A new clause 20DA is inserted, empowering the Central Government to notify specifications for nano fertilizers, valid for a period not exceeding five years, conforming to general specifications in Schedule VII. It prohibits manufacturing nano fertilizers unless they conform to these standards. Manufacturers seeking approval must apply in a new Form G-5 in duplicate to the Controller of Fertiliser, including reports from State Agriculture Universities or the Indian Council of Agricultural Research on multi-locational and multi-crop trials (at least ten crops, minimum two seasons, three agro-climatic zones) and biosafety, biotoxicity, and quality trial reports from NABL accredited or GLP laboratories as per Department of Bio-Technology guidelines. Manufacturers must inform the Central Government and the Director (Agriculture) of the concerned State Government about distribution plans, ensure farmer training on safety, print necessary precautions on labels or leaflets, provide a Package of Practice (75% Recommended Dose of Fertilizer (RDF) with 25% Nano Fertilizer dose), and submit a test report of each batch from NABL accredited laboratories before distribution. Batch numbers must be printed on containers or labels. Notifications will be product-wise, not company-wise, based on general specifications, and extensions beyond five years will be granted based on Indian Council of Agricultural Research research and development of Package of Practice for nano fertilizers. For sale permission in a State under clause 8, companies must provide a report from NABL accredited laboratories on biosafety, biotoxicity, and quality trials as per Department of Bio-Technology guidelines. A new Form G-5 is introduced for applications for inclusion of nano fertilizers. L.-33004/99 The Gazette of India CG-DL-E-11032026-270825 EXTRAORDINARY PART II-Section 3-Sub-section (ii) PUBLISHED BY AUTHORITY No. 1190] NEW DELHI, TUESDAY, MARCH 10, 2026/PHALGUNA 19, 1947 MINISTRY OF AGRICULTURE AND FARMERS WELFARE (Department of Agriculture and Farmers Welfare) NOTIFICATION New Delhi, the 9th March, 2026 S.O. 1242(E).— In exercise of the powers conferred by section 3 of the Essential Commodities Act, 1955 (10 of 1955), the Central Government hereby makes the following Order further to amend the Fertiliser (Inorganic, Organic or Mixed) (Control) Order, 1985, namely: - 1. (1) This Order may be called the Fertiliser (Inorganic, Organic or Mixed) (Control) (Second) Amendment Order, 2026. (2) It shall come into force on the date of their publication in the Official Gazette 2. In the Fertilizer (Inorganic, Organic or Mixed) (Control) Order,1985 (hereinafter referred to as the said order, (i) after sub-clause (2) of clause 8, the following proviso shall be inserted, namely,- "Provided that in case of nano fertilizers, the manufacturer along with form A-1 for obtaining the Authorization letter submit the Bio toxicity or safety data, conducted by the Good Laboratory Practices (GLP) laboratories or National Accreditation Board for Testing and Calibration Laboratories (NABL) as per the guidelines issued by the Department of Bio Technology, to the notified authority of the concerned State Government" (ii) in clause 20 D,- (a) in sub-clause (1), for the words “three years” the words “ two years” shall be substituted; (b) in sub-clause (3), for the words " and multi crops", the bracket and words "(trials shall be conducted for at least for two crops, each of which shall be of minimum one season in three different agro-climatic Zones), shall be inserted; (c) after sub-clause (8), the following sub-clauses shall be inserted, namely:- "(9) Every manufacturer shall give Package of Practice on the leaflet of the product for the farmers; (10) Every manufacturer shall request for notification for a further period of five years under clause 20 DA within a period of two years of said notification issued under sub-clause (1) along with post notification trials reports of at least ten crops, two seasons in three different agroclimatic zones from the Indian Council of Agricultural Research or State Agricultural Universities failing which the notification issued under clause 20D (1) ceases to be operative and no further extension shall be granted."; (d) after clause 20 D, the following clause shall be inserted, namely:- "20 DA (1) Notwithstanding anything contained in this order, the Central Government may, by order published in the Official Gazette, notify specifications, valid for a period not exceeding five years, conforming to the general specifications as specified in Schedule VII, in respect of nano fertilizers to be manufactured by such manufacturing unit, as may be specified therein. (2) No person shall manufacture any nano fertilizer unless such fertilizer conforms to the standard set out in the order issued under sub-clause (1). (3) Every person, desirous of obtaining approval of any nano fertilizer shall make an application in Form-G-5 in duplicate to the Controller of fertiliser along with a report of the State Agriculture University or of the Indian Council of Agricultural Research on multi-locational and multi crop trials shall be conducted for at least ten crops, shall be of minimum two seasons in three different agro-climatic zone and also a report from any of the NABL accredited laboratories or Good Laboratory Practices laboratories on biosafety, biotoxicity and quality trial as per the guidelines issued by the Department of Bio-Technology. (4) Every manufacturer shall inform the Central Government and the Director (Agriculture) of the concerned State Government as to where it intends to make said fertilizer available to the farmers. (5) Every manufacturer shall ensure training to farmers on the safety aspects of the use of nano fertilizer. (6) Every manufacturer shall print necessary precautions on the label of the container of the nano fertilizer or on a separate leaflet to be packed with the nano fertilizer. (7) Every manufacturer shall give Package of Practice on the leaflet of the product for the farmers. Package of Practice must contain the crop wise basal dose of 75% RDF (Recommended Dose of Fertilizer) with 25% of dose of Nano Fertilizer as per trials positive outcome. (8) Every manufacturer shall provide to the Central Government a test report of each batch from any of the NABL accredited Laboratories before its distribution or dispatch of nano fertilizer. (9) Every manufacturer shall print the batch number on the container or shall have the label securely affixed on the container having weight less than 5 litre. Provided that the notification shall be made product wise and not company wise based on general specification provided by the company; Provided further that extension beyond five years, shall be given based on outcome of Indian Council of Agricultural Research research on nano fertilizers and development of Package of Practice for nano fertilizers. (10) If any company intends to get sale permission in a State under clause 8 of the said order, it shall apply to the state with a report from any of the NABL accredited laboratories on biosafety, biotoxicity and quality trial as per the guidelines issued by the Department of Bio-Technology. (iv).
