial year from the date of being notified as designated consumer. Explanation. If any entity created as a result of merger, demerger, slump sale, acquisition, change of control or any other corporate restructuring of, or involving, any existing electricity distribution company, such entity shall not be considered as a new electricity distribution company for the purposes of this sub-regulation. 3. Conduct of quarterly energy accounting. (1) Every electricity distribution company shall undertake quarterly energy accounting for each quarter of the financial year through its energy manger as per the format specified in Annexure-II. (2) the quarterly energy accounting report shall be submitted to the Bureau and respective State Designated Agency within forty-five days from the date of the closure of each quarter of the financial year. 4. Monitoring and Verification (1) The accredited energy auditing firm, while carrying out the energy audit shall verify, analyse and process the data with respect to- (i) consistency and accuracy of data; and (ii) reducing losses for the electricity distribution company. (2) The annual energy audit report shall identify the areas of energy leakage, wastage or inefficient use for initiating target based corrective action. (3) The electricity distribution company shall maintain all supporting records relating to quarterly energy accounting and annual energy audit and shall make such records available to the Bureau of Energy Efficiency, State Designated Agency or any authorised agency, as and when required.
