S.O. 148(E), dated 11th January 2024, issued by the Ministry of Home Affairs, recites that the Central Government had earlier declared Tehreek-e-Hurriyat, Jammu and Kashmir (TeH) an unlawful association under sub-section (1) and the proviso to sub-section (3) of section 3 of the Unlawful Activities (Prevention) Act, 1967 (37 of 1967) vide notification S.O. 5532(E) dated 31st December 2023; now, in exercise of powers under section 42 of the said Act, the Central Government directs that all powers exercisable by it under sections 7 and 8 of the Act in relation to that unlawful association shall also be exercised by the State Governments and the Union Territory Administration. L.-33004/99 The Gazette of India CG-DL-E-11012024-251272 EXTRAORDINARY PART II-Section 3-Sub-section (ii) PUBLISHED BY AUTHORITY No. 141] NEW DELHI, THURSDAY, JANUARY 11, 2024/PAUSHA 21, 1945 MINISTRY OF HOME AFFAIRS NOTIFICATION New Delhi, the 11th January, 2024 S.O. 148(E).—Whereas, in exercise of the powers conferred by sub-section (1) and proviso to sub-section (3) of section 3 of the Unlawful Activities (Prevention) Act, 1967 (37 of 1967), the Central Government declared the Tehreek-e-Hurriyat, Jammu and Kashmir (TeH), to be an unlawful association vide notification number S.O. 5532(E), dated the 31st December, 2023, published in the Gazette of India, Extraordinary, Part-II, Section-3, Sub-section (ii), dated the 31st day of December, 2023. Now, therefore, in exercise of the powers conferred by section 42 of the Unlawful Activities (Prevention) Act, 1967, the Central Government hereby directs that all powers exercisable by it under section 7 and section 8 of the said Act shall also be exercised by the State Governments and the Union Territory Administration in relation to the above said unlawful association.
