L.-33004/99 The Gazette of India CG-DL-E-05032025-261471 EXTRAORDINARY PART II—Section 3—Sub-section (i) PUBLISHED BY AUTHORITY No. 124] NEW DELHI, TUESDAY, MARCH 4, 2025/PHALGUNA 13, 1946 MINISTRY OF PORTS, SHIPPING AND WATERWAYS NOTIFICATION New Delhi, the 4th March, 2025 G.S.R. 158(E). — In exercise of the powers conferred by sub-section (1) of section 34, section 35, sub- section (1) of section 36, sub-section (3) of section 37, sub-sections (1) and (4) of section 38, section 39, sub- section (2) of section 41 read with clauses (z) to (zg) of sub-section (2) of section 106 of the Inland Vessels Act, 2021 (24 of 2021), the Central Government proposes to amend the Inland Vessels (Manning) Rules, 2022 notified by the Government of India in the Ministry of Ports, Shipping and Waterways vide number G.S.R. 422(E) dated the 7th June, 2022 and hereby publish as required by sub-section (1) of section 106 of the Inland Vessels Act, 2021 (24 of 2021) for information of all persons likely to be affected thereby; and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of thirty days from the date on which the copies of this notification, as published in the Official Gazette, are made available to the public; Objections or suggestions, if any, to these draft rules may be sent to the Deputy Secretary (IWT), Ministry of Ports, Shipping & Waterways, Room No. 536, Transport Bhawan, 1-Parliament Street, New Delhi-110001, or by email at dsiwt-psw@gov.in and uttam.mishra27@gov.in within the period specified above; Draft Amendment 1. (1) These rules may be called as the draft Inland Vessel (Manning) (First Amendment) Rules, 2025. (2) They shall come into force on the date of their final publication in the Official Gazette. 2. In the Inland Vessels (Manning) Rules, 2022 (hereinafter referred to as the said rules), after clause (a) of sub-rule (1) of rule 2 the said rules, the following clauses shall be inserted namely. - "(aa) "approved training institute” means training institutes approved under Rule 21; (ab) "basic safety and security courses” means the following five courses whose syllabus and duration shall be such as may be specified by the Inland Waterways Authority of India: (i) Elementary First Aid; (ii) Proficiency in survival techniques; (iii) Personal safety and social responsibility; (iv) Fire Prevention and Fire Fighting; and (v) Security Training for Seafarers with Designated Security Duties; (ac) “conversion course to general purpose rating” such course whose syllabus and duration shall be such as may be specified by the Competent Authority; (ad) "preparatory course" means the course for various grades on the deck and engine side, whose syllabus and duration shall be such as may be specified by the Inland Waterways Authority of India; (ae) "refresher and revalidation course" means the course for various grades on the deck department and engine department, whose syllabus and duration shall be such as may be specified by the Inland Waterways Authority of India; (af) "Schedule" means the schedule annexed to these rules containing the standards of approval of training institutes." 3. In sub-rule (3) of rule 4 of the said rules, in the table: i. In Category A. - a. in row no. 2, for the figure "500" occurring at both places, the figure “300” shall be substituted; b. in row no. 2, for the figure "1600" occurring at both places, the figure "1000" shall be substituted; c. in row no. 3, in column GT<500, for the words "Master Class 3/Serang", the words "Master Class 2" shall be substituted; d. in row no. 6, in column kW ≥ 750 propulsion power, in clause (a), after the words “One chief engineer with Inland Engineer certificate", the words "or one chief engineer with Inland Engine Driver Class 1 certificate with 2 years of experience as Engine Driver Class 1 on vessel with ≥ 750 kW." shall be inserted; e. in row no. 8, for the figure "500" occurring at both places, the figure "300" shall be substituted; the words "and KW" shall be substituted with "or KW" ii. In Category B, - a. in row no. 12, for the figure "500" occurring at both places, the figure "300" shall be substituted; b. in row no. 12, for the figure "1600", the figure "1000" shall be substituted; iii. For Note 1 in the table, for the words "2 years of coming into force of the Rules", the words "5 years from the date of coming into force of these Rules." shall be substituted. iv. After Note 2, the following notes shall be inserted, namely. – "Note 3: In addition to the manning for deck side and engine side prescribed for vessels more than 1000 GT, vessels of more than 3000 GT shall have on board a Master Foreign Going or Master Near Coastal Voyage Vessel (NCV) and a Mate Foreign Going or Mate Near Coastal Voyage Vessel (NCV) and a Marine Engine Officer (MEO) Near Coastal Voyage Vessel (NCV) Class II. Note 4: The Designated Authority may specify manning lower than that prescribed in sub-rule (3), if in cases of shortage of crew." 4. In rule 5 of the said rules: i. For sub-rule (5), the following shall be substituted. - (a) Possesses a Ministry of Transport Master (Foreign Going) or Marine Engineer Officer (MEO) Class I Certificate of Competency issued by Directorate General of Shipping with minimum 8 years' experience as Certificated Officer on ships or State Maritime Boards or Director General of Shipping or Ports or State Inland Waterways Authority or Inland Water Transport Directorate or equivalent; or (b) Possesses a Ministry of Transport First Mate (Foreign Going) or Marine Engineer Officer (MEO) Class II Certificate of Competency issued by Directorate General of Shipping with minimum 10 years experience as Certificated Officer on ships or State Maritime Boards or Directorate General of Shipping or Ports or State Inland Waterways Authority or Inland Water Transport Directorate or equivalent; or (c) Possesses academic qualification of Secondary School Certificate (SSC) and above along with an Inland Vessel Master Class I or Inland Engineer Certificate with a minimum of 20 years of service onboard in inland vessels or State Maritime Boards or State Inland Waterways Authority Inland Water Transport Directorate or Directorate General of Shipping or Ports or equivalent as Certificated Officer of which at least 5 years shall be in the capacity of a Master or Chief Engineer on ships or State Maritime Boards or Director General of Shipping or Ports; or (d) Possesses a Master [Near Coastal Voyage Vessel (NCV)] or Marine Engine Officer (MEO) Class III (Near Coastal Voyage Vessel-Chief Engineer Officer) Certificate with a minimum of 