A prepaid label fee mechanism will be implemented on the Standards and Labeling web portal from April 1, 2027. Non-compliance, such as affixing counterfeit labels or failing check tests, may result in forfeiture of the label security deposit, suspension of model registration for one year, publication as a defaulter, de-registration on e-commerce platforms, and penalties under the Energy Conservation (Compliance Enforcement) Rules, 2025. The BEE or State designated agencies will conduct compliance verification through market surveillance and check testing, with provisions for second check tests and cost recovery from permittees.

L.-33004/99 The Gazette of India CG-DL-E-29122025-268894 EXTRAORDINARY PART III—Section 4 PUBLISHED BY AUTHORITY NEW DELHI, MONDAY, DECEMBER 29, 2025/PAUSHA 8, 1947 No. 836] THE BUREAU OF ENERGY EFFICIENCY NOTIFICATION New Delhi, the 26th December, 2025 No. 5506/BEE/S&L/AL/2025-26.—Whereas to establish a comprehensive framework governing the display of essential information on labels, including their particulars, manner and time-limits, to establish the process for applying for and granting permission to affix such labels, the following draft regulations were published for public consultation as required under sub-section (1) of section 58 of the Energy Conservation Act, 2001 (52 of 2001), inviting objections and suggestions from persons likely to be affected thereby, namely :- (a) the Bureau of Energy Efficiency (Appliance Labelling) Regulations, 2025, vide notification number 5506/BEE/S&L/AL/2025-26, dated the 10th July, 2025; (b) the Bureau of Energy Efficiency (Label Particulars) Regulations, 2025, vide notification number 5506/BEE/S&L/LP/2025-26, dated the 10th July, 2025; (c) the Bureau of Energy Efficiency (Labelling Fees) Regulations, 2025, vide notification number 5506/BEE/S&L/FR/2025-26, dated the 10th July, 2025; and (d) the Bureau of Energy Efficiency (Labelling Compliance) Regulations, 2025, vide notification number 5506/BEE/S&L/LC/2025-26, dated the 10th July, 2025; And whereas copies of the said draft regulations were made available to the public on 16th day of July, 2025; And whereas suggestions received with respect to the said draft regulations, have been taken into consideration. Now, therefore, in exercise of the powers conferred by clause (i) and (l) of sub-section (2) of section 58 of the Energy Conservation Act, 2001 (52 of 2001) and in supersession of the regulations specified in Schedule D of these regulations, except as respects things done or omitted to be done before such supersession, the Bureau, with the previous approval of the Central Government hereby makes the following regulations, namely :— REGULATIONS CHAPTER I General 1. Short title and commencement.— (1) These regulations may be called the Bureau of Energy Efficiency (Appliance Labeling and Compliance) Regulations, 2026. (2) These regulations shall come into force on the 1st day of January, 2026. 2. Definitions.—(1) In these regulations, unless the context otherwise requires,- (a) “Act" means the Energy Conservation Act, 2001 (52 of 2001); (b) “country of Origin” means country where the appliances or equipments have been manufactured, assembled or substantially processed, irrespective of the origin of some of its components. (c) “endorsement label” is a mark that guarantees efficiency of an appliance or equipment, by assuring that the appliance or equipment meet minimum energy performance standards specified in the rating system of the respective appliance or equipment and it informs prospective purchasers that the product is energy efficient for its category; (d) "label" means a printed matter, affixed to, or displayed on an appliance or equipment as specified in Schedule C of these regulations; (e) "label series" means the validity of the energy performance standard of the specified appliance or equipment; (f) "mandatory appliance or equipment” shall include appliance or equipment as specified under Schedule A of these regulations; (g) “permittee” means any person dealing in any appliance or equipment specified in the Schedule A and B of these regulations and to whom permission has been granted by the Bureau to affix the label on any appliance or equipment; (h) “person” means and includes any individual, association or body of persons, partnership firm, limited liability partnership and company, whether incorporated or not; (i) "Schedule” means schedules annexed to these regulations; (j) "star rating or star level” means the level of energy performance displayed on the label of the appliance or equipment based on their respective notification issued by the Central Government under clause (a) of Section 14 of the Act; (k) “State designated agency” means any agency designated under clause (d) of section 15 of the Act; (1) “voluntary appliance or equipment” shall include appliance or equipment specified under Schedule B of these regulations. (2) Words and expressions used herein and not defined but defined in the Act shall have the meaning assigned to them in the Act. CHAPTER II APPLIANCE LABELLING AND REGISTRATION 3. No label on any appliances or equipment as specified in Schedule A and Schedule B of these regulations shall be affixed without prior written permission from the Bureau. 