No. J-11013/36/2008-IA.II(I)) and signed by Amandeep Garg, Additional Secretary, issued in exercise of powers under sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) and in pursuance of notification S.O. 1533(E) dated 14th September 2006, constitutes the State Level Environment Impact Assessment Authority, Bihar (SEIAA), comprising Shri Ashutosh (Chairman), Shri Sudhir Kumar Karn (Member), and the Conservator-cum-Additional Secretary, Environment, Forest and Climate Change Department, Government of Bihar (Member Secretary), each to hold office for three years from the date of publication. The Authority shall decide matters on recommendations of the State Level Expert Appraisal Committee, Bihar (SEAC), also constituted by this notification in consultation with the State Government of Bihar, comprising Shri Arvinder Singh (Chairperson), Shri Lalan Prasad Singh, Dr. Nityanand Singh Maurya, Shri Swami Nath Jayaswal, Dr. Vinita Prasad, Dr. Md. Nazim, Prof. Naveen Kumar Nishchal, Shri Mokhtarul Haque, and the Member Secretary of the Bihar State Pollution Control Board, each to hold office for three years. The notification prescribes that decisions shall ordinarily be unanimous or, if by majority, recorded with reasons; requires members to declare consulting affiliations and recuse themselves from matters involving conflicts of interest, including where they provided consultancy or conducted Environment Impact Assessment studies for a project proponent in the preceding five years; requires the State Government of Bihar to designate a Secretariat providing financial and logistic support; and provides that sitting fees, travelling and dearness allowances shall be paid per the Bihar State Government's rules.

L.-33004/99 The Gazette of India CG-DL-E-03122024-259122 EXTRAORDINARY PART II—Section 3—Sub-section (ii) PUBLISHED BY AUTHORITY No. 4800] NEW DELHI, MONDAY, DECEMBER 2, 2024/AGRAHAYANA 11, 1946 7798 GI/2024 MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 2nd December, 2024 S.O. 5192(E).—In exercise of the powers conferred by sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) and in pursuance of the notification of the Government of India in the erstwhile Ministry of Environment and Forests, number S.O. 1533(E), dated the 14th September, 2006 (hereinafter referred to as the said notification), the Central Government hereby constitutes the State Level Environment Impact Assessment Authority, Bihar (hereinafter referred to as the Authority) comprising of the following Members, namely: — (i) Shri Ashutosh A-18, 9th Floor, Shreeram Heights, Near MIT College, Kothrud, Pune-411038 (Maharashtra) Chairman; (ii) Shri Sudhir Kumar Karn, G13B, Sail City, Ranchi-834007 (Jharkhand) Member; and (iii) Conservator-cum-Additional Secretary, Environment, Forest and Climate Change Department Government of Bihar, Ground Floor, Sinchai Bhawan, Patna, Bihar Member Secretary. 2. The Chairman and Members of the Authority shall hold office for a period of three years from the date of publication of this notification in the Official Gazette. 3. The Authority shall exercise such powers and follow such procedures specified in the said notification. 4. The Authority shall take its decision on the recommendations of the State Level Expert Appraisal Committee constituted under paragraph 6 for the State of Bihar. 5. All decisions of the Authority shall be taken in a meeting and shall ordinarily be unanimous: Provided that, in case a decision is taken by majority, the details of views, for and against it, shall be clearly recorded in the minutes and a copy thereof sent to the Central Government. 6. The Central Government, in consultation with the State Government of Bihar, for the purpose of assisting the Authority, hereby constitutes the State Level Expert Appraisal Committee, Bihar (hereinafter referred to as the Committee), comprising of the following Members, namely:— (i) Shri Arvinder Singh Chairperson; Forest Bunglow No.3, Shaheed Peer Ali Khan Marg (Riding Road), Aranya Bhawan Patna, 800014 (Bihar). (ii) Shri Lalan Prasad Singh Member; NOBA Nagar, Phase-2, Khojai Imli Mazaar, Phulwari Sharif, Patna-801505(Bihar). The Chairperson and Members of the Committee, shall hold office for a period of three years from the date of publication of this notification in the Official Gazette. 8. The Committee shall exercise such powers and follow such procedure specified in the said notification. 9. The Committee shall function on the principle of collective responsibility and the Chairman shall endeavour to reach a consensus in each case, and if consensus cannot be reached, the view of the majority shall prevail. 10. In order to avoid any conflict of interest,— (i) the Chairman and Members of the Authority, and the Chairperson and Member of the Committee shall,— (a) declare to which consulting organisation they have been associated with and also the project proponents; (b) not undertake any consultation or associate with regard to preparation of Environment Impact Assessment and Environment Management Plan for project, which is to be decided by the Authority or to be appraised by the Committee during their tenure; and (ii) if the Chairman or any Member of the Authority or the Chairperson or Member of the Committee has provided consultancy services or conducted Environment Impact Assessment studies for any project proponent during the preceding five years, in that event they shall recuse themselves from the meetings of the Authority, or the Committee in the process of appraisal of any project proposed by such proponents. 11. The State Government of Bihar shall specify an agency to act as Secretariat for the Authority and the Committee and the Secretariat shall provide financial and logistic support including accommodation, transportation and such other facilities in respect of their functions under the said notification. 12. The sitting fee, travelling allowances and dearness allowances to the Chairman and Members of the Authority and the Chairperson or Member of the Committee, shall be paid in accordance with the provisions of relevant rules of the State Government of Bihar.
