Detailed Summary

A vacancy in the office of the Vice-President of India occurred due to the resignation of Sh. Jagdeep Dhankhar on 21st July, 2025. In accordance with clause (2) of Article 68 of the Constitution of India, an election is required to be held to fill this vacancy as soon as possible. Pursuant to sub-section 4 of Section 4 of the Presidential and Vice-Presidential Elections Act, 1952 (31 of 1952), the Election Commission of India is mandated to appoint the election dates. Therefore, the Election Commission of India, via Notification O.N. 32(E) dated 7th August, 2025, calls upon the Electoral College, as referred to in Article 66 of the Constitution, to elect a successor. Furthermore, in pursuance of sub-section (1) of Section 4 of the said Act, the Commission appoints the following dates for the election: 21st August, 2025 (Thursday), as the last date for making nominations; 22nd August, 2025 (Friday), for scrutiny of nominations; 25th August, 2025 (Monday), as the last date for withdrawal of candidatures; and 09th September, 2025 (Tuesday), as the date on which a poll shall, if necessary, be taken.

Jagdeep Dhankhar on 21st July, 2025; and Whereas, under clause (2) of Article 68 of the Constitution of India, an election to fill the said vacancy is required to be held as soon as possible after the occurrence of the vacancy; and Whereas, under sub-section 4 of Section 4 of the Presidential and Vice-Presidential Elections Act, 1952 (31 of 1952), the Election Commission of India is required to appoint the dates for the election to fill the office of the Vice President of India; Now, therefore, the Election Commission of India hereby — (A) calls upon the Electoral College, referred to in Article 66 of the Constitution, to elect a person to fill the said vacancy in the office of the Vice-President of India, in accordance with the provisions of the Constitution, the Presidential and Vice-Presidential Elections Act, 1952 (31 of 1952), and the Rules and Orders made thereunder; and (B) in pursuance of sub-section (1) of Section 4 of the said Act, appoints- a) the 21st August, 2025 (Thursday), as the last date for making nominations; b) the 22nd August, 2025 (Friday), as the date for scrutiny of the nominations; c) the 25th August, 2025 (Monday), as the last date for the withdrawal of candidatures; and d) the 09th September, 2025 (Tuesday), as the date on which a poll shall, if necessary, be taken.