4. Application for permission for label display. — (1) Each company that manufactures or sells or imports appliances or equipment as specified in Schedule A of these regulations shall be required to register with the Bureau and submit an application accompanied by a one-time application fee of five thousand rupees. (2) A company registered under sub-regulation (1) of this regulation shall be required to apply for registration for each and every equipment or appliance separately and shall submit an application accompanied by a label security deposit of three lakhs rupees per appliance or equipment : Provided that in the case of a small-scale industry, the label security deposit shall be fifty thousand rupees only. (3) A company registered in the sub-regulation (1) of this regulation, shall be required to register for each model of the appliance or equipments and shall submit an application accompanied by a model registration fee of five thousand rupees per application: Provided that a company that manufactures or imports or sells the appliances or equipments specified in Schedule B, may register their company and their appliances or equipments in accordance with the procedure provided in the Operational Manual. 5. Grant of permission.— (1) The Bureau shall complete the scrutiny of applications received under regulation 4 of these regulations as per the procedure laid down in the Operational Manual under regulation 16 of these regulations within a period not exceeding thirty working days from the date of the receipt of application: Provided that in cases where discrepancies are found in the applications received, the Bureau shall put these applications on hold and shall provide the applicants a period not exceeding sixty days to take suitable action, failing which the application shall be cancelled. (2) After being satisfied that the applications received under regulation 4 of these regulations comply with all the requirements specified in these regulations, the Bureau shall – (a) register the company and appliances or equipment; (b) grant permission to affix labels on permitted models for a period of three years; (c) make entries in the permittee register. (3) To renew permission for continuance to affix a label on the permitted model, each permittee shall, before the expiry of such permission previously granted, shall submit an application to the Bureau. The renewal application shall be processed within a period of thirty days from the date of receipt of the application: Provided that no fee shall be payable for the renewal or for continuance to affix a label on the permitted model, where the star ratings or endorsement label have been revised or for continuation of an existing star rating plan or endorsement label, as the case may be. (4) If the energy performance standards are revised during the validity of the permission period, the Bureau shall inform the revised energy performance standards to the permittee. Upon receipt of such information, the permittee shall submit a self-declaration form to the Bureau within a period of sixty days from the date of notification or before the period of validity mentioned in the label series, confirming compliance with the revised energy performance standards and the affixation of labels reflecting the revised standards. (5) The Bureau may revoke permissions granted for affixing labels, if the permittee fails to (a) comply with the specific energy performance standards fixed under the Act, with respect to the appliance or equipment under Schedule A and Schedule B ; (b) comply with the provisions of regulation 7, providing the manner of display of the label under these regulations; (c) pay the label fee as fixed under regulation 9 of these regulations; (d) affix labels only to permitted models; (e) ensure that the affixed labels are legible and well maintained; (f) provide an updated list of authorized sellers by 30th April of each year; (g) comply with other terms and conditions as may be specified in the Operational Manual on Standards and Labelling; (h) comply with the directions as specified in Chapter III of these regulations: Provided that no permission shall be revoked without giving the permittee a reasonable opportunity to be heard. 6. Particulars to be displayed on the label. — On every appliance or equipment as specified in Schedule A and Schedule B of these regulations, the following particulars shall be displayed on its label, namely:– (a) name of appliances or equipment; (b) name of brand; (c) model number; (d) energy performance parameter; (e) label series; (f) rated capacity/output (as applicable); (g) star level or endorsement; (h) country of origin; (i) the logo of the Bureau of Energy Efficiency; (j) any other appliances or equipment specific parameters as specified in Schedule C of these regulations. 7. Manner of display of label.