The Ministry of Environment, Forest and Climate Change issued S.O. 637(E) dated 12th February 2024, in exercise of powers under sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) and pursuant to notification S.O. 1533(E) dated 14th September 2006, constituting the Union Territory of Jammu and Kashmir Environment Impact Assessment Authority with Shri Lal Chand as Chairman, Shri Nazir Ahmed as Member, and the Director, Ecology, Environment and Remote Sensing as Member Secretary, each holding office for three years from the date of publication; it also constitutes, in consultation with the Government of Jammu and Kashmir, the Union Territory of Jammu and Kashmir Expert Appraisal Committee chaired by Shri Arun Kumar Tikku with thirteen further named members and a Scientist/Junior Scientist as Member Secretary, also for a three-year term; the notification sets out conflict-of-interest disclosure and recusal requirements for members regarding prior consultancy or Environment Impact Assessment work, collective-responsibility decision-making with majority vote on the Committee, secretariat support to be arranged by the Government of Jammu and Kashmir, and sitting fees, travelling and dearness allowances payable per Union Territory rules; the notification is issued under F. L.-33004/99 The Gazette of India CG-DL-E-13022024-252049 EXTRAORDINARY PART II-Section 3-Sub-section (ii) PUBLISHED BY AUTHORITY No. 606] NEW DELHI, TUESDAY, FEBRUARY 13, 2024/MAGHA 24, 1945 MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 12th February, 2024 S.O. 637(E).—In exercise of the powers conferred by sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) and in pursuance of the notification of the Government of India, in the erstwhile Ministry of Environment and Forests, number S.O. 1533(E), dated the 14th September, 2006 (hereinafter referred to as the said notification), the Central Government hereby constitutes the Union territory of Jammu and Kashmir Environment Impact Assessment Authority (hereinafter referred to as the Authority) comprising of the following persons, namely: - (a) Shri Lal Chand, former Member Jammu and Kashmir Public Service Commission, R/O Khearian, P/O Gole Gujral, ward No. 32, Jammu-180002 -Chairman; (b) Shri Nazir Ahmed, former State Information Commissioner, Jammu and Kashmir State Information Commission, R/O H. No. 12, Jeelanabad, Lane 1, Batpora, Srinagar, Jammu and Kashmir -190006 -Member; (c) Director, Ecology, Environment and Remote Sensing. -Member Secretary. 2. The Chairman and Members of the Authority shall hold office for a period of three years from the date of publication of this notification in the Official Gazette. 3. The Authority shall exercise the powers and follow the procedures specified in the said notification. 4. The Authority shall take its decision on the recommendations of the Union territory Expert Appraisal Committee constituted under paragraph 5 for the Union territory of Jammu and Kashmir. 5. The Central Government, in consultation with the Government of Jammu and Kashmir, for the purpose of assisting the Authority, hereby constitutes the Union territory of Jammu and Kashmir Expert Appraisal Committee (hereinafter referred to as the Committee), comprising of the following persons, namely:- (a) Shri Arun Kumar Tikku, Retd. The Chairman and Members of the Committee, shall hold office for a period of three years from the date of publication of this notification in the Official Gazette. 7. In order to avoid any conflict of interest, - (i) the Chairman and Members of the Authority, and the Committee shall, - (a) declare to which consulting organisation they have been associated with and also the project proponents; (b) not undertake any consultation or associate with regard to preparation of Environment Impact Assessment and Environment Management Plan for project, which is to be decided by the Authority or to be appraised by the Committee during their tenure; and (ii) in the preceding five years, if the Chairman or any Member of the Committee has provided consultancy services or conducted Environment Impact Assessment studies for any project proponent, they shall recuse themselves from the meetings of the Committee from the process of appraisal of any project proposed by such proponents. 8. The Committee shall exercise the powers and follow the procedures specified in the said notification. 9. The Committee shall function on the principle of collective responsibility and the Chairman shall endeavour to reach consensus in each case, and if they fail to reach consensus, the view of the majority shall prevail. 10. The Government of Jammu and Kashmir shall specify an agency to act as secretariat of the Authority and the Committee and the secretariat shall provide financial and logistic support including accommodation, transportation and such other facilities in respect of their functions under the said notification. 11. The sitting fee, travelling allowance and dearness allowance to the Chairman and Members of the Authority and the Committee, shall be paid in accordance with the provisions of relevant rules of the Union territory of Jammu and Kashmir.
