No. BUSS/Unani PG Regul./2023.––In exercise of the powers conferred by section 55 of the National Commission for Indian System of Medicine Act, 2020 (14 of 2020), and in supersession of the Indian Medicine Central Council(Post-Graduate Unani Medical Education) Regulations, 2016, the Establishment of New Medical College, Opening of New or Higher Course of Study or Training and Increase of Admission Capacity by a Medical College Regulations, 2019 and the Indian Medicine Central Council (Post-Graduate Diploma Course in Unani medicine) Regulations, 2015 except as respects things done or omitted to be done before such supersession, the Commission hereby makes the following regulations, namely.- 1. Short title and commencement. - (1) These regulations may be called the National Commission for Indian System of Medicine (Minimum Essential Standards, Assessment and Rating for Postgraduate Institutions and Minimum Standards of Postgraduate Unani Education) Regulations, 2024; (2) Save as other wise provided, they shall come into force on the date of their publication in Official Gazette. CHAPTER-I PRELIMINARY 2. Definitions.-(1) In these regulations, unless the context otherwise requires,- (a) “Act” means the National Commission for Indian System of Medicine Act, 2020 (14 of 2020); (b) “Annexure” means an annexure annexed to these regulations; (c) “Appendix” means an appendix appended to these regulations; (d) “applicant” means a person namely a society, trust, University, or any legal person but does not include the Central Government; (e) “assessment” of an Institution means the act of verifying the availability of minimum essential standards as specified in these regulations in terms of the infrastructure, human resources and functionality of an institution and its attached teaching hospital by the MARBISM ; (f) “attached teaching hospital” means an Unani Medical Hospital that offers standard healthcare services, attached to an Unani Medical Institution for the purpose of teaching and training to the students of Unani system of Medicine; (g) “Doctor of Philosophy” means doctoral degree (Ph.D) awarded or granted to a research work carried out for not less than three years of duration after postgraduation, either in the subject concerned or in inter disciplinary, intra-disciplinary, or trans-disciplinary or multi-disciplinary research areas; (h) "extended permission" means permission is extended to fully established Unani medical institutions fulfilling the criteria for “extended permission” status as laid down in these regulations, and such institutions are allowed to participate in the counselling process for admitting students to Postgraduate programmes as per the sanctioned student intake capacity without waiting for permission from the MARBISM every year unless otherwise denied or specified or communicated by the MARBISM (i) “fully established institute” means the institute with either extended permission or yearly permission from the year after second renewal of permission granted by the MARBISM; (j) “letter of intent” means preliminary approval along with conditions and timelines issued by the MARBISM to the applicant through the procedure specified in these regulations to establish a new Unani Medical Institution, or to start any new Postgraduate programme recognised by the Commission or to increase student intake capacity in existing Postgraduate programme; (k) “letter of permission” means approval granted to the applicant by the MARBISM through the procedure determined in these regulations to establish Unani medical institution or to start any new Postgraduate programme recognised by the Commission or to increase student intake capacity in existing Postgraduate programme and to admit the students as per the sanctioned student intake capacity specified by the MARBISM; (l) “MARBISM” means Medical Assessment and Rating Board for Indian System of Medicine; (m) “minimum essential standards” means the mandatory minimum requirements in terms of infrastructure, human resources, and functionality, quality and standards that are essential and below the minimum essential standards, which is unacceptable; (n) “NCISM-UG MES Regulations, 2023” means the National Commission for Indian System of Medicine (Minimum Essential Standards, Assessment, and Rating for Undergraduate Unani Colleges and Attached Teaching Hospitals) Regulations, 2023; (o) “Postgraduate education” means that include Postgraduate degree programmes (Doctor of medicine-M.D. and Master of Surgery-M.S.), doctoral degree programme (Doctor of Philosophy-Ph.D.), and super-specialty degree programme (Doctorate of Medicine-D.M.); (p) “Postgraduate degree” in Unani means a Postgraduate degree namely “Mahire Tib” (Doctor of Medicine M.D.) and Mahire Jarahat (Master of Surgery-M.S.)” of three years duration granted or awarded after graduation in Unani; (q) “professor of practice” means a person having a minimum of ten years of experience in the field other than teaching in Unani medical colleges, like a person from an industry or research institute, a technical consultant, a renowned practitioner, or a scientist and the like; (r) “rating’ of Postgraduate Department means a score or measurement of how good a Postgraduate Department is; rating of a fully established Postgraduate Department through a rating procedure carried out by the MARBISM or any designated rating agency based on the standards and parameters laid down by the Board of Unani, Siddha and Sowa-Rigpa and rating shall be on the basis of