By notification S.O. 5339(E) dated 10th December 2024, the Ministry of Environment, Forest and Climate Change, exercising powers under sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) and in pursuance of notification S.O. 1533(E) dated 14th September 2006, constituted the State Level Environment Impact Assessment Authority, Rajasthan comprising Shri Munish Kumar Garg (Chairman), Shri Manphool Singh (Member) and the Secretary, Department of Environment, Government of Rajasthan (Member Secretary), which decides on the basis of recommendations of the State Level Expert Appraisal Committees; the Central Government, in consultation with the State Government of Rajasthan, also constituted four State Level Expert Appraisal Committees (Committees 1 to 4) for Rajasthan with named chairmen, members and member secretaries (Additional/Senior Environmental Engineer, Rajasthan State Pollution Control Board), each assigned jurisdiction over specified districts (Committee-1: Kota, Bundi, Jhalawar, Baran, Karauli; Committee-2: Dholpur, Bharatpur, Sawai Madhopur, Dausa, Alwar, Jaipur, Jhunjhunu, Tonk, Sikar, Ajmer, Nagaur; Committee-3: Jodhpur, Sirohi, Pali, Barmer, Jalore, Bikaner, Jaisalmer, Shri Ganganagar, Churu, Hanumangarh; Committee-4: Udaipur, Banswara, Pratapgarh, Dungarpur, Rajsamand, Chittorgarh, Bhilwara); the Authority and Committees hold office for three years, must avoid conflicts of interest by recusal from projects of prior consultancy clients, and the State Government of Rajasthan is to provide secretariat, financial and logistic support, with sitting fees and allowances paid per State Government rules; the notification is signed by Rajat Agarwal, Joint Secretary under F. In exercise of the powers conferred by sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) and in pursuance of the notification of the Government of India in the erstwhile Ministry of Environment and Forests, number S.O. 1533(E), dated the 14th September, 2006 (hereinafter referred to as the said notification), the Central Government hereby constitutes the State Level Environment Impact Assessment Authority, Rajasthan (hereinafter referred to as the Authority) comprising of the following persons, namely:— (i) Shri Munish Kumar Garg, -Chairman; B-1/528, Chitrakoot, Vaishali Nagar, Jaipur-302021(Rajasthan). Department of Environment, Government of Rajasthan, Jaipur (Rajasthan). 2. The Authority shall take its decision on the recommendations of the State Level Expert Appraisal Committees constituted under paragraphs 5 of the said notification. 3. All decisions of the Authority shall be taken in a meeting and shall ordinarily be unanimous: Provided that, in case a decision is taken by majority, the details of views, for and against it, shall be clearly recorded in the minutes and a copy thereof sent to the Central Government. 4. The Central Government, in consultation with the State Government of Rajasthan, for the purpose of assisting the Authority, hereby constitutes following State Level Expert Appraisal Committees for the State of Rajasthan (hereinafter referred to as the Committees) comprising of the following persons, namely:— State Level Expert Appraisal Committee-1 (i) Shri Ajay Kumar Gupta, -Chairman; B-158 Janta Colony, Jaipur (Rajasthan). The Chairman and Members of the Authority, and the Committees, shall hold office for a period of three years from the date of publication of this notification in the Official Gazette. 7. The Authority and the Committees shall exercise such powers and follow such procedures as specified in the said notification. 8. In order to avoid any conflict of interest,— (i) the Chairman and Members of the Authority, and the Committees shall,— (a) declare to which consulting organisation they have been associated with and also the project proponents; (b) not undertake any consultation or associate with regard to preparation of Environment Impact Assessment and Environment Management Plan for project, which is to be decided by the Authority, or to be appraised by the Committees during their tenure; and (ii) in the preceding five years, if the Chairman or any Member of the Authority, and the Committees have provided consultancy services or conducted Environment Impact Assessment studies for any project proponent, in that event they shall recuse themselves from the meetings of the Authority, or the Committees as the case may be, from the process of appraisal of any project proposed by such proponents. 9. The Committees shall function on the principle of collective responsibility and the Chairman shall endeavour to reach a consensus in each case, and if cannot be reached consensus, the views of the majority shall prevail. 10. The State Government of Rajasthan shall specify an agency to act as Secretariat of the Authority and the Committees which shall provide financial and logistic support, including accommodation, transportation and such other facilities in respect of their functions under the said notification. 11. The sitting fees, travelling allowances and dearness allowances to the Chairman and Members of the Authority and the Committees, shall be paid in accordance with the provisions of relevant rules of the State Government of Rajasthan.