20 years of sailing experience of which at least 5 years shall be in the capacity of Master or Chief Engineer on ships or State Maritime Boards or Directorate General of Shipping or Ports or State Inland Waterways Authority or Inland Water Transport Directorate; or (e) Possesses qualifications as in (a), (b), (c) or (d) above and in case of any chief examiner appointed after the notification of these rules (i) experience as a faculty or examiner in any approved training institute or Directorate General of Shipping or Mercantile Marine Department; and (ii) has undergone Trainer and Assessor Course for Inland Vessels as may specified by the Inland Waterways Authority of India at any approved training institute. Provided that the Designated Authority may exempt Master Foreign Going Master or Marine Engineer Officer Class I chief examiners from the requirement of this course." Explanation. – The tenure of experience as faculty or examiner may be counted towards shipboard or inland vessel experience required under clauses (a), (b), (c) and (d) of this sub-rule. ii. In sub-rule (7): (a) for clause (a), the following clause shall be substituted, namely. "(a) Possesses a Ministry of Transport Master (Foreign Going) or Marine Engineer Officer (MEO) Class I Certificate of Competency issued by Directorate General of Shipping with minimum 5 years experience as Certificated Officer on ships or State Maritime Boards or Directorate General of Shipping or Ports or State Inland Waterways Authority or Inland Water Transport Directorate or equivalent; or" (b) for clause (b), the following clause shall be substituted, namely. "(b) Possesses a Ministry of Transport First Mate (Foreign Going) or Marine Engineer Officer (MEO) Class II Certificate of Competency issued by Director General of Shipping with minimum 7 years experience as Certificated Officer on ships or State Maritime Boards or Directorate General of Shipping or Ports or State Inland Waterways Authority or Inland Water Transport Directorate or equivalent; or" (c) in clause (c), after the words "years of service onboard inland vessels", the words "or State Maritime Boards or State Inland Waterways Authority or Directorate General of Shipping or Ports or Inland Water Transport Directorate or equivalent" shall be inserted; (d) for clause (d), the following clause shall be substituted, namely. "(d) Possesses a Master [Near Coastal Voyage Vessel (NCV)] or Marine Engineer Officer (MEO) Class III (Near Coastal Voyage Vessel -Chief Engineer Officer) Certificate with a minimum of 15 years of sailing experience of which at least 5 years shall be in the capacity of Master or Chief Engineer on ships or State Maritime Boards or Directorate General of Shipping or Ports or State Inland Waterways Authority or Inland Water Transport Directorate or equivalent; and" (e) for clause (e), the following clause shall be substituted, namely. "(e) Possesses qualifications as in (a), (b), (c) or (d) above and in case of any examiner appointed after the notification of these rules: (i) experience as a faculty or examiner in any approved training institute or Directorate General of Shipping or Mercantile Marine Department and (ii) has undergone Trainer and Assessor Course for Inland Vessels at any approved training institute. Provided that the Designated Authority may exempt Master Foreign Going Master or Marine Engineer Officer Class I examiners from the requirement of this course." 5. In rule 6 of the said rules: i. for sub-rule 1, the following sub-rule shall be substituted, namely. - "(1) No candidate shall be granted a Certificate of Competency in Form no. 4 and Form No. 5, of these rules unless he secures minimum 50% marks"; ii. in sub-rule (2), for the words "Competent Authority", the words "the Inland Waterways Authority of India" shall be substituted; iii. after sub-rule (4), the following sub-rule shall be inserted, namely. "(5) All holders of Certificate of Competency in sub-rule (2) shall be required to undergo refresher course after five years from the date of issuance of certificate of competency and thereafter at interval of every five years, at any approved training institute." 6. In rule 8 of the said rules, in sub-rule (1): i. in clause (b), for the figure "500", the figure "300" shall be substituted; ii. in clause (c), for the words "an Inland Waterways Authority of India or Designated Authority empanelled MBBS medical practitioner or medical officer”, the words “MBBS doctor” shall be substituted. iii. for clause (d), the following clause shall be substituted, namely. “have successfully attended preparatory course for Master Class 1 at any approved training institute." iv. for clause (e), the following clause shall be substituted, namely. "(e) have completed the five basic safety and security courses for inland vessels at any approved training institute or an institute approved by the Directorate General of Shipping." 7. In sub-rule (1) of rule 9 of the said rules: i. in clause (c), for the words "an Inland Waterways Authority of India or Designated Authority empanelled MBBS medical practitioner or medical officer", the words "MBBS doctor" shall be substituted. ii. for clause (d), the following clause shall be substituted, namely. "(d) have successfully attended preparatory course for Master Class 2 at any approved training institute." iii. for clause (e), the following clause shall be substituted, namely. "(e) have completed the five basic safety and security courses for inland vessels at any approved training institute or an institute approved by the Directorate General of Shipping." 8. In rule 10 of the said rules, - i. in clause (c) of sub-rule (1), for the words "an Inland Waterways Authority of India or Designated Authority empanelled MBBS medical practitioner or medical officer", the words "MBBS doctor" shall be substituted. ii. for clause (d) of sub-rule (1), the following clause shall be substituted, namely.- "(d) have successfully attended approved preparatory course for Master Class 3 or Serang at any approved training institute." iii. for clause (e) of sub-rule (1), the following clause shall be substituted, namely.- "(e) have completed the five basic safety and security courses for inland vessels at any approved training institute or an institute approved by the Directorate General of Shipping." iv. in sub-rule (3), for the figure and words "2 years time to undergo new training program.", the figure and words "5 years from the date of coming into force of these rules to undergo new training program." shall be substituted. 