The new Regulation 8 establishes a comprehensive system for ensuring compliance, including technical and safety audits throughout the design, pre-construction, construction, commissioning, and operation stages. It mandates the submission of planned project details, such as the Detailed Feasibility Report (DFR), layout, PESO approval, and Environmental Clearance, to the Board at least one month prior to commencing construction for greenfield projects and specific brownfield expansions. The Board will monitor compliance either directly or through an accredited third party. For any default, deviation, or shortfall, entities are liable to civil penalties under Section 28 of the PNGRB Act, 2006, and/or suspension or termination of operations. The procedure includes issuing a notice for remedial action, with no punitive action if the entity rectifies the default to the Board's satisfaction. Failure to undertake remedial action can result in a civil penalty of up to one crore rupees for each contravention, an additional penalty of up to ten lakh rupees per day for continuing failure, and potential suspension or termination of operations after providing an opportunity to be heard. If an entity fails to comply with Board directions, action may be taken as prescribed under Chapter IX of the Act. A proviso allows for immediate suspension of operations in cases posing imminent danger to public safety or deemed necessary in public interest or State security, with the opportunity of being heard deferred to a subsequent stage.

No. PNGRB/Tech/18-penalty-T4SReg./(9)/2024/(E-5488)/12—In exercise of the powers conferred by section 61 of the Petroleum and Natural Gas Regulatory Board Act, 2006 (19 of 2006), the Petroleum and Natural Gas Regulatory Board hereby makes the following Regulations further to amend the Petroleum and Natural Gas Regulatory Board (Technical Standards and Specifications including Safety Standards for dispensing of Automotive Fuels) Regulations, 2018, namely: 1. Short title and commencement: (1) These regulations may be called the Petroleum and Natural Gas Regulatory Board (Technical Standards and Specifications including Safety Standards for dispensing of Automotive Fuels) Amendment Regulations, 2025. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Petroleum and Natural Gas Regulatory Board (Technical Standards and Specifications including Safety Standards for dispensing of Automotive Fuels) Regulations, 2018, - (a) In Regulation 8, under heading "Default and Consequences.", all the existing clauses shall be omitted, and the following shall be substituted namely: - “ (1) There shall be an established comprehensive system to ensure compliance with the provisions of these regulations, encompassing the conduct of technical and safety audits throughout the stages of design, pre- construction, construction, commissioning, and operation, and also on an ongoing basis, as periodically specified. Details of any planned project along with Detailed Feasibility Report (DFR), layout, PESO approval and Environmental Clearance etc. as may be applicable, shall be submitted to Board at least one month prior to commencing the construction. (2) The Board shall monitor the compliance with Technical Standards and Specifications, including Safety Standards, either directly or through an accredited third party via separate regulations on third-party conformity assessment. (3) For the purpose of these Regulations, in event of any default or deviation or shortfall, the entity shall be liable to face the imposition of civil penalty as per Section 28 of the PNGRB Act, 2006 and/or suspension/termination of operation, as per following procedure: (a) The Board shall issue a notice to the entity, allowing it a reasonable time period to fulfil its obligations under the regulations; (b) No punitive action shall be taken in case remedial action is taken by the entity, to the satisfaction of the Board, within the time period specified by the Board; (c) In case the entity fails to undertake remedial action within such time period, the Board may, after giving such entity an opportunity of being heard, by order in writing, direct that, without prejudice to any other penalty which the entity may be liable for, such entity shall pay, by way of civil penalty, an amount which shall not exceed one crore rupees for each contravention, and in case of a continuing failure, additional penalty which may extend to ten lakh rupees for every day. In addition, the Board, if it deems appropriate, may direct for suspension or termination of operations of the said entity. (d) If the entity fails to comply with the directions passed by the Board, as provided in clause (c), the Board may take appropriate action as prescribed for offences and punishment under Chapter IX of the Act. Provided that, notwithstanding anything contained in clauses (a) to (d) of sub-regulation (3), in cases (i) where the violation on the part of the entity poses an imminent danger to public safety or (ii) where the Board determines, in public interest or in the interest of State security, that it is so required, the Board may, apart from requiring the entity to take immediate remedial action, also direct for immediate suspension of operations of the said entity and in such cases, an opportunity of being heard may be deferred and afforded subsequently to the entity by the Board. Note 1: Planned projects shall include all greenfield projects and, in the case of brownfield projects, shall encompass any addition to storage, handling, or processing capacity, increase in manpower, or increase in risk level of any installation/facility. ” ANJAN KUMAR MISHRA, Secy.