infrastructure, human resources, and functionality over and above the minimum essential standards specified in these regulations; (s) “renewal of permission” means permission renewal granted by MARBISM to a new Postgraduate institution or department or speciality undergoing establishment under section 29 of the Act through the procedure mentioned in these regulations during the following academic years after the issuance of a letter of permission for admitting students as per the sanctioned student intake capacity specified by the Medical Assessment and Rating Board for Indian System of Medicine, and such renewal of permission shall be mandatory until it attains the fully established institution or department or speciality status, under section 28 of the Act; (t) “stand alone Postgraduate institution” means a teaching institution with an attached teaching hospital dedicated for conducting Postgraduate programme only; (u) “sanctioned intake capacity” means number of seats sanctioned by MARBISM to a Postgraduate programme for admission of students based on infrastructure, human resources and functionality of the institution or department and the teaching hospital; (v) “yearly permission” means fully established medical institutions or Postgraduate departments that are not fulfilling the criteria for “extended permission” status as laid in these regulations, and such institutions shall participate in the counselling process for admitting students to Postgraduate programmes as per the sanctioned student intake capacity only after obtaining permission from the MARBISM every year. (2) The words and expressions used herein and not defined but defined in the Act, rules or regulations made thereunder shall have the same meanings as respectively assigned to them in the Act, rules or regulations. CHAPTER-II GENERAL 3. General considerations. ––(1) The Postgraduate medical education in Unani shall produce competent specialists in respective specialties with profound knowledge, skill, attitude, value and ethics; (2) Every institution shall maintain minimum essential infrastructural standards, qualified and skilled human resources and a functional education ecosystem as specified in these regulations. 4. Acamedic hierarchy. – (1) The academic hierarchy of the postgraduation programmes shall be in the descending order from super specialty degree (D.M.) to doctoral degree (Ph.D.) to Postgraduate degree (M.D. or M.S.) to Postgraduate diploma (P.G. Diploma). (2) (a) The Unani Postgraduate Medical institution shall appoint Professor of Practice on a part-time basis in the concerned subject with the qualification as mentioned in the Seventh Schedule in these regulations; such professors shall not be provided with the unique teacher code by the MARBISM; (b) he or she shall have a minimum of ten years of experience in the concerned field other than teaching in Unani colleges, like a person from an industry or research institute, a technical consultant, a renowned practitioner, or a scientist and the like. (3) (a) On and from the date of publication of these regulations, the Postgraduate diploma programme shall stand abolished and no Postgraduate diploma course or programme shall be conducted by any Unani Medical College or Institution from the date of commencement of the National Commission for Indian System of Medicine (Minimum Essential Standards, Assessment and Rating for Postgraduate institutions and Minimum Standards of Postgraduate Unani Education) Regulations, 2024; However, already admitted students in the Postgraduate diploma course or programme, before the commencement of these regulations, if any, shall continue and complete the course as per the provisions under “Indian Medicine Central Council (Post-Graduate Diploma Course in Unani medicine) Regulations, 2015”; (b) the seats in existing Postgraduate diploma programmes permitted by the MARBISM that are recognised in the “Indian Medicine Central Council (Postgraduate Diploma Course in Unani Medicine) Regulations, 2015”;, may be converted to the Postgraduate degree programme seats of the parent department in the ratio of 2:1, i.e., every two Postgraduate diploma seats may be converted to one Postgraduate degree seat subject to the availability of student-Postgraduate guide ratio as specified in regulation 20 for Postgraduate degree programmes. (4) (a) Each institution shall install online platforms or systems such as Learning Management Systems, Hospital Information and Management systems (compatible with Ayushman Bharat Health Account, Health Professional Registry, Health Facility Registry, and Unique Health Identification Number), Aadhaar enabled biometric attendance system or iris detection or face recognition attendance system and the like as directed by the commission, Closed-Circuit Television Systems, and any other system specified by the Commission from time to time and shall align or interface to the online platforms or information technology system run by the commission or central server designated by the commission and shall provide real time data or relevant data to the commission and its autonomous boards as required; (b) biometric attendance data shall be made available to the concerned regulatory body or the Commission or autonomous boards of the Commission on real time basis throughout the year through any agency as designated or assigned by the Commission; (c) all Unani medical institutions shall connect with centralised Aadhar Enabled Biometric Attendance System for marking attendance of