9. In rule 11 of the said rules, in sub-rule (1), - i. in clause (a), after the words "Central or State Government", the words "or has completed conversion course for general purpose rating at any training institute.” shall be inserted; ii. in clause (c). (a) in sub-clause (i), for the figure “500”, the figure “300” shall be substituted; (b) in sub-clause (iii), for the figure “15”, the figure “10” shall be substituted; iii. in clause (d), after the words "or an Assistant Master (deck) or Seacunny", the words "or boat master or equivalent," shall be inserted; iv. after clause (d), the following clauses shall be inserted, namely. "(e) have successfully attended preparatory course at any approved training institute; and (f) have completed the five basic safety and security courses for inland vessels at any approved training institute or an institute approved by the Directorate General of Shipping." 10. In rule 12 of the said rules: i. in sub-rule (1). – (a) in sub-clause (ii), for the words "General Purpose Rating Course at similar training establishment approved by the State", the words "any approved training institute" shall be substituted; (b) in sub-clause (iii), after the words “or as Seacunny”, the word “or equivalent” shall be inserted. ii. sub-rule (2) shall be renumbered as sub-rule (3) and before sub-rule (3) so renumbered, the following sub-rule shall be inserted, namely: - "(2) In addition to the requirements in sub-rule (1) every new entrant through rating route, including existing Lascars or Deck Hands or General Purpose Rating shall be: (a) be a Citizen of India; (b) not less than twenty one years of age; (c) medically fit and produce a medical certificate as to his physical fitness in Form No. 1 appended to these rules from an MBBS doctor; (d) have successfully attended preparatory course for Master Class 3 or Serang at any approved training institute along with minimum service of 36 Months on inland vessels; and (e) have completed the five basic safety and security courses for inland vessels at any approved training institute or an institute approved by the Directorate General of Shipping." 11. In rule 13 of the said rules: i. for sub-rule (1), the following sub-rule shall be substituted, namely. – "Minimum requirements for certification of Master Class 3 or Serang or Engine Driver Class 2 of an inland vessel for new entrants through cadet training route. (1) For the purposes of certification of every new entrants through cadet training route, shall - (a) be a citizen of India; (b) not be less than twenty-one years of age; (c) be medically fit and produce a medical certificate as to his physical fitness in Form No. 1 appended to these rules from an MBBS doctor; (d) possess any of the following educational qualifications: (i) candidates who have passed class 12th class examination from board recognised by the Central or the State Government; or (ii) candidates who have passed class 10th examination from board recognised by the Central or the State Government and who have successfully completed a vocational or skill training course from an Industrial Training Institute; or (iii) candidates who have passed class 10th examination from board recognised by the Central or the State Government and who have successfully completed Polytechnic Diploma in Mechanical or Electrical Engineering approved by All India Council for Technical Education. (e) have successfully completed inland vessel cadets training course, whose syllabus and duration shall be such as may be specified by the Inland Waterways Authority of India, from any approved training institute.; (f) have successfully completed five basic safety and security courses for inland vessels at any approved training institute or at an institute approved by the Directorate General of Shipping; and (g) have served on Inland vessels or sea going vessels either for: (i) two years, in case the candidate possesses the educational qualification under sub-clause (i) of clause (d) of this sub-rule; or (ii) 18 months, in case the candidate possesses the educational qualification under sub-clause (ii) of clause (d) of this sub-rule; or (iii) 12 months, in case the candidate possesses the educational qualification under sub-clause (iii) of clause (d) of this sub-rule. Provided the total service has been performed as Inland Vessel cadet apprentice with onboard vessel Structured Training Program verified in record book and should have performed at least six months watch keeping service under qualified Master Class 1 or Class 2 or Class 3 Serang or Engine Driver Class 1 or Engine Driver Class 2 on board the vessel plying in the port or Inland vessels of the State." ii. Sub-rule (3) shall be omitted. 12. In rule 15 of the said rules: i. in sub-rule (1), - (a) in clause (a), for the words "Competency Service issued under the Act along with academic qualification or”, the words “Certificate of Competency issued under the Act along with academic qualification of” shall be substituted; (b) in clause (b), for the figure and unit of measurement "750 kW", the figure and unit of measurement "425kW" shall be substituted; (c) in clause (c), for the words "an Inland Waterways Authority of India or Designated Authority empanelled MBBS medical practitioner or medical officer", the words "MBBS doctor" shall be substituted; (d) in clause (d), for the words "shall have successfully attended approved Preparatory Course for Inland Vessel Engineer, which shall be an approved course by the Inland Waterways Authority of India", the words "shall have successfully attended Preparatory Course for Inland Vessel Engineer at any approved training institute” shall be substituted; (e) for clause (e), the following clause shall be substituted. "have completed the five basic safety and security courses for inland vessels at any approved training institute or an institute approved by the Directorate General of Shipping." ii. sub-rule (2) shall be omitted. 13. In rule 16 of the said rules: i. In sub-rule (1), in clause (c), for the words "an Inland Waterways Authority of India or Designated Authority empanelled MBBS medical practitioner or medical officer", the words "MBBS doctor" shall be substituted.; ii. In sub-rule (1), for clause (d), the following clause shall be substituted. "have successfully attended approved preparatory course for Engine Driver Class1 at any approved training institute." iii. in sub-rule (1), for clause (e), the following clause shall be substituted. "have completed the five basic safety and security courses for inland vessels at any approved training institute or an institute approved by the Directorate General of Shipping." iv. sub-rule (2) shall be omitted. 