It follows an earlier notification, S.O. 3903(E) dated 4 September 2023, issued under section 20A(1) of the Railways Act, 1989 (24 of 1989), declaring the Central Government's intention to acquire land for execution, maintenance, management and operation of the Haryana Orbital Rail Corridor Project in Gurugram district, Haryana; the substance of that notification was published in "Times of India" and "Danik Jagran" on 13 September 2023 under section 20A(4). Two objections were received and resolved by the Competent Authority. Following the Competent Authority's report under section 20E(1), the Central Government, exercising powers under section 20E(1), declares that the land specified in the appended Schedule shall be acquired for the aforesaid purpose, and, exercising powers under section 20E(2), declares that on publication the land vests absolutely in the Central Government free from all encumbrances. The Schedule (spanning some 29 pages) lists, village by village in Farrukhnagar tehsil, Gurugram district, the survey/rectangle/field numbers, nature and type of land, area in hectares, and names of land owners/interested persons (including numerous individual heirs with fractional inheritance shares, and Civil/Gram Panchayat holdings) for each parcel, covering villages including Patli Hajipur, Khetawas and Mubarikpur among others, culminating in a cumulative Grand Total land area of 9.3783 hectares. L.-33004/99 The Gazette of India CG-DL-E-10072024-255315 EXTRAORDINARY PART II—Section 3—Sub-section (ii) PUBLISHED BY AUTHORITY No. 2533] NEW DELHI, TUESDAY, JULY 9, 2024/ASHADHA 18, 1946 MINISTRY OF RAILWAYS NOTIFICATION New Delhi, the 9th July, 2024 S.O. 2668(E).— Whereas, by the notification of the Government of India in the Ministry of Railways, number S.O. 3903(E), dated the 04th Sep 2023 published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), dated 04th Sep 2023 and issued under sub-section (1) of section 20A of the Railways Act, 1989 (24 of 1989) (hereinafter referred to as the said Act), the Central Government declared its intention to acquire the land specified in the Schedule annexed to the said notification for the purpose of execution, maintenance, management and operation of the Special Railway Project, namely, Haryana Orbital Rail Corridor Project in the district Gurugram, in the State of Haryana; And whereas, the substance of the said notification has been published in the daily local newspapers, namely, "Times of India" dated the 13th Sep, 2023, and "Danik Jagran" dated the 13th, Sep, 2023 under sub-section (4) of section 20A of the said Act; And whereas, 02 objections have been received & the same was considered & resolved as per rule by the Competent Authority; And whereas, in pursuance of sub-section (1) of section 20E of the said Act, the Competent Authority has submitted its report to the Central Government; Now, therefore, upon receipt of the report of the Competent Authority, and in the exercise of the powers conferred by sub-section (1) of section 20E of the said Act, the Central Government hereby declares that the land specified in the Schedule annexed hereto shall be acquired for the aforesaid purpose; And further, in pursuance of sub-section (2) of section 20E of the said Act, the Central Government hereby declares that on publication of this notification in the Official Gazette, the land specified in the Schedule annexed hereto shall vest absolutely in the Central Government free from all encumbrances.
