Detailed Summary

The Union Territory of Ladakh Reservation (Amendment) Regulation, 2025 (No. 1 of 2025), promulgated by the President on June 2, 2025, under powers conferred by article 240 of the Constitution and sub-section (2) of section 58 of the Jammu and Kashmir Reorganisation Act, 2019 (34 of 2019), amends the Jammu and Kashmir Reservation Act, 2004 (XIV of 2004). This Regulation extends to the whole of the Union territory of Ladakh and will come into force on a date appointed by the Central Government. Key amendments include: in section 3, sub-section (1), the first proviso is substituted to cap the total percentage of reservation at 85%, excluding Economically Weaker Sections; in section 5, sub-section (1), the second proviso is omitted, and a new sub-section (5) is inserted, stating that this section does not apply to Economically Weaker Sections and their vacancies shall be filled as prescribed; in section 6, the first proviso is substituted to cap the total percentage of reservation at 85% of available vacancies, excluding Economically Weaker Sections; and in section 9, sub-section (1), the first proviso is substituted to cap the total percentage of reservation at 85%, excluding Economically Weaker Sections. In exercise of the powers conferred by article 240 of the Constitution read with sub-section (2) of section 58 of the Jammu and Kashmir Reorganisation Act, 2019, the President is pleased to promulgate the following Regulation made by her:— 34 of 2019. 1. (1) This Regulation may be called the Union territory of Ladakh Reservation (Amendment) Regulation, 2025. (2) It extends to the whole of the Union territory of Ladakh. (3) It shall come into force on such date as the Central Government may, by notification in the Official Gazette, appoint. Short title, extent and commencement. XIV of 2004. 2. In the Jammu and Kashmir Reservation Act, 2004 (hereinafter referred to as the principal Act), in section 3, in sub-section (1), for the first proviso, the following proviso shall be substituted, namely:— "Provided that the total percentage of reservation shall in no case exceed 85%, excluding reservation for Economically Weaker Sections:". 3. In the principal Act, in section 5,- (a) in sub-section (1), the second proviso shall be omitted; (b) after sub-section (4), the following sub-section shall be inserted, namely:- "(5) Nothing contained in this section shall apply to Economically Weaker Sections and filling up of vacancies for such Sections shall be in such manner as may be prescribed.". 4. In the principal Act, in section 6, for the first proviso, the following proviso shall be substituted, namely:- "Provided that the total percentage of reservation shall in no case exceed 85% of the available vacancies, excluding reservation for Economically Weaker Sections:". 5. In the principal Act, in section 9, in sub-section (1), for the first proviso, the following proviso shall be substituted, namely:— "Provided that the total percentage of reservation shall in no case exceed 85%, excluding reservation for Economically Weaker Sections:".