14. For rule 17 of the said rules, the following rule shall be substituted, namely. "17. Minimum requirements for certification of Engine Driver Class 2 of an inland vessel. (a) be a citizen of India (b) age should not be less than 21 years; (c) shall produce a medical certificate as to his physical fitness in Form No. 1 appended to these rules from an MBBS doctor; (d) shall have completed preparatory course of 1 month duration from an approved training institute and possess a valid Course Completion Certificate; (e) shall have minimum service of 36 Months on Inland Vessels as General Purpose Rating; and (f) existing Engine Driver Class 2 serving on Inland Vessels shall be allowed to serve as Engine Driver Class 2 and given maximum of 5 years from the date of coming into force of IV Manning Rules, 2022 to undergo new training program;." 15. After sub-rule (2) of rule 18, the following sub-rule shall be inserted, namely. – "(3) A certificate of service shall be issued in Form No. 2 appended to these rules and shall have the same effect as a certificate of competency granted under these rules." 16. In rule 19 of the said rules: i. in clause (d) of sub-rule (1), for the words "an Inland Waterways Authority of India or Designated Authority empanelled MBBS medical practitioner or medical officer", the words "MBBS doctor" shall be substituted. ii. for clause (e) of sub-rule (1), the following clause shall be substituted, namely.- "(e) if new entrant, shall have completed induction training for General Purpose Ratings at any approved training institute"; iii. in proviso to clause (f) of sub-rule (1), for the words, "and such Conversion Course shall be approved course by the Competent Authority", the words “at any approved training institute" shall be substituted; iv. for clause (g) of sub-rule (1), the following clause shall be substituted, namely.- "(g) have completed the five basic safety and security courses for inland vessels at any approved training institute or at an institute approved by the Directorate General of Shipping."; V. sub-rule (2) shall be omitted; vi. sub-rule (3) shall be renumbered as sub-rule (2), and in sub-rule (2) so renumbered, for the figure and words "minimum 2 years time", the figure and words “maximum 5 years from the date of coming into force of these rules" shall be substituted. 17. After rule 20 of the said rules, the following rules shall be inserted, namely. "21. Approval of Training Institutes. – For the purposes of these rules, training institutes shall be approved by: i. the concerned State Government, for institutes within their jurisdiction, in accordance with the Schedule; and ii. Inland Waterways Authority of India for the following institutes, in accordance with the Schedule: (a) institutes established by the Central Government or Inland Waterways Authority of India; or (b) institutes within the jurisdiction of any State Government, if a request is made by the State Government. 22. Issuance of Seaman's Identification Record Book. – (1) No person shall be employed on a mechanically propelled inland vessel registered under this Act, without obtaining the Seaman's Identification Record Book which shall include the INDVIC Number. (2) Every new entrant or an existing General Purpose Rating before the completion of the course under induction training for General Purpose Ratings or conversion course, as the case may be shall make an online application through the portal to the Designated Authority of the State in which the approved training institute is situated for issuance of Seaman's Identification Record Book. (3) Every existing certificate of competency holder, within 5 years from the date of coming into force of these rules, shall make an online application through the portal for issuance of the Seaman's Identification Record Book to the Designated Authority of the State, in which the Certificate of Competency had been issued. (4) The Designated Authority shall maintain a register of the Seaman's Identification and Record Books issued through the portal. (5) The Designated Authority shall update the details of the training courses completed from approved training institutes, and the details of services done by each member of the crew onboard the vessels registered under this Act." 18. After the said rules, the following Schedule shall be inserted, namely. – "SCHEDULE-1 Standards for Approval of Inland Vessel Navigation Training Institutes / Centers by State Governments and Inland Waterways Authority of India Part 1 - Approval of Inland Vessel Navigation Training Institutes 1.1 Compliance with this Schedule a) From the date of notification of the Inland Vessels (Manning) Rules, 2022, Inland Vessel Navigation Training Institutes (“IVNTI”) shall be approved by the State Government or IWAI (“Approving Authority"), in accordance with Clause 21 of Inland Vessels (Manning) Rules 2022. b) Existing IVNTIs established by State Governments or Central Government or IWAI shall aim to comply with the requirements of this Schedule by 31st December, 2025, subject to any exemptions which may be granted by the Approving Authority. c) All courses for inland vessels may be completed by a new entrant at any IVNTI approved in accordance with the standards and procedure under this Schedule or an institute approved by the Directorate General of Shipping, subject to meeting the standards specified in this schedule. In case of institutes approved by DG Shipping, all the requirements & procedures for approval / inspection / cancellation etc shall be carried out by DG Shipping as per their procedures. 1.2 Eligible Entities a) Every IVNTI shall be established and administered by any of the following persons: i. An individual; or ii. HUF; or iii. Society registered under Societies Registration Act, 1860, as amended from time to time or any other relevant Acts; or iv. Trust registered under Indian Trust Act, 1882 or any public charitable trust registered under applicable State Trust legislation, as amended from time to time or any other relevant Acts through the Chairman/President/Secretary of the Trust; or V. Company established under Companies Act, 1956 or Companies Act, 2013; or vi. Central or State Government or UT Administration or by a Society or a Trust registered by them; or vii. Limited Liability Partnership within the meaning of Limited Liability Partnership Act, 2008; or viii. Partnership firm within the meaning of Indian Partnership Act, 1932; or ix. An association of persons or a body of individuals, whether incorporated or not; or Χ. any other artificial juridical person, not falling within any of the above. 