– (1) There shall be a label along with a Quick Response code embedded with particulars required under regulation 6 of these regulations on every appliance or equipment as specified in Schedule A and Schedule B of these regulations, in accordance with the manner provided in Schedule C of these regulations, for that appliance or equipment. (2) The permittee shall ensure that the label is — (a) easily visible; and (b) appears on every registered unit or model at both online and offline point of sale. (3) The star label may be printed or pasted on the packaging box of every unit of the registered model. (4) The design, colour, size, content and placement of the label shall be as specified in Schedule C of these regulations. (5) The label along with Quick Response code shall be of self-adhesive material. (6) The markings required as per the provisions of Schedule C of these regulations shall be legible, indelible and durable. The Quick Response code shall be placed adjacent to the star label of the respective appliance and the dimensions of Quick Response code shall be such, as specified in Schedule C of these regulations on a minimum basis. 8. Time-limit for display of labels.— (1) A label, in accordance with the provisions of regulation 6 and 7, shall be displayed on every appliance or equipment as specified in Schedule A of these regulations within a period of six months from the date of commencement of these regulations while transitioning from voluntary to mandatory regime. (2) When the energy performance standards for an appliance or equipment shall be revised and become effective, the permittee shall — (a) stop production of appliances or equipment under the expired standards; and (b) undertake preparatory measures (dealer awareness and consumer education). (3) For a dummy display unit, a duplicate or replica of the star label corresponding to the particular model, shall be shown on the dummy units. The label shall clearly mark with the word “dummy” to indicate that it is not an original label. 9. Label Fee.— (1) For every mandatory appliance or equipment, the permittee shall pay to the Bureau a label fee as per Schedule A. (2) For every voluntary appliance or equipment, the permittee shall pay to the Bureau a label fee as per Schedule B. (3) The label fee specified under sub-regulations (1) and (2) above, shall be paid quarterly within a period of thirty days from the date of closure of each quarter of the financial year. (4) The permittee shall furnish to the Bureau a statement containing details of production of labelled appliances or equipment and the accrued labelling fee due for each quarter within a period of thirty days from the date of closure of each quarter of the financial year and a reconciliation of the production data which is duly certified by a Chartered Accountant, shall be submitted to the Bureau within a period of two months from the date of closure of each financial year: Provided that on failure to pay the label fee within the period specified under this regulation, the Bureau may recover the amount due with interest thereon at ten per cent. per annum from the label security deposit made under regulation 4 and if complete labelling fees are not recovered within a period of one year from the last date of submission, the Bureau may cancel all labels granted to the permittee and publish the name of the permittee in the newspapers as a defaulter. (5) The prepaid label fee shall be payable by the permittee at the time of Quick Response code requisition on the web portal of the Bureau of Energy Efficiency, namely, Standards and Labeling web portal, with effect from the 1st day of April, 2027 onwards: Provided that, in the absence of the above-mentioned prepaid label fee mechanism on the web portal of the Bureau, sub-regulations (3) and (4) of these regulations shall remain in force. 10. Refund of label security deposit.— (1) Subject to the provisions of regulation 4, a permittee shall be entitled to a refund of the interest free label security deposit upon ceasing the manufacturing of the mandatory or voluntary appliance or equipment, as the case may be. (2) The Bureau shall refund the security deposit to the permittee within a period of thirty days from the date on which the permittee submits a written intimation of such permanent cessation of manufacture to the Bureau, as the case may be. 11. Mode of Payment.-All payments shall be made through an acceptable payment mode which includes payment through electronic mode in addition to already existing modes of payment. CHAPTER III LABELLING COMPLIANCE AND ENFORCEMENT 12. Compliance verification by the Bureau.— The Bureau or State designated agency, shall undertake verification at such intervals as may be deemed necessary to ensure that any appliance or equipment complies with the requirements as specified under these regulations through any of the following manners, namely :- (a) label verification as specified under regulation 13 of these regulations; (b) check testing as specified under regulation 14 of these regulations; and (c) any other reasonable methods deemed necessary by the Bureau to verify the compliance. 13. Label verification.