L.-33004/99 The Gazette of India CG-DL-E-10072026-274338 EXTRAORDINARY PART II-Section 3-Sub-section (i) PUBLISHED BY AUTHORITY No. 539] NEW DELHI, WEDNESDAY, JULY 8, 2026/ASHADHA 17, 1948 5129 GI/2026 MINISTRY OF AGRICULTURE AND FARMERS WELFARE (Department of Agriculture and Farmers Welfare) NOTIFICATION New Delhi, the 8th July, 2026 G.S.R. 597(E).β€”Whereas the draft rules further to amend the Insecticides Rules, 1971, was published, as required by section 36 of the Insecticides Act, 1968 (46 of 1968), vide notification of the Government of India in the Ministry of Agriculture and Farmers Welfare (Department of Agriculture and Farmers Welfare) number G.S.R. 855 (E), dated the 18th November, 2025, and published in the Gazette of India, Extraordinary, Part II, Section 3, Sub- section (i), dated the 19th November, 2025, inviting objections and suggestions from all persons likely to be affected thereby, before the expiry of a period of thirty days from the date on which the copies of the Official Gazette in which the said notification was published, were made available to the public; And whereas, copies of the said notification were made available to the public on 19th day of November, 2025; And whereas, objections or suggestions received from the public in respect of the said draft rules have been considered by the Central Government; Now, therefore, in exercise of the powers conferred by section 36 of the said Act, the Central Government hereby makes the following rules further to amend the Insecticides Rules, 1971, namely:- 1. Short title and Commencement.- (1) These rules may be called the Insecticides Third (Amendment) Rules, 2026. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Insecticides Rules, 1971 (hereinafter referred to as the said rules), in rule 4, after clause (b), the following clause shall be inserted, namely:- "(c) grant import permit to any person desirous to import an insecticide for non-insecticidal use.". 3. In the said rules, after Chapter III, the following Chapter shall be inserted, namely:- "Chapter III A MANNER OF IMPORT OF AN INSECTICIDE FOR NON-INSECTICIDAL PURPOSE 8A. Manner of import.- (1) An application for import of an insecticide for non-insecticidal purpose shall be made to the Registration Committee in Form IA. (2) The application under sub-rule (1) shall be accompanied by a fee of rupees five thousand only. (3) The Registration Committee shall have the power to conduct an enquiry to verify the information furnished by the applicant. (4) An application which is complete in all respect shall be considered and disposed by the Registration Committee preferably within a period of forty-five days which may further extend to a period not later than fifteen days. (5) The import permit granted under sub-rule (4) shall be valid for one year. (6) If an applicant holds a certificate of registration for the pesticide for which the imported goods are intended to be used as raw material, the import permit shall be valid for three years.". 4. In the said rules, in "THE FIRST SCHEDULE", after "FORM I, the following FORM shall be inserted, namely: "FORM IA APPLICATION FOR GRANT OF PERMISSION FOR IMPORT OF INSECTICIDES FOR NON-INSECTICIDAL USE [see rule 4(c)] 1. Name of the applicant along with complete address:. 2. Address of premises, where the imported insecticide shall be stocked or used: 3. Name of the insecticide proposed to be imported along with the minimum purity: 4. Source of import with complete address: 5. (i) Name of the Item being manufactured using the imported insecticide: (ii) Licensed Capacity of item proposed to be manufactured: (iii) Installed Capacity of item proposed to be manufactured: (iv) Function of the insecticide in the process of manufacture of the item and the percent required: 6. Annual quantity (in MT) of the insecticide proposed to be imported: 7. Copy of valid industrial license / approval (enclosed a copy of factory license) / Industrial Entrepreneur Memorandum (IEM) issued by Department of Industrial Policy and Promotion / State Director of Industry certificated / District Industry Centre) [Attach self-certified copy (along with English Version, If not in English Language)- Please attach as Annexure-I] 8. Whether- (a) Clearance or consent from Pollution Control Board (PCB) for the current year:........... (b) If no, whether renewal has been applied for current year: (Attach legal self-certified document for existence of manufacturing facility at the address provided by applicant. Please attach as Annexure-II) 9. Self-Certified Year-wise quantity of the insecticide imported and consumed during the last three years along with corresponding production of end- product. [ Please attach self-certified duly filled Proforma provided at S. No. 13 as Annexure III] 10. Self-Certified affidavit for the quantity requested with justification for first time application thereafter, verification of the claim as per Registration Committee decision. 11. (a) Whether the imported material is for Domestic consumption or export or both: (b) If for domestic consumption then declaration certified by jurisdictional Industrial Health and Safety Office that the imported insecticide shall be stored in a separate area away from all other material to avoid poisoning. (c) If for export, name and address of foreign buyer to whom the finished product is to be exported, enclosing a copy of the advance license, if applicable. 12. In case, the difference between quantity imported (S.No.9) and average consumption during last three years (Annexure-III) is more than 30 percent, detailed justification of the Nodal Ministry/ Department/State Department of Industry is required to import fresh quantity. 13.