1.3 Application & Approval process of the Institute (a) The approval of the application shall be in two phases: i. In-principle approval; and ii. Final approval (b) Every application for grant of in-principle approval and final approval shall be submitted through the portal along with the processing fees. (c) The processing fee for seeking in-principle approval, final approval and approval for shifting of premise shall be specified by the Approving Authority. (d) The application for grant of in-principle approval shall contain the following particulars: i. Details of land or premises where the institute is proposed to be established along with proof of ownership or lease or the proposed agreement to sell from the owner of the land/premises or proposed agreement to lease along with a no-objection certificate from the owner. ii. Details of the proposed infrastructure in accordance with Part 2 of this Schedule. iii. Proposed name of the IVNTI which shall be also be approved by the Approving Authority. Provided the usage of words including "Government", "India", "National", "State" shall be prohibited in accordance with Emblems and Name (Prevention of Improper use) Act, 1950. iv. Every IVNTI shall be required to have a unique name. V. Proposed source of funding of IVNTI for initial capital expenditure and recurring expenditure vi. Business Plan and Project Feasibility Report which shall include: A. the proposed batch strength for every course which shall not be less than 20 students for each course; B. the frequency with which each course shall be conducted annually; C. the proposed fee structure for every course; D. the proposed number of classrooms; and E. the proposed number of faculty. vii. The annual capacity for each course shall be based on the approved batch strength for every course and the frequency with which every course shall be conducted annually. The total annual capacity for all courses to be conducted shall be a sum of the annual capacity of all courses. viii. The details of the proposed statutory courses and value-added courses to be conducted in the institute shall be submitted. (e) The Screening Committee as constituted by the Approving Authority shall evaluate the application and supporting documents. Based on the recommendations of the Screening Committee and the material on record, the Approving Authority shall grant in-principle approval or reject the same, within a month from the date of application. In cases of deficiency in application, it shall be communicated to the applicant and he/she can re-apply after rectification. If in-principal approval is granted, a system- generated unique provisional IVNTI No. will be issued to the Institute. (f) The validity of the in-principle approval shall be 5 years from the date of its receipt for commencement of long-term residential courses and 2 years from the date of its receipt for commencement of classroom courses. 1.4 Procedure for final approval of the Institute (a) The applicant shall communicate the readiness of the institute anytime within the period of validity of in-principle approval, to the Approving Authority, after which Field Visit Committee (“FVC”) shall physically verify the readiness of the institute. (b) Applicants shall submit their application for final approval along with self-attested copies as per online application formats. (c) The Screening Committee shall evaluate application along with self-attested copies submitted by the applicants. (d) FVC shall be constituted by Approving Authority. The FVC shall verify physically the infrastructural facilities of the institution. (e) FVC shall verify readiness with respect to infrastructure, administration, amenities, laboratory equipment, relevant documents and other essential and desirable requirements of the IVNTIs. (f) FVC shall also verify the progress made in appointing the Principal/ Director and faculty under the conditions specified in this Schedule. (g) The FVC may ask for the original documents for verification. (h) They shall verify the actual availability of equipment as per the curriculum and syllabus and computers, software, internet, printers, book titles, book volumes, subscription of national and international journals and entry in the digital stock registers of the IVNTI. (i) At the time of physical inspection by FVC, the institution shall arrange for video recording at the expense of the institution, with the date and time of the entire proceedings of the FVC. The institution shall upload the same on the website of the training institute and share the link in the web portal. (j) After completion of the verification, the FVC shall submit its recommendations to the Approving Authority. (k) Applicants shall be called for making presentation to the Approving Authority. 1.5 Grant of Final Approval (a) Approving Authority after considering the recommendations of the Committees, and material on record shall take a decision i.e. either decide to grant approval or otherwise communicate deficiencies or may reject the same within 60 days of receipt of an application for final approval. In case of communication of deficiencies, the applicant may re-apply after rectification. (b) The decision of the Approving Authority shall be uploaded on the Web-Portal in the form of Letter of Approval (LoA) or Letter of Deficiency (LoD)/ Letter of Rejection (LoR). In case of rejection, specific reasons for rejection shall be communicated. (c) The applicant must obtain the final approval within the validity period of in-principle approval. (d) The permanent IVNTI No. will be issued once the IVNTI is approved for conducting statutory or other courses 1.6 Approval of courses conducted by IVNTI (a) The courses offered by the institute shall be in accordance with Inland Vessels (Manning) Rules, 2022 and the syllabus and duration of the courses shall be such as may be specified IWAI. (b) Approval of "Basic safety and security Training" course [i.e. Personal Survival Techniques (PST), Personal Safety & Social Responsibility (PSSR), Elementary First Aid (EFA), Fire Prevention & Fire Fighting (FPFF)] and Security Training for Seafarers with Designated Security Duties (STSDSD) shall be considered as a composite package at any point of time (c) No Inland Vessel Navigation Training Institute shall be approved for less than five courses. The Basic safety and security Training course which consists of 5 courses as mentioned in 1.10.3 shall be considered equivalent to 5 courses. (d) All the approvals of IVNTI shall be deemed to be withdrawn if the Inland Vessel Navigation Training Institute conducts less than five courses for a period of six months. 