— (1) The Bureau or State designated agency, shall undertake verification of the particulars displayed on the label affixed on any appliance or equipment by conducting market surveillance either through offline or online mode including through e-commerce platforms. (2) For any non-compliances, including but not limited to affixing or selling appliances or equipment with counterfeit label or without label, altering genuine labels, replacing genuine labels with unauthorised labels and creating labels that mimic design, layout or content of genuine labels issued by the Bureau, detected by the Bureau or the State designated agency with respect to any appliance or equipment, the Bureau or State designated agency shall issue a show-cause notice to the permittee concerned, informing him regarding the identified non-compliance and seeking an explanation in writing within a period of thirty days of issuance of the show-cause notice. (3) The Bureau or State designated agency shall also take necessary action in accordance with the provisions of the Act, or any other relevant laws, rules, regulations, or notifications applicable within the jurisdiction of India. (4) In case the permittee does not submit an explanation to the satisfaction of the Bureau, within the prescribed time- limit, the Bureau shall undertake the following actions against the said permittee, namely:- (a) forfeit the label security deposit; (b) suspend the model registration under the appliance or equipment category for a period of one year and display the suspension details on official website of the Bureau; and (c) the Bureau or State designated agency shall initiate action to impose a penalty as per the Energy Conservation (Compliance Enforcement) Rules, 2025. (5) In the event of any non-compliance, found in online mode including at any e-commerce platforms, the Bureau shall direct the e-commerce platform to de-register the specified model of appliance or equipment. (6) The Bureau shall specify the detailed procedure to be followed in the Operation Manual on Standards and Labeling program under regulation 16 of these regulations. 14. Check testing.– (1) The Bureau or State designated agency may either suo motu or on receipt of a complaint, as the case may be, carry out check testing to ensure that the appliances or equipments, conforms to the energy performance standards and norms as specified under clause (a) of section 14 of the Act and the appliance or equipment specified under schedule B. (2) For suo moto verification, the Bureau or State designated agency may procure a sample of the equipment from the manufacturing facilities, open market, online platforms or any other means, as it deems fit. (3) The Bureau or State designated agency may verify the energy performance of models through check testing conducted at identified laboratories for such purpose or by directly obtaining and relying upon the energy performance results of testing of the identified appliances or equipment undertaken by the Bureau of Indian Standards; (4) In the event the first check test fails, the Bureau or State designated agency shall conduct a second check test with twice the quantity of the same model used in the first test in two different identified laboratories. The Bureau or State designated agency shall intimate the permittee at least fifteen days prior to the scheduled date to witness the second check test : Provided that in case the second check test is conducted, the permittee shall be solely liable to bear all costs and expenses incurred during the conduct of the second check test. In case any one or both samples collected for a second check test fail, it will be termed as failure in check testing : Provided further that if the permittee fails to witness the check test, the test results shall be deemed to be valid and binding, and action shall be initiated accordingly: Provided also that in case the two samples for second check test are not available in the market including e-commerce platforms, and all efforts to trace the samples fail, then result of check testing of the first sample shall be treated as final and shall be binding on the permittee. (5) For check testing initiated upon a complaint received under sub-regulation (1), the complainant shall deposit all cost and expenses relating to testing, with the Bureau, within such time, as may be determined by the Bureau, and if the sample drawn under check testing fails, all cost and expenses, shall be reimbursed by the permittee to the Bureau and the Bureau shall refund the aforesaid expenses to the complainant and where the sample passes the check test, then, the expenses deposited by the complainant shall stand forfeited. 15. Failure in check testing.