Guruprasad (retired Engineer-in-Chief and former Secretary, Public Works Department, Government of Karnataka), Member Shri Lakshmikanth H.M. (Srishti International), and Member-Secretary the Principal Secretary (Ecology and Environment), Forest, Ecology and Environment Department, Government of Karnataka. It also constitutes the State Level Expert Appraisal Committee (SEAC) for Karnataka, comprising Chairperson Shri Mahesh A.N. and Members Shri Ravi Kumar Yadav B.V., Dr. Balakrishna S. Maddodi, Shri Dhruva Kumara B.Y., Shri Shivappa Naik S., Shri K.H. Nagaraj, Shri Sadiq Ahmed and Dr. Sangamesh Kolliyavar, with the Commissioner (Technical Cell) as Member-Secretary. Both bodies hold office for three years from the date of publication, are required to reach decisions by consensus or majority with recorded minutes, and are subject to conflict-of-interest declarations and recusal requirements; the State Government of Karnataka is directed to provide secretariat and logistical support, with sitting fees and allowances payable per State Government rules. MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 8th March, 2024 S.O. 1188(E).—In exercise of the powers conferred by sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) and in pursuance of the notification of the Government of India in the erstwhile Ministry of Environment and Forests, number S.O. 1533(E), dated the 14th September, 2006 (hereinafter referred to as the said notification), the Central Government hereby constitutes the State Level Environment Impact Assessment 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II-SEC. 3(ii)] Authority for the State of Karnataka (hereinafter referred to as the Authority) comprising of the following persons, namely: - (i) Shri. B. The Chairman and Members of the Authority shall hold office for a period of three years from the date of publication of this notification in the Official Gazette. 3. The Authority shall exercise such powers and follow such procedures as specified in the said notification. 4. The Authority shall endeavour to reach consensus to take decision and if they fail to reach consensus, the views of the majority shall prevail and the details of views, for and against it, shall be clearly recorded in the minutes and a copy thereof sent to the Central Government. 5. The Authority shall take its decision on the recommendations of the State Level Expert Appraisal Committee constituted under paragraph 6 for the State of Karnataka. 6. The Central Government, in consultation with the State Government of Karnataka, for the purpose of assisting the Authority, hereby constitutes the State Level Expert Appraisal Committee (hereinafter referred to as the Committee), comprising of the following persons, namely: - (i) Sri. The Chairman and Members of the Committee, shall hold office for a period of three years from the date of publication of this notification in the Official Gazette. 8. In order to avoid any conflict of interest,- (i) the Chairman and Members of the Authority, and the Committee shall, - (a) declare to which consulting organisation they have been associated with and also the project proponents; (b) not undertake any consultation or associate with regard to preparation of Environment Impact Assessment and Environment Management Plan for project, which is to be decided by the Authority, or to be appraised by the Committee during their tenure; and (ii) In the preceding five years, if the Chairman or any Member of the Committee has provided consultancy services or conducted Environment Impact Assessment studies for any project proponent, they shall recuse themselves from the meetings of the Committee from the process of appraisal of any project proposed by such proponents. 9. The Committee shall exercise such powers and follow such procedures as specified in the said notification. 10. The Committee shall function on the principles of collective responsibility and the Chairman shall endeavour to reach consensus in each case, and if they fail to reach consensus, the views of the majority shall prevail. 11. (i) The State Government of Karnataka shall specify an agency to act as secretariat of the Authority and the Committee. (ii) The secretariat shall provide financial and logistic support including accommodation, transportation and such other facilities in respect of their functions under the said notification. 12. The sitting fees, travelling allowances and dearness allowances to the Chairman and Members of the Authority and the Committee, shall be paid in accordance with the provisions of relevant rules, of the State Government of Karnataka.