1.7 Transfer of premises Institutes shall apply afresh with applicable processing fees for approvals in case of transfer or shifting of premises of the institute from one location or place to another location or place. Institute shall actually shift only after such approval is granted. Such applications shall be disposed within 60 days of receipt. 1.8 Authorized signatories Institutes shall nominate authorized signatories to communicate with the Approving Authority. 1.9 Quality standards The institutes shall comply with the following quality standards: (a) IVNTI's shall obtain ISO certification or equivalent within 12 months of receiving final approval. (b) Compliance with basic safety and security courses as per the syllabus to be specified by IWAI (c) The IVNTIs shall ensure that the principal, faculty, and instructors & visiting faculty comply with the qualifications specified in Part 3 of this Schedule. Part 2 - Infrastructure 2.1 Establishment of new IVNTI (a) Eligibility entity under Section 1.2 of this Schedule must have lawful possession of required leased or owned land or building before submission of application for final approval. (b) The building shall be constructed in accordance with the applicable local or municipal laws and shall have a valid occupancy certificate issued by the statutory authority concerned. 2.2 Land Requirements (a) Land requirements for: i.Institutes proposing to conduct GP Rating courses (residential) shall have an independent campus of a minimum 2 Acres (owned or leased). The period of leased land must be a minimum of 10 years. ii.Institutes proposing to conduct classroom courses only can meet the infrastructure requirement as specified in this schedule through leased/owned premises provided they meet the requisite requirements such as swimming pool, fire mockups tie ups etc on their own or through tie ups. (b) Land or leased premises shall be used primarily for conducting courses approved by the Approving Authority. (c) Construction and Safety of the building shall comply with the following requirements: i. Buildings shall have regular construction with proper roofing. ii. Buildings shall be equipped with fire detection and fire alarm system. iii. Buildings shall have electrical safety and ensure a bug-free environment. iv. There shall be supply of clean and potable water with purification facility. v. There shall be an alternate source of electric supply for essential services. 2.3 Facilities (a) Administrative and Faculty Areas shall comply with the following requirements: i. There shall be separate room of at least 8 m² for Principal/head of Institute. ii. There shall be at least 4 m² carpet area per full-time faculty member. iii. Faculty shall be provided with appropriate furniture including chair, table, and cupboard. (b) Classrooms shall comply with the following requirements: i. size requirements shall be at least 30 m² for upto 20 students, at least 36 m² for upto 24 students, at least 50 m² for upto 40 students. The minimum size of a class room shall be 30 m². ii. clear visibility shall be ensured. iii. provisions shall be made for raised platform, table, and chair for faculty. iv. every student shall be provided with desk and chair. V. notice board shall be provided in common area and at classroom entrance. vi. provision for good ventilation, lighting, and temperature control shall be made. (c) The following teaching aids shall be provided: i. overhead Projector or computer with projector in each classroom. ii. technology based aids such as educational apps, interactive whiteboards iii. black or white or smart boards with writing materials. iv. audio-visual equipment, maps, and models of vessels. V. learning management systems (d) There shall be a dedicated library and shall comply with the following requirements i. area of 20-50 m² based on course type. ii. adequate seating, lighting, and ventilation. iii. stocked with textbooks, publications, and reference materials. iv. at least three internet-enabled workstations shall be provided. (e) Following general facilities shall be provided: i. photocopying facilities ii. refreshment area with hygienic food service. iii. toilet facilities (1 per 40 candidates, 75% urinals). iv. internet facilities V. recreation room and playground for residential courses vi. parade ground and auditorium for residential courses 2.4. The following academic facilities shall be provided: (a) Computer Training i. There shall be dedicated space for computer training. ii. At least 5 workstations shall be provided per 40 candidates. (b) Boat Work and Swimming Facilities i. Formal agreement with outside agencies, if on-campus facility is not possible. ii. Swimming pool (50 ft x 30 ft, depth 3-12 ft) or tie-up arrangement with similar specifications. (c) Fire Fighting Mock-up Own facility or tie-up arrangement for practical training. (d) Catering (for Residential Courses i.e. GP Rating Courses) i. Hygienic kitchen with proper ventilation and pest control. ii. Nutritious and fresh food served. iii. Dining hall to seat all candidates (or half with staggered meal times). iv. Wash facilities for utensils and hand washing. (e) Hostel and Residential Facilities i. Rooms A. Maximum 4 candidates per room. B. Minimum 4 m² floor area per candidate. C. Two-tier bunks allowed for rating candidates. ii. Ventilation and Utilities A. Natural ventilation with adequate lighting and fans. B. Cupboard space, cot, mattress, and personal utilities provided. iii. Toilet Facilities A. 1 wash basin, 1 shower, and 1 WC per 4 candidates. B. 1 urinal per 20 candidates. C. Western-style WCs with toilet seats. D. 24-hour water supply with hot water in showers. iv.Linen and Laundry A. New linen shall be provided at the commencement of courses. B. Weekly linen change shall be done. C. Laundry service, in-house or outsourced, as the case may be shall be provided. D. Ironing facilities shall be provided. Part 3 - Human resources 3.1 General Requirements (a) A Principal/Head shall be appointed on permanent basis. (b) Courses require qualified faculties in accordance with Part 3.2 of this Schedule. (c) 50% of faculty in each category of courses must be full-time. (d) Visiting faculty shall be engaged on a part-time basis. (e) Permanent faculty shall be available during working hours. (f) Contractual faculty employed for equal to or more than 3 months shall be considered permanent. (g) Encourage industry experts to contribute as visiting faculty. (h) A designated course in-charge shall be in place for every course. (i) 50% of lectures or training by permanent faculty (j) Emphasize on the pedagogic abilities of faculty. (k) Proper employment contracts for faculty shall be required. 