— (1) If the appliance or equipment fails in the check test, conducted as per the provisions of regulation 14, the Bureau or State designated agency shall — (a) publish within a period of two months from the date of intimation of failure of check test, for the benefit of the consumers, the details including but not limited to the name of the permittee, brand name, model name or number, logo and other specifications, in any national daily newspaper, electronic or social media or on the website of the Bureau or any other manner as it deems fit. The Bureau shall recover the cost of publishing such advertisement from the permittee limited to the amount of security deposit as specified in regulation 4: Provided that in case the permittee fails to deposit the expenses towards the cost of publishing advertisement mentioned above within a period of one month, the Bureau shall suspend the registration of the appliance or equipment category until such cost is deposited ; (b) direct the permittee, under intimation to all State designated agencies, within a period of two months from the date of intimation of failure of the check test, to— (i) withdraw all the stocks from the market to comply with the directions of the Bureau; (ii) change the particulars displayed on all advertising materials; (iii) correct the star level displayed on the label of the equipment; (iv) take corrective action to remove the defects and deficiencies or non- compliances found during check testing from the existing and new stock of the concerned appliance or equipment; (c) direct the permittee to send an action taken report to the Bureau in the format as provided under the Operational Manual within a period of ten days of the conclusion of the period of two months from the date of issuance of aforesaid intimation; (d) initiate action to impose a penalty as per the Energy Conservation (Compliance Enforcement) Rules, 2025. (2) In the event, the permittee fails to comply with the directions issued under sub-regulation (1) of this regulation, the Bureau shall pass an order to withdraw the permission to affix the label granted to the permittee for said appliance or equipment category under regulation 4 for a minimum period of three months or till the compliance has been made and also send a copy of such order to all the State designated agencies. 16. Operational Manual on Standards and Labelling Programme.–The Bureau shall publish on its website an Operational Manual consistent with the provisions of the Act and rules made thereunder for the implementation of the Standards and Labelling Programme. The said Operational Manual shall, inter- alia, include the following, namely :— (a) procedure for undertaking the market surveillance activity or any other similar activity by the Bureau or State designated agency; (b) procedure for undertaking check testing; and (c) required formats. A. Room Air Conditioners (Fixed Speed/ Variable Speed/Cassette, Floor Standing Tower, Ceiling, Corner AC) (i) Dimension Note: - One ton of refrigeration is equivalent to 3517 watts. The calculated tonnage shall be rounded off up to two decimal places. (ii) Colour Scheme (iii) Label material : The Label shall be of self – adhesive material. The markings required by the regulations shall be legible, indelible and durable. (iv) Placement of Label: The Label shall be firmly affixed at the front side of each appliance and should be easily visible and the Permittee shall ensure that the Label appears on every unit of the registered model at point of sale and the Label may also be printed or pasted on the packaging box of the every unit of the registered model. B. Light Commercial Air Conditioners (i) Dimension (ii) Colour Scheme (iii) Label material : The Label shall be of self – adhesive material. Tubular Fluorescent Lamps (i) Dimension (a) On packaging (b) On appliance or equipment (ii) Colour Scheme (iii) Label material : The Label shall be of self – adhesive material. The markings required by the regulations shall be legible, indelible and durable. (iv.) Placement of Label: The Label shall be firmly affixed at the front side of each appliance and should be easily visible and the Permittee shall ensure that the Label appears on every unit of the registered model at point of sale and the Label shall also be printed or pasted on the packaging box of the every unit of the registered model. 7. Self-Ballasted LED Lamps (i) Dimension: (a) On packaging (b) On appliance Note: The QR code shall be affixed on LED lamps of above 5W ratings. (ii) Colour Scheme (iii) Label material : The Label shall be of self – adhesive material. The markings required by the regulations shall be legible, indelible and durable. (iv) Placement of Label: The Label shall be firmly affixed at the front side of each appliance and should be easily visible and the Permittee shall ensure that the Label appears on every unit of the registered model at point of sale and the Label shall also be printed or pasted on the packaging box of the every unit of the registered model. 8. (iv) Placement of Label: The Label shall be firmly affixed at the top view of each appliance and should be easily visible, and the Permittee shall ensure that the Label appears on every unit of the registered model at point of sale and the Label shall also be printed or pasted on the packaging box of the every unit of the registered model. 12. Grid connected Solar Inverter (i) Dimension (ii) Colour Scheme (iii) Label material : The Label shall be of self-adhesive material. The markings required by the regulations shall be legible, indelible and durable. (iv) Placement of Label: The Label shall be firmly affixed at the front side of each appliance and should be easily visible and the Permittee shall ensure that the Label appears on every unit of the registered model at point of sale and the Label may also be printed or pasted on the packaging box of the every unit of the registered model. 13.
