Secy., File No. J-11013/41/2007-IA.II(I)), this notification amends the Central Government's notification S.O. 4894(E) dated 23 November 2021 (itself issued under S.O. 1533(E) dated 14 September 2006), which had constituted the State Level Environment Impact Assessment Authority, Chhattisgarh and its State Level Expert Appraisal Committee (SEAC); the amendment follows a National Green Tribunal (Principal Bench) direction in O.A. 142 of 2022 (Jayant Kumar v. Ministry of Environment, Forest and Climate Change) that SEAC appraise/re-appraise environmental clearances issued by District Level Environment Impact Assessment Authorities (DEIAA) up to 11 December 2018, with clearances granted on or after 12 December 2018 to be appraised by the state-level authority under the Environment Impact Assessment, 2006, as well as a request from the Government of Chhattisgarh to constitute additional committees and replace the SEAC Chairman; the notification substitutes references to "SEAC" with "SEAC-1, SEAC-2 and SEAC-3" throughout, replaces serial number 1 of the committee table with Shri Ashish Kumar Bhatt, reallocates the state's districts among the three new committees (including Kondagaon, Narayanpur, Bastar, Bijapur, Dantewada and Sukma among others), and provides that the tenure of the Chairmen and Members of SEAC-1, SEAC-2 and SEAC-3 shall be co-terminus with the Authority, Chhattisgarh.

Ministry of Environment, Forest and Climate Change, has directed that the State Level Expert Appraisal Committee shall appraise /re-appraise the environmental clearance issued by the District Level Environment Impact Assessment Authority (DEIAA) upto 11.12.2018. In case of environmental clearances granted on or after 12.12.2018 by DEIAAs, the appraisal has to be made by the State Level Environment Impact Assessment Authority and environmental clearances are to be granted in accordance with the provisions of Environment Impact Assessment, 2006. AND WHEREAS the State Government of Chhattisgarh has requested for the constitution of additional Committees to assist the Authority by re-appraising the environmental clearance issued by District Level Environment Impact Assessment Authority and grant a fresh environmental clearance. AND WHEREAS the State Government of Chhattisgarh has also requested that Chairman SEAC may be replaced; AND WHEREAS the Central Government in consultation with the State Government of Chhattisgarh has decided to constitute two additional State Level Expert Appraisal Committees for Chhattisgarh for the purpose of assisting the Authority; Now, THEREFORE, in exercise of the powers conferred by sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) and in pursuance of the notification of the Government of India in the erstwhile Ministry of Environment and Forests, number S.O. 1533 (E), dated 14th September, 2006, the Central Government hereby makes the following amendments in the notification of the Government of India in the Ministry of Environment, Forests and Climate Change, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub- section (ii), vide number S.O. 4894 (E), dated the 23rd November, 2021 (hereinafter referred to as the said notification), namely:- In the said notification,- (a) for the words and figures “SEAC” wherever they occur, the words "SEAC-1, SEAC-2 and SEAC-3" shall be substituted; (b) in paragraph 4, for the words, "the State Level Expert Appraisal Committee", the words "the State Level Expert Appraisal Committees (SEAC-1, SEAC-2 and SEAC-3)" shall be substituted; (c) in paragraph 5,- (i) for the words, brackets and figures "constitutes State Level Expert Appraisal Committees (hereinafter referred to as SEAC, Chhattisgarh)", the words, brackets and figures, “Constitutes three State Level Expert Appraisal Committees, that is, the State Level Expert Appraisal Committee-1, State Level Expert Appraisal Committee -2 and the State Level Expert Appraisal Committee-3 (hereinafter referred to as the SEAC-1, SEAC-2 and SEAC-3)", shall be substituted; (ii) The words "SEAC-1,” shall be inserted above the table.