3.2 Qualification and Exemption (a) Emphasize pedagogic abilities. (b) Principal/Vice-Principal shall have the following minimum qualifications: Minimum COC as Master (FG) or Chief Engineer (MEO Class I) or holder of Certificate of Services (COS) having served as a master or engineer of the vessel of the Coast Guard, Indian Navy or Army. (c) Faculty shall undertake Trainer and Assessor Course as mandated by IWAI from time to time (d) For courses as per Inland Vessels (Manning) Rules, 2022 preference shall be given to faculty who have an M.Sc./ M.Tech / B.Tech / Domain Experts. (e) Instructors must be qualified and experienced in subject matter. (f) Minimum & detailed qualification requirements for faculty shall be: i. Possesses a Ministry of Transport Master (Foreign Going) or Marine Engine -Officer (MEO) Class I Certificate of Competency issued by Director General of Shipping with minimum 5 years' experience as Certificated Officer on ships or State Maritime Boards or Directorate General of Shipping or Ports; from any DG Shipping approved training institute / IWAI approved institutes prospectively, or ii. Possesses a Ministry of Transport First Mate (Foreign Going) or Marine Engine -Officer (MEO) Class II Certificate of Competency issued by Director General of Shipping with minimum 7 years' experience as Certificated Officer on ships or State Maritime Boards or Directorate General of Shipping or Ports; from any DG Shipping approved training institute / IWAI approved institutes prospectively or iii. Possesses academic qualification Secondary School Certificate (SSC) and above along with an Inland Vessel Master Class I or Inland Engineer Certificate with a minimum of 15 years of service onboard inland vessels as Certificated Officer of which at least 5 years shall be in the capacity of a Master or Chief Engineer; or iv. Possesses a Master [Near Coastal Voyage Vessel (NCV)] or Marine Engine -Officer (MEO) Class III (Near Coastal Voyage Vessel -Chief Engineer Officer) Certificate with a minimum of 10 years of sailing experience of which at least 5 years shall be in the capacity of Master or Chief Engineer. V. The personnel from Indian Navy/Coast Guard have under gone long Navigation and Direction (Long ND) course with a minimum of 5 years of sailing experience and Education Officers with minimum of 5 years teaching experience (g) The faculty for GP Rating courses and basic STCW Safety Training and STSDSD course shall be minimum holder of COC as Master-NCV, or Chief Mate (FG) or MEO Class III (CEO) or MEO Class II. 3.3 Teaching Hours (a) Principal/Vice Principal: Maximum 16 hours per week. (b) Permanent faculty: Maximum 18 hours per week. (c) Instructors: Maximum 24 hours per week. 3.4 Age and Medical Fitness (a) Maximum Age limits for: i. Principal or permanent faculty is 70 years; ii. visiting faculty is 72 years; iii. instructor is 65 years. 3.5 (b) Staff must be medically fit and capable of clear communication. Faculty Load Matrix / Details (a) Keep staff details updated at all times on the website of the institute and the centralized web portal. (b) Whenever there is change in Principal, faculty and instructor, the IVNTI must upload a fresh the complete faculty load matrix. If there is no change, the complete faculty load matrix is to be uploaded every six months. Part 4 - Administrative requirement 4.1 Advertisements/Brochure/Prospectus and Websites (a) Full disclosure shall be required in advertisements promoting the IVNTI. (b) Advertisements or brochure or prospectus shall include statement about on-board training. (c) No misleading claims should be made. 4.2 Admission Standards (a) Any Indian citizen desirous of obtaining admission in an approved training institute shall meet the eligibility criteria specified under the Inland Vessels (Manning) Rules, 2022. (b) Any foreign citizen desirous of obtaining admission in an approved training institute shall meet the required equivalent qualifications. 4.3 Verification of Documents (a) Scrutinize original documents before admission. (b) Issue original certificates upon course completion. 4.4 Course Fees (a) Course fees shall be fixed by individual institutes. (b) A uniform fee structure shall be specified by the approved training institute. Provided that different fee structures which are lower than the uniform fee structure, may be specified for candidates belonging to SC, ST, EWS and women. (c) The IVNTI shall give proper receipts for fee charge to the candidate. The IVNTIs shall not collect any fee in cash. 4.5 Practical Training (a) Compulsory video recordings of all practical training shall be made. 4.6 Batch Details (a) Upload batch details on the website of the institute and the centralized web portal within stipulated time. 4.7 Biometric Attendance (a) The minimum attendance required shall be 100% for courses whose duration is less than 6 days and 80% for all other courses. (b) Biometric attendance for all staff and candidates shall be mandatory. 4.8 Conduct of Course (a) Follow course guidelines and syllabus published by IWAI and update the content from time to time. (b) Monthly timetable shall be published on website of IVNTI. (c) Courses shall be conducted only during daytime hours. (d) No partial course conduct allowed that is the course material should be covered in its entirety. (e) Staggered batches may be allowed for certain courses. (f) Batch numbering system shall start with 001 every year. (g) Year shall be construed as calendar year. 4.9 Evaluation and Monitoring (a) IVNTIs shall implement continuous evaluation system. 4.10 Final Examination (a) Conduct final examinations in accordance with Inland Vessels (Manning) Rules, 2022/Guidelines issued by IWAI. (b) Re-examination for failed candidates. 4.11 Certificate Issuance (a) Format of course completion certificate shall be such as may be specified by IWAI. (b) Include IVNTI No. on all certificates. (c) Use system-generated certificate numbers. (d) Authorized signatories shall be required to sign the certificate. 4.12 Uniforms and Identity Cards (a) Mandatory wearing of prescribed uniforms for faculty and candidates on campus. (b) All staff, faculty and candidates must have laminated photo identity cards. 4.14 Value Added Courses (a) Every IVNTI shall provide intimation for starting value added courses and shall ensure that the statutory courses shall not be compromised due to the conduct of any other value-added courses (b) A disclaimer shall be added for value added course stating that they are non-statutory. 4.15 Feedback Mechanism (a) Implement compulsory feedback mechanism and obtain feedback from the candidates on completion of course. 4.16 Ban on Ragging (a) Enforce strict measures to prevent ragging. (b) Report all cases to Approving Authority. 4.17. Placement of students for shipboard training Every IVNTI shall have a placement cell which shall endeavor to provide placements on inland vessels. 4.18 Records Maintain the following records for 5 years which shall be readily made available for verification: a) Final approval granted under this Schedule b) Proof of ownership or valid lease deed c) Tie-up or any other agreements for swimming pool and other such facilities, if any d) Admission records e) Documents related to practical training facility details/type approval etc., such as fire mock up, swimming pool, water body, type approvals, load test etc. f) Last Comprehensive Inspection Programme report, surprise inspection report, quality audit report g) Advertisements and brochures published h) Complete Faculty load matrix i) Complete classroom utilization chart j) Records of placement of candidates k) Application and attested photocopy duly signed by the respective candidate of all supporting documents. l) Records of fee charged to the candidate m) Bio metric attendance report of Principal, permanent faculty, visiting faculty, instructors, and n) Answer-scripts and other assessment records for at least twelve months thereafter. Further the approved or authorizes agency may also ask questions to some of the candidates during the surprise/annual inspection to assess the general quality of training imparted. o) Records of faculty / instructor training and faculty / instructor evaluation. p) Record of written declaration by the visiting faculty stating that he/she shall not exceed 18 hours of delivering lectures in a week. q) Record of annual medical fitness of Principal, faculty and instructors above 65 years of age r) Record of all cases of ragging, however minor and the action taken thereon by the Institute s) Feedback data from candidates and stakeholders in paper/ electronic form Part 5 - Inspection and disciplinary action a) Inspection i. Field Visiting Committee may conduct inspections biennially and may also carry unscheduled inspections with the permission of Approving Authority. ii. Inspections shall verify compliance with the administrative requirements specified in Part 4 of this Schedule. iii. Inspection reports shall be communicated within 7 days to the institutes stating deficiencies and rectification timeframe. b) Comprehensive Inspection Programme (CIP) i. IVNTIs shall undergo CIP inspections at intervals of five years. ii. The Grading shall be valid for five years from the date of conduct of the CIP unless revoked by the Approving Authority concerned. However, the Approving Authority may re-assign the grading during the biennial inspections or based on Additional inspections at the request of the Institute. c) Methodology for Grading shall be such as may be specified by IWAI. d) External Assistance for Inspection i. Approving Authority may empanel external members to assist in inspections. ii. External inspectors shall meet the following requirements: A. Not more than 72 years old B. Holder of COC as master (FG) or MEO Class-I C. Completed ISO lead auditor course d) Suspension and Cancellation of Final Approval i.The approving authority may suspend or cancel the final approval granted to a IVNTI if: A. it has reason to believe that such institute has contravened any standard specified in this Schedule, as a result of any inspection carried out under this Schedule or otherwise; or B. The Grading assigned to the IVNTI after conduct of the CIP is below average or poor. ii. The approving authority shall, after giving the owner of IVNTI an opportunity of being heard, issue a notice of suspension to the IVNTI stating the errors to be rectified and conditions that have to be complied with by the IVNTI, along the time period within which such rectification may take place from the date of issuance of such notice. Provided that in case of any major deficiency or major deviation from this Schedule by the IVNTI the approving authority may issue the notice of suspension immediately. iii.After issuance of a notice of suspension, the IVNTI shall not admit any new students till the errors and conditions specified in the notice of suspension are complied with by the IVNTI within the period specified in such notice. iv.In the event of non-compliance with the notice of suspension by the IVNTI within the period specified in such notice, the approving authority may issue the order of cancellation of the final approval recording the non-compliance, after giving the owner of IVNTI an opportunity of being heard, which shall come into force with immediate effect. v.In case of emergencies, the approving authority may issue directions to any institute based on inspections or other material on record to cure deficiencies. vi.No IVNTI shall operate after its final approval has been cancelled by the Approving Authority. e) Display of approvals All approvals issued by the Approving Authority shall be displayed on a prominent place in the training institute and its website, if any. f) Discontinuation of Courses/Closure of Institution i.Every IVNTI before discontinuing a particular course or closure of the institute, shall give a three month's intimation to the Approving Authority prior to such discontinuation or closure. Provided that individual basic safety and security courses from the composite package of five basic safety and security courses shall not be discontinued. ii.Courses for existing batches shall continue to be held till their completion and no existing batch shall be adversely affected by way of such discontinuation of course or closure of the institute." 19. In the said rules, in Form No. 1, before serial number 1 relating to Name of the applicant, for the words "Inland Waterways Authority of India empanelled MBBS medical practitioner or medical officer", the words "MBBS doctor" shall be substituted. 20. In the said rules, in Form No. 2, for the words "see rule 13(1)", the words "see rule 18(3)" shall be substituted. 21.
